IN ORDEA TO INCREASE GEN6RAG EFFICIENCY � to maintain the existing harmonious relations between the Employer and its employees, to promote the morale, Well being and security of said employees , to maintaln a uniform minimum scale of uages, hours and conditions of employment among the employees and to promote ortlerly procedures for the processing of any grievaace between employees and/or employee and emploYec, and the declaration of policies to insure proper and ethical conduct of business and relations betwaen the 'cmploYer and to tnat end have reached this 9greement . NOW, therefore , the parties hereto, each in consideration of the Agreements herein contained of the other, hereby agree as FOS10H9 : &RTS�.LB� Yi4Eg�'EEK � Police Captains & Lieutenants are supervisory personnel and as such are in charge with the responsibility oF controlling and directing subordinate personnel in executing their specified police assignments. Therefore , the duty week shall be determined by the depzrtment head based upon departmental manpower requirements. Captains & Lieutenants working a 5-2, 5-2 aork schetlule shall be provided sixteen � 16) days to be taken as oFf time during the calendar year . �TI.�LE�I. SLNSES2BL�_`�AIflTE2LANS.E The Employer will provide uniform apparel to all personnel at City expense. The items to be furnished by Lhe City shall include: coats , trousers, hats , ties , shirts , shoes , leather goods , and other items of uniform apparel required by the City . Uniform will be inspected periodically Oy the department head or his agent and replaced as needed. Replacement orders shall be processed by the City of Oshkosh Purchasing Division . _3_ Non-uniformed personnel shall receive a uniform allox2nce of $3Z5.00 per year payable in January. Uniformed captains & Lieutenants required to wear plain clothes during a ^substantial" amount of his duty time , shall receive a partial yearly clothing allowance in the amount of $75•00 per year. Substantial is defined as at least fifteen ( 15) times per year . Cleanin� and laundering services will be provided at City expense. The cleaning firm and eleaning schedule shall be designated by the City . �ET7�.LE1II �.4h1PENS9TIlBYS2ME Lieutenants who work in excess of the normally scheduled Work day or work week shall 6e compensated at the raie of time and one half in either compensatory time or cash as the officer may choose. All compensetory time will be recorded and may be used during the month Sn which it accrues sub ject to the approval of the department head. Employees may maintain a coapensatory time balance of no more than eidhty (80) hours. Unused balances of compensatory time or time accumulated in excess of eighty (80) hours shall be paid on the first pay period following the quarter in which it was accrued at the effective rate of pzy when such time was earned. The formula for computing the hourly rate shall be: Hi-Weekly rate + educational + longevity 77 .2 Hours . A11 covpensatory time accumulated prior to the 31st day of December, 1965 , may remain or may be taken as time off by the employees, calculated on the basis of straight time. Any balance of compensatory time remaining upon the retirement or separation of the employee shall be paid in cash calculated at the rate of straight time based on the salary schedule in effzct as of December 31 , 1965 . AHTS�L&_IY �ALL.�Si�I21E_At{L�.Ili�RT�PPE8HAI�I�Efl Lieutenants called to return to duty or appear in Court at some time other than his regular scheduled duty day sha11 receive three � 3) hours pay for the call or appearance unless the call or appearance is cancelled by 7 p.m. of the day prior to the call or appearance. The Lieutenants, in addition , shall receive time and one-half for the time spent on the call or appearance. Volunteers shall not be paid the call-in pay . -4- Lieutenants called or scheduled to appear in court during vacation shall be paid three (3) hours call-in pay plus time and one-half for ti¢e worked and , in addition thereto, shall receive an additional day of vacation returned. If notification of cancellation is diven 24 hours prior to the start of vacation, no call pay is given. If cancellation occurs thereafter, a vacation tlay return shall be made. Vacation shall be defined to include off-tlays commencing on the Lieutenant's last day of work before the vacation and his first day of work after vacation. This provisio❑ shall apply only when vacation is taken in one week 6locks. On trials lasting more than one day, no additional call- in pay shall be given after the first day . A esll is deFined as a request to return to duty at some time other than the regularly scheduled time not scheduled at least twenty-four (24) hours in advance antl not imoediately followino the officer ' s regularly scheduled shift . No call or Court Appearance shall preclude a Lieutenant from working his regularly scheduled shift exce�t by his request and upon approval of his department head . � A$Tj.�Isf�y ASITHIlHIZEP�.EAY� S.ick_S.aasa: Each regular fu11 time employee shall accumulate sick leave at the rate of one � 1) working day for each month of service. Such unused sick leave shall be alloWed to accunulate without limitation . � An employee may �use sick leave with pay for absence necessitated by injury or illness. It is further recognized that the serious injury or illness of the spouse or chlld of the eeployee oay adversely effect the ability of the employee to �erforo his duties efficiently. and may necessitate the use of sick leave. However, no leave shall be granted under this subsection iF the spouse of the employee is employed and continues to work during the absence of the officer. IL is understood that absences because of illness of the officer's wife , children , or otner aember of the Family living at their residence is designed for emeroency purposes and the officer shall make dil:gent effort to lioit such absences to one day if possible . To qualify for sick leave payment an =mployee must do the following: a. Report his a6sence prior to the start of each work day to the department head or supervisor . b . Keep his supervisor informed of the conditions if the absence is more than three ( 3 ) Norking days . -5- c . Upon request submit a doctor's certificate for such absenee. The certificate must state the nature of the illness or injury and whether the employee has been incapacitated for the period oF his absence . d . The employee upon return:ng to duty must sign a change of status form requesting the sick leave benefits. Such a signature shall 6e an acknowledgment of fuil compliance with all regulations related to sick leave benefits as set forth in this Contraet . In the event any employee has misused the provisions contained herein or has requested the use of sick leave when such leave is not authorized by the terms of this contract, the employe2s absence shall be without pay. The determination that an eoployee has abused the benefits conta!ned in this paragraph shall not preclude the employee from using accumulated sick leave when � authorized by the teras of this contract in the future nor shall the accumulated sick leave credit to that employee 6e effected thereby. In addition to the employees' right to accumulate siek leave without limitation , unused accumulated sick leave up to 150 days shall be paid at one-half the employees ' rzte in effect at the time of said separation for those employees who retire at age 50 or older or for those employees who separate because of disability , pursuant Lo s .s . 65 . 191 . Yas.aS.isn...4€a�ca All full-time employees shall be granted the followi�g vacation benefits: After oae ( 1) year of service - ten ( 10) aorking days. After seven (7J years of service - fifteen ( 15) uorking tlzys. After fifteen ( 15) years of service - twenty (20) working days. After twenty (20) years of service - twenty-five (25) working days . Those employees reaehing their seventh, fifteenth, and twentieth year of service sha11 earn their vacation for that year on a pro- rated basis . In the event an employee hzs not worked the full calendar year prior to his vacation , such vacation shall be pro- rated oa the time actually worked. Vacation vill not be carried over from year to year. Vacation may be chosen froo January 1st throuah December 31st and sha11 be subject to staffing requirements as determined by the Chief of Police . f1s11dax=Laax€� Each full time employee shall be granted eleven ( 11) paid holidays: New Year's Day, Meoorial Day, Independence Day, Labor Day , Thanksgiving Day, Christmas Day, Good Friday , December 24, Washington's Birthday and two (2) adtlitional floating holidays shall be granted each employee. Such holiday leave shzll be granted as eleven ( 11) days off in lieu oF the calendar holidays. Such holiday leave shall be subject to the departmental uork schedule and staffin� requirements as deterained by the Police -6- Chief. Employees may aaive holidays off time in favor of cash payment. Said cash payment shall be computed in the following manner: the hourly rate in effect at the time of holiday accruement times the number of holitlay hours. Employees electing the option payment must natify the department head in writing by Qg,y,g,Qgt_yg,y, of the current budget yezr :or the folloWing year. All holidays shall be credited to the emplcyee January 1 of each year and must be used by December 31 of each year ezcept a maximum of three ( 3) holldays may be carried over to April 1 of the folloNin� year. Holidays not used within these Lime limits will be forfeited . $m€L°oE.Il9.Y_jaE.dY€: Each employee shall be allowed paid leave not to exceed three (3) Workine days for the funeral of such employee's spouse , parent , step-father� step-mother� drantlparent , grandchild � child of spouse, parent of spouse, child , step-child , 6rother and sister. Such leave shall be only for the purpose of attending the funeral and be the period immediately preceding and including the date of the funeral or to be the date of the funeral and the daYs following . 9HII�L�Yl EAY3EHI4PS All payroll checks shall be paid Hi-iieekly . AHTI�4�_YIS llIl�PST@L�c�1EPS.S�.AL_INSllfl9H�E_�LZ�E_I�Pl,F1LBfl^1�E=3Efl�.I4h The employer shall provide health cov_rage equal tc the level of benefits zvailable to the employees under the HMP type program in effect during 1982. The full cost of this plan sha11 be paid for by the City . Life Insurance: The employer &hall pay one hu�dred per cent ( 100$ ) of the employee ' s group life insurance policy . Pension: In addition to the statutory requireoents , the employer shall pay to the employees' retirement fund an amount not to exceed 7% of the employees ' gross wages . '�_ AHTS�LE_Y?ZS �ASYEE_4E_BS�PT� Neither party to this agreeoent by such act at the time hereof or subsequent hereto agrees to and does waive any rights possessed by it or them under state and f=deral laws , regulations or statutes. In the event any clause or portion of this agreement is in conflict with Statutes of the State of Wisconsin Governin� municlpalities or other statutes such clause or portions of the Agreement shall be declared invalid and negotlations shall be instituted to adjust the invalidated clause or portion thereof. AHT3�.4&�% LflESEflT_flEtLEFITS The employer agrees to oaintain in substantially the same oanner, all benefits, policies , and procedures related to wages , hours, and conditions of employment not specifically referred to or altered by this Agreement . eaxis�.�_x S�PIEYAIY�.E3H4�EPURE Both the Association and the City recogr.ize that �rlevances and complaints should be settled promptly and at the earliest possible stages and that the grievance proce�s must be initiated vithin five (5) days of the incident or knuwledge oi the incident whichever is the latter. Any grievance ❑ot reported or filed within five (5) days shall be invalidJ A grievznce is defined as any dispute or misunderstanding relating to employment between the City and the Association and shall be handled in the follou- in� manner: 1 . The aggrieved employee shall present the grievance orally to his Supervisor either alone or accompanied by an association representat!ve, or if the employee refuses to present Lhe grievance, the Association may present the grievance . 2 . If the grievance is not settled at the first step , the grievance shall be presented in Writing to the Police Chief within five (5) days (Saturday, Sunday and Holidays excluded). The Chief sha11 within five (5) days (Satur- day, Sunday , and Holidays excluded) hold an informal ¢eeting with the aggrieved employee, and Association representatives. Zf the grievance 1s not resolved to the satisfaction of all parties within three (3) tlays, (Satur- day , Sunday and Holidays excluded) , either party ¢ay pro- ceed ta the next step. -8- 3 • The grievance shall be presented in writing to the City Manager for tlisposition uithin five (5) vorking days ISaturday, Sunday and Holidays exclutled). Response to the grievance shall be in writing. 4 . Nothing herein shall limit any employee from his rights to a hearing pursuant to Wisconsin Statutes in case formal charges are filetl against him. THIS AGAEEMENT shall become effective as of Pay Period $1 , 1987 , and Will remain in full force and effect to and including the 31st day of December, 1988 .
