BE IT RESOLVED by the Co�on Council of the Ci[y of Oshkosh tha[ the
a[tached agreement wi[h the Sta[e of Wisconsin Depar[ment of Transporation
for Progxa�ing and Cons[nc[ion of an Urban Highway Improvemen[ Project --
Campbell Rd., City of Oshkosh (Dempsey Trail - Taft Ave.) is hereby approved
and [he proper Ci[y ofHcials are hereby authorized and directed [o enter into
same.

This request tor the programming antl consim[tion ot a highway improvement, upon acceptantt by the Highway Commission
shall conztitute an Aqreement between the Wisronsin OeOartment of Transportation antl ihe Municipality, antl unlezs specifically
modifietl or amentletl by supPlemenlal written agreement between the State antl tM1e Municipality is sublect to all ot the tollowing
terms antl contlilions.
Terms ana Cantlitions
1. WM1en Fetleral Funtls are involretl in the improvement, the iniliation and accomplishmenl of ihe impwvement will be sobjett
to the applica�le Federal Aid Highway Acts antl Regulations ol the Fetleral HiqM1way AOminiitration, U.S. Deparlment of Transportation.
2. The Municipali[y will contribute antl pay to t�e Sta[e all cost incurretl by t�e S�ate in connnction with the improvement which
I5 no[eligible �or State antl/or Fetleral funtl financing.
3. Fetleral aitl antl/or$tate highway tuntl financing will be limitetl to 75 per[ent (%) participation in lhe constmclion
costs of the following items: (5[ate tuntls limitetl to State trunk highway routes and connecting itreets.)
(a) T�e pavement,base,curb antl gulteq together with all gratling.
(b) Ca[ch bazins ane inlets for surtace water arainage ot the imOrovement, with connections to the storm sewer main.
(�) Construction enqineering intitlent to ins0ection and supervision of actual constmttion work.

4. Work neressary to mmplete the improvement to be financetl enlirety by the Municipality or other utility or facility owner
inclutles the tollowing items unless otherwise tle5ignate0 in 3(d) above: �
(a) Storm sewer mains neceuary Forthe surface water tlrainage.
(b) Consirvction or r¢placement of sitlewalks antl surfacing of private Eriveways.
(c� New iretaliations or al[eration ot zheel lighting antl traftic signals or tlevices.
(d) RiqM of Way for the improvement.
(e� Surveys, plans antl other preliminary enqineerin9 expenses.
5. Work necessary to mmplete the impmvement to be finantetl entirely by the Municipality or other utiiity or facility owner
inclutles the followinq items.
(a) New installations of or alteration of sanitary sewers antl<onnections.water, gas,electric, lelephone, telegrap�, (ire or
Oolice alarm facili[ies. parking meters, anE similar utilities.
(b) Damages to abutting pmperty due to change in siree[ or sitlewalk witlt�s, gratles or tlrainage.
(�) Contlitioning, iirequireC, antl maintenance ot tletovr routes.
(tl) Repair of tlamages to roatls or streets causetl by reason of their use in hauling materials incitlent to the improvement.
(e) Other
6. The State will, al rts msl antl expense:

(bJ Finance State expenses ot purely an atlministrative nature.

8. The Distri�t Office of the Divizion of Highways will cooperate wilh antl ativise the Municipality Guring the survey antl plan
aevelopment phase. T�e wst of any survey, plan, ana preconsVUttion enqineering untlertaken py the $tate, othe�than aEminist�a-
tive eapenses, will be chargetl to the Muniupality.
It is untlerstootl that, upon wmpletion of lhe plans anG prior�o Ne exewtion ot the mnhact for the work, the project will be
subject to further agreement between the Municipality antl Ne State with respect to the detail ot design, approval of plans, and if
Fetleral aia is to be usetl, certain requirements to satisfy the provizions of the Federal Aid Highway Hct and [he regulations issuetl
pursuant thereto. It is furlher agreed by Lhe Municipality that:
(a) I[will maintain, at its own cosl antl expense,all portions ot [he proje<t thal lie within its juristlic[ion for sucn main-
tenance Mrough statutory requirements, in a manner satisfactory to Ne State or the Federal Highway Administration or balh, or
their authorizetl re0resentatives, antl wiil make ample provision for such maintenan<e each year.
(b) It will keep recortls of mst of constmction, inspection, tests, and maiMenance tlone by it as will enable the Slate
to report, upon request of the Fetleral Highway Atlminislratioq the amount antl nature of the expentliNre for these purposes:Ihat
Ihe acmunts antl recortls of mch ezpentlitures, toge[M1er with all sup0ortmg document,wlll be kept open al all times to inspection
by au[horiied representatives of the Fetleral Highway Atlministration;antl that it will furnish mpies thereof when requestetl.
(c) All signs and iraffic control tlevices antl other protective shu<Wres erectetl on or in connection with the project,
inUUtling such ot these az are installea at the sole cost antl expense of the Municipality or by others,wiil be in contormity with wch
manual of unitorm traffic contml tlevices as may be adoptetl by the American Asmtiation of State Highway and Transportation otti�
cials, appmved by Ne State, antl mncurretl in by the Fetleral Highway Atlministration.
(tl) The rigM of way available or provitletl for the project will be heltl ana maintainetl inviolate for puGlic highway or street
pmposes. Those signs prohibitetl untler Fetleral aia highway regulations, posters, billboartls, roadside stantls, or ot�er private installa-
tions prohibitetl by Fetleral or State highway requlaiions will not be permitted within the riqht of way limifs of ihe project. The Mun-
icipality, within its Iuristlictionai Ilmits, will remove or caure to be removetl fmm [he right of way of the praject all private initallations
oi whalever nature which may be orcause an obstruction or inlerfere with Ne tree flow of traffic, or which may be or cause a hazard
to traffic, or which impair Ihe usefulness of IDe project antl all other encroachments which may be requiretl to be removed byYhe State
at its own e�ection or at the reqvest ot the Federal Highway Atlministration, and that no such private Installations will be permittetl to
be erectea or maintainea in the fuhre.
(e) Itwillprohibitangleparking.
(f� It will regula�e or prohibit all parking at lo[ations where antl when the pavement area usvally occupietl by pa�ked vehicles

(9) It will assume general responsibility tor all pvblic intormation and Oubii< relations for lhe project antl to make fitting
announcement to the press antl suc� outlets as woultl generally alert the affecletl property owners and the community of the nature,
extent, antl timing of the pmjec[antl arrangements for handlinq hattic wlthin antl around the prolects.

prior ro [he s[arc of any acquisition ac[ivicics.

upon until a formal request Eor sucli services, Form E-D-419 has been submitted to and accepted by the
Highway Commission.
