PURPOSE: APPROVE FINAL RESOLUTION FOR SPECIAL ASSESSMENTS
CONTRACT NO. 15-07 / UTILITY REPAIRS AND INSTALLATION /
SANITARY SEWER AND WATER RELAYS / VARIOUS LOCATIONS
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the Common Council of the City of Oshkosh held a public hearing on
the 9th day of June, 2015, at 6:00 p.m. for the purpose of hearing all interested persons
concerning the preliminary resolution and report of the City Manager (Board of Public
Works) on the proposed improvements as listed below, pursuant to the initial resolution
adopted May 26, 2015, by the Oshkosh Common Council of the following named streets:

(new and relay), Storm Sewer Laterals (new and relay), Water Laterals (new and
relay), Sidewalk Repair, New Sidewalk, and Concrete Driveway Approaches:

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh as follows:
1. That the report of the City Manager, acting as the Board of Public Works,
pertaining to the construction of the above described public improvements, including plans
and specifications therefor, is hereby adopted and approved with the following
modifications:

2. That the action of the City Manager in advertising for bids and to carry out the
work of such improvements in accordance with the reports of the City Manager and in
accordance with the said resolution heretofore adopted, is hereby approved, ratified and
confirmed.
3. That payment for said improvements be made by assessing the cost to the
property benefited as indicated in said report, except as modified herein.
4. Assessments shown on the report represent an exercise of the police power and
have been determined on a reasonable basis and are hereby confirmed.
5. That the assessments for all projects included in said report are hereby
combined as a single assessment but any interested property owners shall be entitled to
object to each assessment separately or all assessments jointly for any purpose or
purposes.
6. That the assessments may be paid in cash, or in installments pursuant to
Section 25-83 thru 25-89 of the Oshkosh Municipal Code, said deferred payments to bear
interest at the rate of six percent (6%) per annum on the unpaid balance. The City Clerk
shall publish an installment assessment notice in accordance with Section 66.0715(3)(e) of
the Wisconsin Statutes in the official newspaper of the City.
7. The City Clerk is directed to publish this resolution in the OSHKOSH DAILY
NORTHWESTERN, the official newspaper of the City.
8. The City Clerk is further directed to mail a copy of this resolution to every
property owner whose name appears on the assessment roll whose post office address is
known or can with reasonable diligence be ascertained.

Director of Public Works Steven Gohde.
1A. Information on construction permit parking from Oshkosh Police Department
2. Initial resolution adopted by the Oshkosh Common Council, which began the process
for the improvement(s) adjacent to your property.
3. Notice of public heanng to be held by the Oshkosh Common Council on June 9, 2015
regarding assessments, which will be set with the adoption of the final resolution, also
scheduled for adoption on June 9, 2015.
4. Special assessment payment plan options explaining the payment choices after
Contract No. 15-07 is certified as complete. Payment choice or payment is not accepted
at this time.

A public hearing is scheduled for Tuesday,June 9,2015, in the Common Council Chambers at City Hall to consider
the improvements to your street StaR will be available beginning at 4:45 p.m. in Room 310 of City Hall to
answer questious abou[ t6e project and the es[ima[ed cos[s. Residents may also call the Departmen[ of
Public Works Engineering Division at (920)2365065 to have questlons answered. The proposed assessable
improvements include: concre[e patching, azphalt patching cold mix oveday paving, water main, sanitary laterals
(new and relay), storm sewer laterals (new and relay), wa[er services (new and relay), sidewalks, and/or driveway
approaches and the levy of special assessments that partially cover the wst of the improvements. Assessments are
❑ot due until the pmject is certified as complete and then can be paid by any one of[he plans as outlined by the CiTy
Clerk's infortnation on payment plan options. Based upon the Ciry of Oshkosh assessment policy, [he assessable
portions of the project have been identified and are outlined on the attached assessmen[ worksheet(s). The
es[ima[ed distauce ou side streets is estima[ed high to allow adequate area for the new construction to be
Vansitioned to ihe existing pavement. The quantities and costs are esfimates and will be adjusted ro actual quantiTy
installed and the unit cosu will be adjusted according to the assessment policy based on bid prices. Sidewalk
eslimated quantltles ioclude two (2) additional squaru of sidewalk to allow foc private lateral conswctioa Only
squares ac[ually removed and replaced will be billed to the property owner. Additiona] sidewalk squares removed
will not be billed ro the pmper[y owner if the Consnucrion Acress Agreement previously mailed to them was signed
and retumed by[he proper[y owner.
Property owners who have not retumed the Construcfion Access Agreement will only have partial sidewalk squares
removed and patched. These property owners will be sent orders to replace the patched sidewalk with permanent
concre[e sidewalk in 2016. These property owners will be fuancially responsible for replacing all patched
concrete sidewally all defective sidewalk, and all sidewalk that does not meet [he Americans with Disabilities
Act(ADA)standards. Sidewalk squares ueediug replacement only to meet ADA staodards will no[be billed
to the property owner if [he property owner returns the Canstructian Acress Agreement before
commeucement of the strre[ reconstrucfion project. If needed, please contact the Department of Public Works

Engineering Division at(920)236-5065 or attend the meeting listed above to get a copy of the agreemen[form. The
enclosed assessmen[ information assumes the Construction Access Agreemen7 wu signed and retucned by the
property owner. �
The final cost will no[ increase above the estimated total without another public hearing. Quesuons in regard to
payment of Special Assessments can be aciswered by calling[he City Clerk's office at(920)236-501 l. Questions in
regard to the construction project in general can be answered by calling the Deparlment of Public Works
Engineering Division at(920)236-5065.
The sequence of consWCtion has no[ yet been scheduled with a conhactor. Residents will be notified
appmzimatety one week before consWCtion will begin on a particular streeL Each street identified in this utility
conhact has been designated a specific time frame in which the contractor will need[o comple[e their work on that
sheeL The constructio�time frames vary from 4-8 weeks depending upon the amount of work and the complexity
of the work associated wi[h a specific street. All work within Ihis contract is scheduled to be completed by[he end
of Ocrober 2015.
A specific description of Ihe projec[coustructio�consists of the following elements: relay or installation of specific
segnents of water and sanitary sewer mains and their associated laterals at various bcations within the projecq
relay or installation of srorm sewer laterals, as needed, within the project ro accommodate the drainage needs for the
street and the adjacent propeRies; and concrete driveway approaches and the existing concrete sidewalk will be
repaired as needed for the lateral installations. It is recommended that no salt or harsh chemicals be put on new
sidewalk for one(I)year. If you know of any underground wires and/or piping, (examples: invisible electric fence,
conduit for exterior lighting, irrigation sys[em, etc.) on your property neaz the sidewalk and driveway, please
contact the Engineering Division as soon az possible. Prior to Ihe completion of the project, all disNrbed pavement
areaz will be either patched or paved; and all disNrbed grass areaz wil] be [opsoiled, seeded, and covered with
erosion mat (t6e proper[y owner is responsible for watering the newly vegetated areas). 7'he matting placed
over the seed is biodegmdable; please do no[ remove the mat because i[ serves as mulch for the new grass.
Please set your lawn mower[o the highest setting when mowing the new grus areas until [he new grass areas are
well established.
A[ various locations within the project, a storm lateral is proposed to be insta0ed at each residen[ial bt on the
project. M eight-inch (8") diameter surface drain with a slotted drain cover will be placed into your yazd. 77�e
stortn sewer lateral and dmin will allow you[o direct drainage anrllor sump pump hoses to this location. This drain
is connected to the storm sewer sys[em and drains directly ro local streams and lakes. The lateral is to be used for
"clear water"only. "Clear water" is Typically grou�dwater dischazged by a sump pump or runoff from precipitation
(i.e. rainfall or snow melt). Do oot piace pet waste, yard waste, or other waste material in[o the s[orm sewer
system. In the event conditions on the property prevent the installation of the drain (euample: a substantial
retaining wall),a drain wil]not be instalied,but the storm sewer lateral will be installed underground to[he pmperty
line. You will be receiving additiorml information abwt the stom� sewer la[eral and drain, including a telephone
number for contact ro coordinate the IateraPs and drain's final locatioa The drain is part of your private lateral and
it will be yours to maintain. The drain will have a fabric filter insialled as a part of the consWCtion. Please leave
the filter in place until the grass surrounding the drain is well established. The fabric will prevent dirt and debris
from filling the pipe until the grass is es[ablished. Commercial properties will receive a larger diameter stortn sewer
lateral installed onto the property. 77te previous two paragraphs assume [he Construcfion Access Agreemen7 was
signed arid reNmed by the proper[y owner.
During cons[ruc[ion, there will be periods of time when access to your property will be reshicted. There will only
be a few instances when this situation will occuc Typically, short access restrictions occur during the undergro�md
utility installation and longer restrictions ocwr during the placement of concrete pavement or asphalt pavement and
driveways. To minimize the incomenience, the contractor will provide a one-week no[ice prior to the access being
reshic[ed for utiliTy work. Per the Police Department,a Constructiou Parking Permit is not reouired to park
on a street overnight, if you oark within two f2) blocks of the s[reet under cons[ruc6on (see enclosed
information). All "No Parking" areas and/or pos[ed time zones must be obeyed. Ve6icles parking overnight
must be parked on the house address side of[he street [ha[wrresponds to the current date before midnight.

On odd calendar da[es,the vehicles should be parked ou the odd address side of the street On even calendar
dates, vehicles should be parked on [he even address side of the street Provisions will be made with the Fire
Department and the Sanitation Division so fire protection and CiTy garbage/recycling callection will continue at alI
limes. Please ensure your garbage/recyclables are at the curbside by 7:00 a.m. on your regular collectian
day. Crews schedule collection of garbage/recyclables in conshvction areas at the start of each day. If rural-Type
mailboxes erzist on your street, the contractor wili remove them during construction. This removal will make it
necessary for you to pick up your mail at the Pos[Office. The contrac[or will be responsible so as not to damage
Ihe mailboxes. Upon completion of the paving work,the contractor will reset the mailboxes.
Although tecrace hees may need to be removed at specific locations, they will be preserved as much ac possibie.
Property owners at locations where a hee needs [o be removed will receive advance notice of the removal and
replacement options. Roots and branches may be cut to allow for utiliTy and paving operations. Cutting and
pruning will either be done by,or under the direction of,the City Fores[er.

, As per Section 27-27,27-28 and 27-29 of the Municipal Code of the Crry ojOshkosh,there is no parking
on the CiTy streets, 2 a.m.to 5 a.m.,unless the oumer of vehicle was gran[ed permission or has purchased
a Ciry parking pelmit.
If your street or sidewalk is under construc[ion,i[is NOT necessary to obtain a parking permi[if you pazk
your car within two blocks of[he street under wnsWCtion. All City ordinances and pazking
rules/guidelines must be followed.
All pos[ed pazking restrictions, including time mnes aud no pazking areas, must be obeyed.
You will need to follow the odd-even rules. On odd days of the week,the vehicle should be parked on
the side of the street with odd-numbered houses. On even days of the week,[he permi[holder should
park on the side of[he street with even-rmmbered houses. Each night,the caz should be parked on the
opposite side of the sh�ee[as the night before. NOTE: Odd and Eveo dates are figured before
midnight.
If parking is only allowed on one side of the street,the odd-even rules DO apply. Vehicles can only park
on[he side of[he street that does not have restric[ed parking and are only allowed to pazk ovemight on the
appropria[e odd-even days.
In tAe caze of a declared Snow Emergeocy, ALL vehicles must be removed from the street or the vehicle
will be towed at owner's expense. It is the responsibiliTy of the vehicle owner/operaror[o find altemate
pazking in[he event of a snow emergency.
Disabled vehicles are no[allowed to pazk overnigh[at anytune and should be moved willtin 24 hours.
Motor busses;Wck tractors; semi-trailers;and motor Vvcks designed, used,or mainiained primarily for
the hansportation of property as defined in City Code 27-26(3)are not permitted to park ovemigh[on
City sheets.
All street parking is subject to the following guidelines:
• May not park in signed/designated"No Pazking"areas.
• V ehicles may not stop or park in a designated"Fire Lane".
• No pazking within 10 feet of a fire hydrant(an official traffic si�may indioated[hat a grea[er
distance is required).
• No parking in loading zones.
• No pazking within 4 feet of an alley or private roadway or driveway.
• No parking wi[hin 15 feet to[he near]imits of a crosswalk.
Failure to follow the above rules could resul[in parking citaUOns being issued.

BE IT RESOLVED BY the Common Council of the City of Oshkosh as follows:
1. The Common Council hereby declares its intention to exercise its police
power under Section 66.0703 and 66.0705 of the Wisconsin Statutes to lery special
assessments upon property within the following described areas for benefts conferred
upon such property by improving the following:

2. The total amount assessed against such district shall not exceed the total
cost of the improvements and the amount assessed against any parcel shall not be
greater than the benefits accrued thereto from said improvements.
3. The assessments against any parcel may be paid according to the provisions
of Section 25-83 through 25-89 of the Oshkosh Municipal Code.

4. The governing body determines that the improvements constitute an exercise
of the police power for the health, safety, and general welfare of the municipality and its
inhabitants.
5. The Board of Public Works is directed to prepare a report consisting of:
(a) Final plans and specifications for said improvements.
(b) An estimate of the entire cost of the proposed work or improvements.
(c) An estimate as to each parcel of property within the assessment
district of:
(1) The assessment of benefits to be levied for each
improvement.
(2) The damages to be awarded for property taken or damages
by each improvement.
(3) The net amount of benefits over damages or the net amount
of damages over benefts for each improvement.
(4) The total assessment against each parcel
Upon completion of such report, the Board of Public Works is directed to file a copy
thereof in the City Clerk's Office for public inspection.
6. Upon receiving the report of the Board of Public Works, the City Clerk is
directed to give notice of a public hearing on such reports as specified in Section
66.0703(7)(a) of the Wisconsin Statutes. The hearing shall be held before the Common
Council at the Council Chambers, Room 406 in the City Hall at a time set by the Clerk in
accordance with the Wisconsin Statutes. The assessment against any parcel may be
paid in cash, paid with the first property tax installment, or in ten (10) installments if the
total amount of the assessment is greater than five hundred dollars ($500.00) or fifteen
(15) installments if the total amount of the assessment is greater than one thousand
dollars ($1000.00).
7. The installation of said street improvements shall be accomplished according
to the provisions of Section 253 through 25-11 of the Oshkosh Municipal Code. �

Notification that the City Manager(Board of Public Works) and City Council will hear all persons
interested or their agents or attorneys concerning the matters in the preliminary resolutions
authorizing awards of damages at 6:00 p.m. in the Council Chambers in the City Hall, Oshkosh,
Wisconsin on JUNE 9, 2015.
All objections will be considered at said hearing and thereafterthe amount of assessmentwill be

in the office of the City Clerk. Once Contract No. 15-07 is certified as complete by the Public
Works Department, the final amount (quantities and costs) of the special assessment against
your property or properties will be mailed to you. At that time you will also receive the
paperwork to select a payment choice for the special assessments. PAYMENT CHOICE OR
PAYMENT IS NOT ACCEPTED AT THIS TIME.
THE PAYMENT OPTIONS SHEET YOU WILL RECEIVE AFTER THE CONTRACT IS
CERTIFIED AS COMPLETE WILL HAVE THE FOLLOWING OPTIONS:
INVOICE - PAYMENT WITHIN 30 DAYS
If you choose this option, the City of Oshkosh will then send you a special assessment invoice
and you must make payment within thirty days of that notice.
If the payment is not made within thirty days after receiving the special assessment invoice,6%
interest accrues from the date of notification.
If after making this selection, the property owner fails to make payment to the City Treasurer;
the entire amount including interest will be placed on the next property tax bill.
TOTAL ASSESSMENT ON NEXT TAX BILL IN FULL
Property owners may elect to pay 100% of the assessment on the next designated real estate
property tax bill, without interest. The total amount of the assessment will be included on and
payable in conjunction with the neM designated property tax bill.
