THZS AGREEMENT is entered into by and between the CITY OF OSHKOSH,
Wisconsin, party of the first part hereinafter referred to as the
6mployer, and the OSHKOSH PAOFESSIONAL POLZCEMEN'S ASSOCIATION,
party of the second part hereinafter referred to as the
flssociation .
� IN OADER TO INCREASE GENERAL EFFICIENCY , to maintaln the existing
harmonlous relatlons between Lhe Employer and its employees . to
promote the morale , well Deing and securlty of said employees, to
- maintain a uniform minimum scale of wages , hours, and conditions of
employment among the employees and to promote orderly procedures
for the processing of any grievance Detween the employer and the
employees , Lhe follouing 8mployment Contract is made .

Except to the extent expressly aDridged by a specific provision of
this Agreement, the City reserves and retains, solely and
exclusively, all of its Commo❑ Law, statutory, and inherent rights
to manage its ovn affalrs, as such rights existed pcior to the
ezecution of Lhis or any other previous Agreement with the
Association. Nothing herein containetl shall divest the Association
from any of its rights under Wis . Stats . Sec . 111 .70 .

The ❑ormal work day shall consist of eight (8) hours , and consist
of Lhe folloxing schedule:
Five (5) days on tluty and two (2) tlays off antl
Five ( 5) days on duty xith three (37 days off.
Officers shall be paid Sn accordance uith the rates listed in
89.hE.dLL1E_2• These rates Snclude a ten-dollar ($10.00) Bi-Weekly
briefing pay allowance. Those officers xorking the 5-2, 5-2
schedule shall be provided vith 16 additional tlays Lo be taken as
. time off during the calendar year. Any days not Laken off by
December 31st shall be forfeited by the employee .

The City of Oshkosh will provitle uniform apparel to all uniformetl
personnel at City expense. The items to be furnished by Lhe City
shall include coats , trousers � hats, ties , shoes , shirts, leather
goods, and any other item of uniform apparel that may be required
. by the City .
Uniforms will be inspected periodically Dy shift commanders or upon
. request of the officer and replaced as needed. Replacement orders -
shall be processetl by the City of Oshkosh Purchasing Division .
Non-uniformed personnel shall receive a clothing allowanee of
$3Z5•o0 per year payable in Jan�ary of each year. In the event of
change of �ob, clothing allowance shall be pro-rated from Lhe tlate
of eF.ange. Officers transferred into a uniformed position
subsequent to receiving the clothing allowance shall pay the pro-
rated amount back to the City .
The uniformed officers vorking the late shift who are required to
� wear plainelothes because oF filling in for the Shift Commander a
substantial amount of time shall receive a yearly clothing
allouance of $75.00. Substantial is definetl as at least fifteen
( 15) times per year.
Cleaning antl laundry servlces will be provided for all officers at
the employer's expense. The cleaning firm antl cleaning schedule
shall be designated by the City .

Work done in excess of Lhe normally scheduled work day or work week
shall be compensated at the rate of time and one half in either
compensatory Lime or cash as the officer may choose. All
compensatory time will be recortled and may be usetl durl�g the month
- in ahich it accrues subJect Lo the approval of the tlepartment head.
Employees may maintai❑ a compensatory time balance of no more Lhan
eighty (80) hours. Unused balances of compensatory time or time
accumulated in excess of eighty ( 80) hours shall be paid on the
first pay perlod follouing the quarter i❑ vhich it was accrued at
the effective rate of pay when such time was earnetl. The formula
for computing the hourly rate shall be: B1-Weekly rate a

Each full time or proDationary employee shall accumulate sick leave
at the rate of one ( 1) uorking day for each month of service. Such
unused sick leave shall be alloaed to accumulate without limitation.
Routine doctor and dental exams, including eye exams and non-emer-
- gency surgery, shall be schetluled o❑ off-duty time whenever practl-
cable .
� An employee may use sick leave uith pay for ahsence necessitated by
injury or illness. It is further recognized that Lhe serioue
injury or illness requiring unforeseen emergency medical treatment
of the spouse or chiltl of the employee may adversely effect the
abllity of the employee to perform h1s duties efficiently, 2nd aay
necessltate the use of sick leave. Nowever, no leave shall be
granted under this subsection if the spouse of the employee is
employed and continues to uork during the absence of the officer.
It is understood that absences because of illness of the ofFicer's
wife , children or other members of the family living at their resi-
dence is tlesignetl for emergency purposes antl the officer shall make
diligent effort Lo llmit such absences to one day if possible.
Notwithstanding the above, employee may use vacation , holiday or
compensatory time for the injury or illness of spouse, child, family
� member living within the residence .
To qualify for sick leave payment an employee must do the
following :
a. Peport his absence prior to the start of each uork day to
department head or supervlsor.
b . Keep his supervisor informed of Lhe conditions if the
absence is more than three (3 ) working days .
c . Upon request submit a doctors certificate For such
absence. The certificate must state the nature of the
illness or injury and whether the employee has been
incapacitated for the period of his absence .
d . The employee upon returning to duty must sign an
application for sick leave form requesting the sick leave
benefits. Such a signature shall be acknowletlgment of
Pull compllance with all regulations relatetl to sick
- leave benefits as set forth in this Contract .
In the event any employee has misused the provisions contai�ed
� herein or has requested the use of sSek leave when such leave is
not authorized by the terms of this contract, the employees absence
shall be rrithout pay. The determination that an employee has
abused the benefits contained in this paragraph shall not preclude
the employee from using accumulated sick leave when authorized by

the terms of this contract in Lhe future nor shall the accumulated
sick leave cretlited to that employee be effected thereby .
In additlon to the employees' right to accumulate sick leave
wlthout limltation, unused accumulated sick leave up to 150 days
shall be paid at one-half of Lhe employees' rate in effect at the
time of said separation Por those employees who retire at age 50 or
older or for those employees who separate because of disability.

- All full time employees shall be granted the following vacation
benefits: After one ( 1) year oF service, ten ( 10) working days.
After seven (7) years of servlce, fifteen ( 15) working days. After
fifteen ( 15) years of service twenty (20) working days. After
twenty (20) years of service, tuenty-five (25) working days. In
the event an employee has not worked the full calendar year prior
to his vacation such vacation shall be pro-rated hased o❑ the time
actually worked. Yacation will not be carried over from year to
year .
Those employees reaching their seventh, fifteenth, and twentieth
year of service shall earn their vacation for that year on a pro-
ratetl basis .
Departmental seniority on shifts shall determine the choice of
vacatio�. The most senior employee shall have first choice of
vacation, however� the first choice will be limited to one ( 1) time
period which could comprise his entire vacation or any portion
thereof. Once he makes his selection , the second senior man will
make a similar selectlon and on down through the least senior man
on each shift . This process will then be repeated until each man
has chosen his entire vacation schedule .
This process shall be completed wlthin five (5) r+eeks from the date
the vacation time for each man has been certified and sent Lo the
❑nion by the Chief of Police. The vacation schedule is subject to
the staffing of the department as determined by the Police ChieP.
The employees are permitted to choose vacation from January lst
through December 31st. In the event oF separation prior to
completion oP one year of service, no terminal vacation shall be
paid .

� All full tSme employees shall be granted eleven (11) paid holitlays:
New Year's Day, Memorlal Day, Independence Day, Labor Day,
Thanksgiving Day, December 24th, Christmas Day, Good Friday,
' Washington's Hirthday, and two additional floating holldays shall
be granted each employee. Such holiday leave shall be granted as
eleven ( 11) days off in lieu of the calendar holidays. Holiday
leave shall be subject to the departmental work schedule and
staffing requirements as determinetl by the Police Chief. Employees

Cash payment shall be computed basetl on the hourly rate in effect
at the time oP the holitlay times the number of hollday hours
accredited to each employee. The employer shall be notified of the
employee's desire for cash payments by the lst day of October oP
the preceding year. All holldays shall be eredited to the employee
January 1 of each year and must be used by December 31 of each year
ezcept a maximum of three ( 3) holidays may be carried over to April
1 of the following year. Holidays not used within these time
. limits will be forfeited. Holitlay pay shall be paid in the second
pay period of November .

� Each employee 9ha11 be alloued paid leave not to exceed three (3)
vorking days for the funeral of such employee's spouse, father,
mother, father-in-law, mother-in-law, son� daughter, stepchild ,
brother, sister, grandmother, grantlfather, grandchlldren, and
guardian.
One ( 1) tlay of emergency leave for aunts , uncles� sisters-Sn-law�
brothers-in-lav� step-parents, and spouse's grandparents shall be
allowed if the employee uses vacation, holidaY or compensatory
time .
In the case of extended travel time or other exigent circumstances
being necessary; adtlitional leave shall be alloued if the employee .
uses holiday, vacation, or compensatory time , subject to reasonable
minimum manpover requirements .
E. S.IISLLLY-Lfl3Y€
In the event that an employee is sick , ill , or hurt , and would De
otherwise coveretl by the Workmen's Compensation statute, or the
City's Norkmen's Compensation carrier, but is ❑ot eligible to
receive benefits because the duration of the illness is not long
enough, then the City agrees to pay for up to three (3) full days
of pay to the affected employee. Accumulated sick time of the
affected member shall not be applied to the three (3) days provided
for herein .
Sick leave , injury leave, or temporary tlisability benefits shall be
payable to any employee injured while in the employ of an employer
other than the City of Oshkosh, except that the sick leave benefits
shall be reducetl Sn a❑ amount equal to the Workman's Compensation
, benefits received from the employer or its insurer.

Friday. In the event such days are legal holidays, ehecks will be

The employer shall provide health coverage equal to the level of
benefits available to Lhe employees under the HMP type program in
effect during 1982. The full cost of this plan shall �e paid for

The employer shall pay one hundred percent ( 100$) of each
employee ' s state group life insurance pollcy .

In addition to the statutory requirements , the employer shall pay
to Lhe employee's retirement fund an amount not to exceed seven
percent (7;) of the employee 's gross wages .

all benefits, Policies, and procetlures related to wages, hours� and
conditions of employment not specifically referretl to or altered by
. this Agreement .

Neither party to Lhis agreement by suoh act at Lhe time hereof or
suDSequent hereto agrees to and does waive any rlghts possessed by
it or them under state antl fetleral laws, regulations or statutes.
In the event any clause or portion of this agreement is in confllet
uith statutes of Lhe State of Nisconsin governing municipalities or
other statutes such clause or portion of the agreement shall Oe
declared invalid antl negotiations shall be instituted to adjust the
invalitlated clause or portion thereof.

When it is tleemed necessary by the City to lay off employees
because of need for economy, lack of aork or funds or other Just
cause. it shall follow the lay-off procedure outlined in Wisconsin
Statutes � 1973 . Section 62 .13(5m) .

The Association recognizes that the employer may adopt and publish
rules frem time to time, however� the employer shall suSmlt such
rules to the Association for its information prior to Lhe effective
tlate .
For this purpose , rules shall be defined as any rules, regulations,
policies� directives, and postings published by the Department or
the city affecting the department. Such rules shall be submitted
to the Hage Board Chairman antl the Associatlon President and shall
also be posted for knowledge and record. A11 such rules shall bear
� the signature of the Chief of Police or his designee. In the event
of a dispute to such rules� the Association shall have fifteen ( 15)
days after inceptio❑ to dispute such rules through Lhe grievance
procedure .

Evaluation reports of employees shall be submitted to the evaluated
employee in final form and identical to those filed in Lhe
personnel office and in the office of the Chief of the Department.

Progression of disciplinary action shall be as follous: First�
- oral reprimand or written reprimand. An Association representative
may De present wlth the employee at the time (or at such time as)
any oral or vritten reprimand, suspension or dismissal Ss
registeretl with the emplayee .
The Assoclation may be furnishetl a copy of any written notice of
reprimand or suspenslon. A written reprimand sustained in Lhe
grievance or not contested shall be recorded .
An employee shall have the rlght to the presence of an Association
representative uhen his work performance or conduct affecting his
status as an employee are t6e suDject of dlscuission for the
record. The City shall , at all steps of this Article,
affirmatively ask the employee if he desires an Association
representative to De present .

In consitleration of the successful completlon of thirty-six (36)
credits from the curriculum of tre University of Wisconsin-Oshkosh,
or the Fox Valley Technical Institute, defined as the Police
Administration Program the following schedule of benefits and
provisions shall apply:

For every three (3) cretlits an employee obtains in Lhe aforesaid
program of study he shall receive Bi-Weekly payments as listed :

Salary adjustments as containetl herein shall be made at Lhe
beginning of the first pay period in February anC the beginning of
. the first pay period in Suly of each year upon presentation of
satisfactory evidence that the ofPicer has completed the aforesaid
courses of instruction. Employees shall not be paid for courses
completed unless the final grade recelved is a "C^ or better.
An additional $15.00 per month shall be paid to the employee upon
completion of 60 credits in the Police Administration program at
the University of Wisconsin Oshkosh or Fox Valley Technical
Institute .
All employees who have completed two (2) years of service are
eligible Lo participate in the etlucational program set forth
herein. An employee Who has accumulated credits herein prior to
the completion of two (2) years of servlce v111 receive Lhe
compensation as provided herein at such time as he has completed
two ( 2) years of service .
Employees desiring to take certified courses in the Po11ce
Administration Program shall fund said courses through LEAA Grants�
GI Benefit Grants or any other available grant made knoun to the
employee. Should the employee not be able to receive funding for
books and tuition from any other source for certified courses in
Lhe Police Administration Program then in that event and only in
that event the City vill pay the expenses of books antl Luition.
Should an employee be required to pay back any grant he has
received - due to termination or voluntary separation from the
Oshkosh Police Department then in that event the City vill
reimburse the employee for those expenses tlue to participation in
Lhe Police Administration Program.

All Payments shall be at the undergraduate rate. If an employee
wishes to take a graduate course� he shall be responsi6le for Lhe
differences between the graduate and undergraduate rate. If the
employee drops a class, the employee vill be responaible for the
costs incurred Dy the City for that course including books- and
Luition .
. If the reason Tor the employee dropping the course is due to a -
shift change, Lhe employee will not be required to reimburse the
� City. Student classroom and stutly hours shall not be construed as
work hours nor shall such time be subject to compensation .
No new employee hired after January 1 , 1969 , for purposes of the
salary schedule shall De hSred in other than the first step of the
salary schedule unless educational achievement is such as the City
may choose to start him in a step not to exceetl step C of the
salary schedule. The salary schedule is set forth in aPPendix A
and incorporated hereSn by reference .

Both the Association and the City recognize that grievances and
complaints shoultl be settled promptly and at the earliest possible �
stages and that the grievance process must be initiated xithin five
(5) days of the incident or knoWledge of the Sncident, whichever is
the latter. Any grievance not reported or filed withi❑ five (5)
days shall be invalitl. A grievance is defined as any dispute or
misuntlerstanding relating to employment between the City and the
Association.
For the purpose of the final step of the grievance procedure , a
grievance will De limlted to the interpretation of application of
the terms and conditions ot this agreement, inclutling past
practices and policies Incorporated in thls agreement by its Lerms�
and shall be handletl in Lhe follorring manner:
1 . The aggrieved employee shall present the grievance orally
to his Supervisor either alone or accompanied by an
Associatio❑ representative, or if the emDloyee refuses to
present the grievance, the Association may present the
� grievance .
2 . If the grievance is not settled at the first step , the
� grievance shall be presented in uriting to the Police
Chief vithin five (5) days (Saturday, Sunday and Holidays
excluded). The Chief shall within five (5) days (Satur-
day � Sunday, and Holldays excluded) hold
an informal meeting with the aggrieved employee� and
Association representatives. The Chief's Response to the

grievance ahall be in urlting. If the grievance is not
resolvetl to the satisfaction of all parties within three
(3) days (Saturday� Sunday and Holidays excluded) , either
party may proceed to the next step .
3 • The grievance shall be presented in writing to the City
Manager Por disposition within five (5) rorking days
(Saturday� Sunday and Holidays excluded). Aesponse to the
grievance shall be in writing.
4 . If the grievance is ❑ot settletl under the provisions of
paragraph 3 above and one of the parties Ceems the issue
to be arbitrated, the party shall process the grievance
vithin five (5) days (Saturday, Sunday and Holidxys ez-
cluded) of completion of Lhe provisions of paragraph 3 to
arbitration. Arbitration procedures shall follou that
outlined in State Statutes. The decision of Lhe arbitra-
tor shall Ce final and Dinding on the parties , sub ,�ect to
judicial review.
Expenses for the arbitrator's services and the proceedings shall be
borne equally by the employer and the Association. However, each
party shall be responsible for compensating Sts own representatives
and xitnesses .

The Union, as the exclusive representatives of all the employees in
the bargaining unit, will represent all such employees, union and
non-union� fairly and equally� antl all employees in the unit will
be required to pay, as provided in this article� their proportion-
ate share of the costs of reDresentation by the union. No employee
shall be required to join the union , but membe�ship in the union
shall be made available to all employees who apply consistent with
the union constitution xnd by-laas. No employee shall be denied
union memDership because of race, creed, color, or sex.
The employer agrees that it will deduct from the monthly earnings
oF all employees in the collective bargaining unit, the monthly
dues as being certified by the union. and pay said amount to the
treasurer of the Union on or before the end of the month in vhich
' sueh deduction was made .
Changes in the amount of dues to be detlucted shal l be certified by

Any time an employee covered by this Agreement is required by the
Chief of Pollce to use his personal automobile to attend in-service
training courses or for any other purpose, then in that event the
� employee shall receive mileage reimbursement at Lhe City Council
approved rate for City employees but in no event shall the rate be
less than 15 cents per mile for in-city travel antl 12 cents per
mile for out-of-city travel. "City" for this purpose shall be
defined as the City oY Oshkosh .

Whenever an employee becomes pregnant � she shall furnish the
Department uith a medical report, stating the ezpected date of
delivery antl what, if any , work restrictions ezist. Continued
employment shall be based upon the employees ability to perform the
work. Phe duration of pregnancy leave without pay shall be
determined subsequent to the request of the attending physicia�.
Sick leave shall be allowed for the actual time of disability due to
pregnancy as certified by the employees physician .

The City hereby recognizes the Association as the sole and
exclusive bargaining agent with respect to hours, wages and
conditions of employment for the positions of patrolman, detective
and sergeant excluding the positlons of ChieP� inspector� captain�
antl all other employees of the Oshkosh Police Department .
THIS AGREEMENT shall become effeetive as of the lst pay period of �
1987 , and will remain in full force and effect to and including the

I . As an addition to this Contract , the parties agree to attach
this Memorandum of Ilnderstanding Which is the result of a
Stipulation entered into between the parties and whSch defines
in-service training. The Memorantlum of Understanding is as

inconsistencies related to payment for courses taken at schools

respect to payment of courses taken at the above schools.
However, payment has been granted to a num�er of individuals in
Lhe past for approved courses taken at other schools , which is
co�trary to the provislons in the labor contract• I�ant Systo
resolve this inconsistency, Management uill hereby g
approval to pay for otheruise approvetl courses taken at
educational institutions other than UN-0 or Fox Valley
Technical Institute. These courses also must 6e approved by
UW-0 or Fox Valley Technical Institute as equivalent to courses
that are on the approved list and must have been taken prior �to
November 30� 1979• As an additional qualification, the indivi-
dual must have been an employee of the City of Oshkosh prior to
November 30, 1979•

When an officer performs duties of a higher ranking officer for more
than tWO (2) consecutive pay periods, that officer shall receive the
compensation equal to the compensation that the higher ranking
officer receives. This provision shall not apply if the reaso❑ for
the assignment is vacation relief.

All officers within Pifteen ( 15) years service as of the lst day of
January, 1969, will receive for purposes of the pay schedule
eighteen ( 18) credits. These credits shall be given Sn addition to
xhatever credits they may acquire untler the program set forth
herein.
Those emploYees who are employed prior to Lhe lst day of January�
1969, vho have not progressed in the educational program set forth
herein shall receive for pay purposes only an atlditional ten dollars
($10.00) per month upon the completion of ten ( 10) years of service
and an additional ten dollars ($10.00) per month upon the completion
of tuenty (20) years service .
This provision is not to be construed as credit equivalents� nor as
additional benefits to acquired credits. Those employees who
