PURPOSE: APPROVE 1987 CATHOLIC CEMETERY AGREEt�IENT
INITIATED BY: PARKS DEPARTMENT
BE IT RESOLVED by the Common Council of the City of Oshkosh that
the attached Agreement between the City of Oshkosh and the Catholic
Cemetery Association of Oshkosh is hereby approved and that the proper
City officials are hereby authorized and directed to enter into said
aqreement.

AGREEMENT BETWEEN THE CITY OF OSHKOSH
AND THE CATHOLIC CEMETERY ASSOCIATION OF OSHKOSH
RESOLUTIOLI # 432
WHEREAS, the Catholic Cemetery Association of Oshkosh presently owns and
opera[es Calvary Ceme[ery and Riverside Catholic Ceme[ery, and
WHEREAS, [he Catholic Ceme[ery Association of Oshkosh desires [o have the
City of Oshkosh assume maintenance of [he cemeteries and also related du[ies, and
WHEREAS, the City of Oshkosh desires to assume the maintenance and related
duties of the aforemeniioned cemeteries in re[urn for a monetary reimbursement.
NOW� THEREFORE, IT IS HEREBY AGREED between the City of Oshkosh, a municipal
corpora[ion low[ed in Winnebago Coun[y, Wisconsin, hereinaf[er called °Ci[y", and
the Ca[holic Leme[ery Association of Oshkosh, Oshkosh Wisconsin� hereinafter called
"The Catholic Association", as follows:
A. The City of Oshkosh agreas Co provide [he followinq services on the
aforemen[ioned Calvary Ceme[ery and Riverside Ca[holic Cemetery:
1. lurf main[enance commonly associa[ed with a cemetery including w[ting,
sodding� irriga[ion, weed control� and trimming;
2. Snow removal on ceme[ery roads used for funeral services.
3• Lo<ating, spo[[ing, and esiablishing the proper locations for immediate
internments and [heir corresponding markers.
4. Labor for [he repair oF irrigation lines and valves. The cost of needed
supplies and materials wlll be billed [o the Ca[holic Association.
� 5. Equipment and related expenses such as gasoline, oil, and labor used
in normal turf main[enance func[ions.
6. An office will be provided [o the Catholic Cemetery Association, such
to be approxima[ely 9 x 12' and to be located in the building commonly
referred [o as the Riverside Chapel, Such office shall be provided
with adequa[e heat, ligh[s, and related utilities,
7. The Ca[holic Association may reques[ the City of Oshkosh wnduct
internmen[ services ai the approved ra[e schedule and [ha[ the Lity
invoice the appropria[e reques[ing party, and Che City of Oshkosh
may agree to do same. The Ci[y of Oshkosh will not show, locate,
or propose information for lot sales or for sirnilar purposes.

B. The Catholic Association will pay to the City of Oshkosh [he amoun[ of
$24,500.00. Said payments [o be made in quarterly installmen[s, payable by [he
15�h day ot [he mon[hs deemed to be appropriate by the Depar[ment oi Finance of
(he Ci(y of Oshkosh, to [he Collection Oepartment, Ci[y Hall, 215 Church Avenue,
OshkoSh, Wisconsin.
C. The Catholic Association and the Oirector of Parks of the City of
OshkoSh or his designee, will cooperate with each oCher in the use, operation,
security, and hours of operat�on or similar matters with regard ro the cemeteries,
in order [o protect, main[ain, and [o secufe the physical componen[s located
within the ceme[ery and [o pYOVlde proper service within the cemetery. However,
the decision of (he City of Oshkosh will be final whwever a confiict arises.
The Latholic Associaticn agrees to prcvide proper supervision of the offices
[o be rented by it and to use all reasonable efforts [o preven[ vandalism or
damage to Ci[y property, and the Associa[ion agrees m leave any premises
occupied by [hem at the end of [he year in good condition at Ihe termina[ion of
[he agreemen[.
D. 1he Catholic Association will be responsible for any and all cemetery
related ac[ivities, including 6ut �ot limited to, the selling of lots, Au6lishing
and advertising, record keeping, invoicing, and collection of fees. The Lity
will not invoice or collect any fees for lot sales and other services excep[
in direc[ coorelation with Lity services. The Latholic Association will be
responsible fof cemetery activities related to [ree care, i,e., planting,
removal, disposal of all wood, limbs, and leaves associated with the vees.
This does not include fall leaf pick-up or [he maintenan<e of physicai facilities
such as buildin9s and any other dutie5 or activiiies.
� E. The Latholic Cemete�y Association of Oshkosh hereby releases the Gity of
Oshkosh from all debts, claims, demands, and damages through an act of God or
vandalism. The Catholic LemeTery Associat�on of Oshkosh agrees to hold the City
of Oshkosh free and harmless from any claim for damages which may be made by
feason of damages or injury [o persons or property connec[ed therewiCh.
F. This agreemen[ and its terms shall expire on December 31. 198).
G. This agreemen[ does ooY preclude the execution of an addendum agreemert
for road a5sessmen[s as5ociated with road and Street repair in Riverside Latholic
Cemetery in 1987.
