RESOLUTION NO. 438
RESOLUTION APPROVING RENTAL HOUSING PROJECT
OF THE HOUSING AUTHORITY
OF THE CITY OF OSHKOSH, WISCONSIN
(CENTURY INVESTMENT FUND XV PROJECT)
WHEREAS, on October 16, 1986, a public hearing was held
befoce the Housinq Authocity of the City of Oshkosh, Wisconsin
(the "Authority") with respect to a rental housinq ptoject (the
'�PLO)ECt"j CO be located ^vR d�J^vilt $lv^ iEEi Of L1V2L frontaqe
south of Conqiess Avenue between the Fox River and Summit
Avenue, in the City of Oshkosh; and
WHEREAS, notice of such public hearinq, in the form
attached as Exhibit A hereto and incorporated herein (the
"Notice"), was published by one insertion in the Oshkosh Dailv
Northwestern, the official newspaper of the City for the
publication of notices pursuant to Chaptet 985 of the Wisconsin
Statutes and a newspaper of general circulation in the locality
of the Ptoject, no less than fourteen (14) days prior to the
date of such public hearing; and
WHEREAS, such public hearinq was conducted in a manner that
provided a reasonable oppottunity to be heard for persons with
differing views on both issuance of the bonds referred to in
the Notice (the "Bonds") and the location and nature of the
Project, which is to be financed by the Bonds; and
WHEREAS, the Authority has made a report of such public
hearing to this body, which report this body has considered; and
WHEREAS

amended (the "Act"), pcovides that this body shall
housinq pcoject to be undertaken by the Authority;
WHEREAS, the Bonds shall not constitute an indebtedness of
the City within the meaninq of any State constitutional
provision or statutory limitation and shall not constitute or
qive rise to a pecuniary liability, ditect or contingent, of
any kind or degtee whatsoever, of the City oc a chatqe against
its genetal credit or taxing powecs;
NOW, THEREFORE, on behalf of the Authority, fo[ the
pucposes of Section 147(f) of the Internal Revenue Code of
1986, as amended, and the Act, this body hereby appcoves the
Pcoject and the issuance of the Bonds thetefot.

The foreqoing resolution of the Common Council of the City
of Oshkosh, Wisconsin was adopted and recorded on December 18,
1986.

I, Donna Secwas, beinq first duly swotn, do heceby depose
and certify that I am the duly appointed, qualified and acting
Clerk of the City of Oshkosh, in the County of Winnebago, State
of Wisconsin, and as such I have in my possession, or have
access to, the complete corporate recocds of said City and of
its Common Council; that I have carefully compared the
transcript heteto attached with the aforesaid corporate
records; that said transcript hereto attached is a true,
correct and complete copy of all the corporate recocds in
relation to the adoption of Resolution No. 438 entitled:
RESOLUTION APPROVING RENTAL HOUSING PROJECT
OF THE HOUSING AUTHORITY
OF THE CITY OF OSHKOSH, WISCONSIN
(CENTURY INVESTMENT FUND XV PROJECT)
I do hereby further depose and certify as follows:
1. Said resolution was considered for adoption by the
Common Council at a meeting held at the City Hall at �:oo p.m.
on December 18, 1986. Said meetinq was a regular meetinq of
the Common Council and was held in open session in compliance
with Subchaptet IV of Chapter 19 of the Wisconsin Statutes.
2. Said cesolution was on the agenda for said meeting and
public notice thereof was qiven no less than 24 hours prior to
the commencement of said meeting in compliance with Section
19.84 of the Wisconsin Statutes, including without limitation,
by postinq on the bulletin board in the City Hall, by notice to
those news media who have filed a written request for notice of
meetings and by notice to the official newspaper of the City.
3. Said meetinq was called to order by Robert Pung, City
Manager, who chaired the meeting. Upon roll I noted and
recorded that the followinq council members were piesent:

and that the followinq council membets were absent:
I noted and recorded that a quorum was present. Various
matters and business wete taken up during the course of the
meeting without intervention of any closed session. One of the
matters taken up was said resolution which was intcoduced and

its adoption was moved by Council Member Mather , and
seconded by Council Membec sinner Following
discussion and after all council members who desired to do so
had expressed their views for ot aqainst said resolution, the
question was called and upon roll beinq called and the
continued presence of a quorum beinq noted, the recorded vote
was as follows:

Pressley, Mather, Binner, Soanbauer, Kutchera,
Propp, Chapin
none
Whereupon the Mayor declared said resolution adopted,
and I so recorded it.
4. Said resolution was approved by the Mayor on
Decembet la , 1986, and I have so recorded.

NOTICE OF PUBLIC HEARING TO
RESIDENTS OF THE CITY OF OSHKOSH, WI5CONSIN
Notice is hereby qiven that the Common Council of the
City of Oshkosh, Wisconsin will hold a public hearinq at 7:00
p.m. on October 16, 1986, at 215 Church Avenue, Oshkosh,
Wisconsin, regatding the pcoposed issuance by the Housing
Authority of the City of Oshkosh, Wisconsin, of revenue bonds
pursuant to Sections 66.40 and 66.904 of the Wisconsin
Statutes, as amended, in the maximum aqqreqate face amount of
$6.000,000 on behalf of Century Investment Fund RV Limited
Partnecship, a Wisconsin Limited gactnecship. The bonds would
finance the construction of a multifamily apartment facility
containing approximately 150 apattments and telated equipment
and facilities. The proposed location of the facility to be
financed is on about 810 feet of civer frontaqe south of
Conqress Avenue between the Fox River and Summit Avenue in
Oshkosh. The initial ownet, operator and manaqer of the
facility will be Centucy Investment Fund XV Limited
Partnership, a Wisconsin limited partnership.
The public hearinq wi11 be conducted in a manner that
provides a reasonable oppottunity to be heard fot petsons with
diffeient views on both issuance of the bonds and the location
and nature of the pioposed facility. Any person desirinq to be
heard on this matter is cequested to attend the public hearing
or to send a representative. Written comments not exceedinq
250 words to be considered at the meetinq may be submitted to
the City Cletk. Comments made at the heacing ace foc the
consideration of the Common Council of the City of Oshkosh,
Wisconsin.
