PURPOSE: TO CREATE JUVENILE CURFEW
INITIATED BY: COUNCIL MEMBER KUTCHERA
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH CREATING SECTION 18-
14.1 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO JUVENILE CURFEW
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 18-14.1 of the Oshkosh Municipal
Code is hereby created to read as follows:
SECTION 18-14.1 CURFEW
(A) VIOLATION BY JOVENILE. No child under 16 years of aqe
shall loiter idle or remain upon any street or alley or othex
public place in the City between 11:00 p.m. and 6:00 a.m. the
next day.
(B) EXCEPTIONS. This ordinance shall not apply:
1. At any time if the child is accompanied by parent,
legal guardian or other adult approved by the parent or
guardian of the child, or riding in a motor vehicle with
parent or guardian consent.
2. At any time in the event of an emergency which would
justify the reasonableness of the child's presence.
3. At any time the child is pursuing the duties of
employment but the child must carry a written, signed
statement from the employer stating the hours and place
of employment.
4. At any time the child is on the property of or the
sidewalk directly adjacent to the building in which the
child resides.
5. If the child is coming directly home from a meetdng
or place of public entertainment such as a movie, play,
or school, church or sporting event. This exception
shall apply for one-half hour after the completion of
the event but in no case beyond 1:00 a.m. If the event
is not commercial in nature or if the event does not
have a fixed, publicly known ending time, the sponsoring
organization must register the event with the Police
Department at least 24 hours in advance, informing it of
the time such event is scheduled to beqin, the place at
which it shall be held and the time and place at which it
shall end and the name of the sponsoring organization.

VIOLATION. No parent, legal guaxdian or other
lawful custody of a child under 16 years of age

(D) WARNING. The first time a child is found to have
violated the provisions of this curfew, the parent,
legal quardian or other adult having lawful custody of
the child shall be given a copy of this curfew
ordinance and shall be informed that subsequent viola-
tions of the curfew by this child or any other child
under care or custody shall result in a penalty being
imposed.
(F) PENALTIES.
1. Any child found violatinq the provisions of this
curfew shall be subject to Chapter 48 of the Wisconsin
Statutes.
2. Any person, not a minor, found violating the
provisions of this ordinance and having been previously
warned shall forfeit not less than Fifty Dollars
($50.00), ox not less than One Hundred Dollars ($100.00)
for any subsequent violation and not more than Five
Hundred Dollars ($500.00), together with the costs of
such prosecution, and in default of payment thereof by
imprisonment in the County Jail for Winnebago County for
not more than ten (10) days.
SECTION 2. This ordinance shall be in full force and effect
from and after its passage and publication.
