HomeMy WebLinkAbout34236 / 87-450December 18, 1986 FIRST READING (CARRIED LOST JA�1ARr �, 1987 #421 ORDINANCE SECOND READING # LAID OVER WITHDRAWN ) PURPOSE: AMEND ALCOHOL REGULATIONS IN CITY PARKS INITIATED BY: CITY ADMINISTRATION A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 4-49 AND 4-50 OF THE OSHKOSH NNNICIPAL CODE PERTAINING TO ALCOHOL REGULATIONS IN CITY PARKS. The Common Council of the City of Oshkosh do ordain as follows: SECTION 1. That Section 4-49 of the Oshkosh Municipal Code pertaining to Special Class B licenses in parks is repealed and recreated to read as follows: SECTION 4-49 SPECIAL CLASS B LICENSE IN PARKS (A) All Special Class B licenses issued for any park requires licensee to take appropriate safeguards to prevent abuse in the dispension and consumption of alcoholic beverages. The applicant of a Special Class B license shall, in order to secure a license, and as part of the application, specify which � of these provisions will be used in enforcing applicable City ordinances. 1. The applicant � erect a fenced "beer garden" wherein a "beer garden" is defined as an enclosed area with specially marked entrances and exits and consists of a fence at least four feet high. Consumption of beer, purchased within the confines of a beer garden, will be restricted to that area within its confines. The decision as to specific location, size, and number of beer gardens shall be made by and at the discretion of the City administration. 2. The applicants� fence in part of, or when feasible, all of a park in order to define the area of public consumption. Consumption of beer, purchased within the park, will be restricted to that part of that park within its confines. 3. (B) The agent for the Special Class B license or a licensed bartender shall be on duty at all times. An enforcement provision shall also be part of the Special Class B application. All enforcement costs shall be borne by licensee. (C) The cost of procuring, installing, maintaining, and disassembling any of the beer garden fence, park perimeter fence, or similar demarcation device shall be borne by the licensee or his designated agent. Restitution or remuneration or damage to City property shall be at the sole expense of the applicant. (D) The sale of beer in any park shall be prohibited after 9:p0 p.m. except in those instances wherein the City Council, by resolution, grants an extension of hours. SECTION 2. That Section 4-50 of the Oshkosh Municipal Code pertaining to the hours of consumption be r�pealed and recreated to read as follows: SECTION 4-50 HOURS OF CONSUMPTION (A) No consumption of any alcoholic beverages, including fermented malt beverages, shall be allowed in any City park after 9:30 p.m., except in the following designated areas where softball league play has been sanctioned, or a Special Class B license exemption for such activity has been issued. 1. The Esther Reetz Softball complex in Menominee Park, located north of Irving Avenue, east o£ Hazel Street, south of Siewert Trail, and west of Lake Winnebago, 2. South Side Lighted Diamond, 3. Any other area in which and when there is sanctioned league play or other sports activity £or which a permit has been issued by the City of Oshkosh Department of Parks or the Oshkosh Recreation Department. SECTION 3. This ordinance shall be in full force and effect from and after its passage and publication.
