HomeMy WebLinkAbout34197 / 86-404December 4, 1986 (CARRIED PURPOSE: LOST LAID OVER //404 RESOLUTION WITHDRAWN ) CONTRACT WITH OSHKOSH CITY CAB COMPANY TO PROVIDE DIAL-A-RIDE SERVICE FOR PERSONS AGE 60+ IN�OSHKOSH INITIATED BY: DEPARTMENT OF COMMUNITY DEVELOPMENT WHEREAS: The City of Oshkosh has contracted with Oshkosh City Cab Company for a"Dial-A-Ride" transit service, since 1975, for older adults age 60 and over in the City of Oshkosh, and WHEREAS: The Oshkosh City Cab Company has agreed to continue offering the service at the same reimbursement rate for 1987 as in 1986 ($1.50 or $2.00 for each one way ride in the residential city limits from the riders with $.70 subsidy for each one way ride from the program), and WHEREAS: $15,929 continues to be available from State Transportation funds, $5,000 from project contri- butions and $9,651 from City of Oshkosh funds NOW THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the proper city officials are hereby authorized and directed to enter into the attached agreement with Oshkosh City Cab Company. Be it Further Resolved that money for the purpose is appropriated from Account No. 076-561, Committee on Aging, Dial-A-Ride. �u�TF!:w:_mi:s� �i� i �� _ _ .��. _ __. __ I - ,, ""�` � �.�,--- - -; __.__... _ _ _ __ __._. �_.--- _( _ _ __ _ __ ...---- ----- --_ -�:: --,;. -23- RESOLUTION # 404 AGREEMENT AND CONTRACT between CITY OF OSHKOSH and OSHKOSH CITY CAB COMPANY This AGREEMENT AND CONTRACT made and entered into this day of 19 , by and between the City of Oshkosh, hereinafter referred to as "City", party of the first part, and OSHKOSH CITY CAB COMPANY, A WISCONSIN CORPORATION, hereinafter referred to as "OSHKOSH CAB", party of the second part. WITNESSETH: WHEREAS, the City wishes to make transportaion services available, specifically taxicab transportation, to the elderly citizens (elderly defined as those individuals over 60 years of age), of the community at a reduced rate of cost to them; and WHEREAS, OSHKOSH CITY CAB COMPANY is now and for manp vears bast has been engaged in the operation of a taxicab business in the City of Oshkosh, Wisconsin and certain surrounding areas; and WHEREAS, the City has contracted with Oshkosh City Cab Company since 1975 to provide subsidized transportation service using taxicabs and has been satisfied with this service; NOW, THEREFORE, in consideration of the mutual promises and covenants of the parties hereto, it is agreed as follows: 1. GENERAL DESCRIPTION-AND BOUNDARIES OF DIAL-A-RIDE SYSTEM a. It is agreed that a DIAL-A-RIDE SYSTEM shall be offered whereby OSHKOSH CITY CAB COMPANY will provide transportation, within specified boundaries of the City of Oshkosh, at a reduced rate of cost to the elderly persons in the community. - 23a - J -2- b. That the presentation of $1.50 (or $2.00 depending on where trip originates and is completed) plus one DIAL-A-RIDE ticket wi11 entitle any elderly person to one trip within said area. d. That additional riders picked up at one place and discharged to- gether contribute SO cents each without using a ticket. 2. PURCHASE, SALE, AND USE OF DIAL-A-RIDE TICKETS a. DIAL-A-RIDE patrons must purchase DIAL-A-RIDE tickets from authorized sale points; such sale points to be announced and determined by the City. b. That the Director of the Oshkosh Seniors Center shall control and coordinate the distribution of, sale of, and inventory of said DIAL-A-RIDE tickets c. Patrons not holding DIAL-A-RIDE tickets, will be considered as taxicab passengers and transported at regular taxicab fares. d. If a patron desires to go beyond the DIAL-A-RIDE boundaries he or she will be considered a regular taxicab passenger, and charged accordingly, however, OSHKOSH CAB will accept a DIAL-A-RIDE ticket as seventy cents toward the total fare. 3. ARRANGING TRANSPORTATION UNDER THE DIAL-A-RIDE SYSTEM a. The DIAL-A-RIDE patron will call a specified number. b. That upon reaching the specified number the DIAL-A-RIDE patron will give his name, address, the number of passengers involved, the approximate time he wants the transportation, destination, and return time. c. The DIAL-A-RIDE patron should be advised to call for service as needed like any patron of the cab company. d. The DIAL-A-RIDE number will be open for calls 24 hours a day and service will be available 24 hours a day, seven days per week. e. It is further agreed that under the System, a patron shall be permitted to place a scheduled pickup request; for example, if a person - 23c - � RESOLUTION # 404 desires to be picked up at the same time every morning to be taken to work or in the evening from work to home, the request will automatically be repeated without the need to place a phone call each time. f. Futhermore, the DIAL-A-RIDE service may be on a shared basis; if the service receives additional call(s) for DIAL-A-RIDE pickups in the vicinity of the first call, or near the route of patrons in the vehicle, the vehicle will deviate from the route to pickup the additional passenger(s). g. OSHKOSH CAB will take all possible precautions to avoid any undue delay of any patrons, either at point of pickup or enroute. h. The drivers of the DIAL-A-RIDE vehicles will assist in the loading and unloading of parcels and personal effects. i. DIAL-A-RIDE vehicles will not wait for more than two minutes for patrons at any one point. j_ If special assistance is needed to qet into the vehicle or if a driver needs to come to the door to give assistance, it should be re- quested when the initial call is made to request a ride. 4. VEHICLES AND SPECIFICATIONS: PRIORITIES FOR USE OF VEHICLES a. Vehicles will be conventional four-door sedans, equipped as taxicabs S. BUDGET, COSTS AND COMPENSATION FOR THE DIAL-A-RIDE SYSTEM a. The monies have been grated by the Winnebago County Committee on Aging, and the City for the institution of said transportation system. b. OSHKOSH CAB will bill the City twice a month; billings will be made within a week after the 15th of each month and within a week after the end of each month. c. Billings and used DIAL-A-RIDE tickets will be sent through the Director of the Oshkosh Seniors Center, who will verify said amounts and forward said billings to the City for payment. - 23d - -5- RESOLUTION # 404 d. Payment by the City shall be made by the 3rd Friday of each month for services rendered the previous month. 6. DURATION OF CONTRACT a. This contract will remain in effect and bind said parties to its conditions and covenants for one year from the lst of January, 1967. b. OSHKOSH CAB or the City shall give 30 days notice prior to any discontinuance or change in services provided. 7. INSURANCE: FINANCIAL RESPONSIBILITY a. OSHKOSH CAB agrees to and does hereby hold the City harmless and does hereby indemnify the City against any claims or demands of any per- son arising by reason of OSHKOSH CAB's operation of said system. b. OSHKOSH CAB shall carry the required workmen's compensation insurance; shall provide property damage insurance of not less than $350,000.00 coverage per occurence, with the Citv named as an additi.onal insured on said property. c. Any claims arising from said operation shall be handled by OSHKOSH CAB or its insurance carrier and OSHKOSH CAB or said carrier shall defend the City in any litigation arising from such claims, and pay any judgments obtained in any such litigation. 6. PROMOTION AND PUBLICITY a. Any promotion or publicity which the City desires concerning the DIAL-A-RIDE program shall be provided by the City or other persons, with OSHKOSH CAB being under no obligation to expand any sums for such promotion or publicity. 9. PERMITS AND LICENSES a. OSHKOSH CAB shall obtain and pay for required permits and licenses in its operation of the system. -23e- J RESOLUTION # 404 S.� 10. EXCLUSIVE AGREEMENT a. During the teriri of this agreement OSHKOSH CAB shall serve as the exclusive contract a�ent for the City in the operation of the system and the City shall not, during the term of this agreement, enter into an agreement with any other cab company or organization for the operation of a similar system and the City shall not enter into a like agreement with any other person for a similar service during the term of this agreement. 11. AMENDMENTS TO OR CANCELLATIONS OF CONTRACT a. Whenever either OSHKOSH CAB or the City are unable to meet their full responsibilities under the terms of this Contract, adjustments to this Agreement may be mutually agreed upon. It is offered to people at approximately one-half the cost a person would incur if not using Dial-A-Ride,. The service is valid anywhere within the City limits (residential) of Oshkosh. A person must present a Dial-A-Ride ticket (available at 12 locations throughc+l�t the city) to the cab driver plus either $1.50 or $2.00 depending on where they're picked up or going. The tickets are purchased for lOt each. There is a limit of 14 tickets per month unless a person has an exceptional need_ This will be determined through a personal interview on a case by case basis. The service i� door to door and if requested, drivers will come to the door and help a person into the cab. The service is good 24 hours per day, seven days per week. In addition to the amount ccntributed by the user for the cab ride, a subsidy of 70t per ride is paid to the cab company_ It is for this that funds are requested. A service included with this pr000sal and part of the package of offering soecialized subsidized transportation to people age 60 and over in the city is the Cabulance service. This is for older handicapped people whc cannot use the conventional cab. No tickets are used. The user reimburses the Cab company $7.50 for each one way ride. The subsidy given the Cab company is $3.50 per ride. A c•a�ulance ride normally costs $15.00 per one way ride. The Dial-A-Ride service has expanded to include the cabulance service so that handicapped people are not forgotten when providing services, and who tannot afford the cabulance at the normal rate. The rate will be for any person age 60+ and will be good for anywhere within the city limits. - 23k - �� �..
