The challenge for the future vlll he to keep the momentum going as a means to protecC and capitalize on Chese investments. Creating an active and economically vital dountovn takes more than just physlcal improvements -- it takes aggressive antl organized business promo- tion and recruitment efforts. This involves alerting the community antl o�tsitle interests to the goods, servlces and business opportunities available downtoun while establishing a favora7le !mage anG environment to Co business. Tvo years ago a number of concernea community leaders anC tlowntown business interests came togethe� to lea�n about Che National Main Str=et program anG the types of promotional acitvities antl Ousi�ess developmen[ strategies vhich have proveC successful for numerous cities across Ehe country. The consensus of ttte participants vas that there Nas a neetl [o develop such an approach in Oshkosh. . An aG hoc committee was formetl in July 1986 by the Oshkosh Commercial Development Corporation (OCDC) to tlevelop a plan for establishing a Business Improvement District (BID) in dawntown Oshkosn. A series of informational meetings were held betueen February antl June 1987 with doWn- tovn property owners and mevchants to present the BID concept, anG to determine the 1eve1 of support for establlshing a downtown improvement district progeam. The presentation of this BIC operating plan is a result of the positive interest expressetl by meeting participants in the BID concept antl proposeG programs, an7 a response to tkeir tles:re to establish a BID in tlOwntOwn Oshko9h. This plan presents a Dovntovn Oshkosh Business Improvement District proposal. The plan inclutles a map of the district, an operating plan antl butlget for 1988, property assessment methodology and tables, an _zplanation of how BID relates to existing dovntown planning efCOrts antl a iegal opinion regarCing th? coclent of this ep_rzcing plan. z THE BID LAW On April 6, 1984, the State of Nisconsin passed a lav (ACt 184) which allowa For Lhe creatlon of Business Improvement �istricts. OFlGANIZATION Upon creation of the Downtoun Oshkosh Business ImprovemenC District by ' the city, the City Manager is requiretl to appoint Che memCers of the DSStrict Board subject to confirmation by the Common Councll. Thle plan proposes Chat the Board Oe composed of 9 members represent- ing the fallowing interests: 2 - Non-owner occupants: --- 1 - retailer --- 7 - service provitler 2 - Non-occupant owners: --- 1 - retailer --- 1 - service proviaer 4 - Owner oceupants: � --- 2 - retailers --- 2 - service proviCers � 1 - Person-at-large. In adaitiun, Board members shoultl be representative of different areas within Che District, as vell as large and smail businesses. As a city entity, the Board will contluct its affairs under Che open meetin5 law and pu�lic recortl requirements. The Boartl Nill be responsible for the management of the Business Improvement District. Responsibilities of the Board inclutle implement- ing the operating plan antl preparing annual reports on the ais[rict. The Ci[y has been actively implementing physical elements of the P1an Dy co�structing new conventlon center and hotel fac!li[ies. making infrastructure and streetscape improvements, - assisting in building rehabilitation. The Plan also recommended Sncreas- Sng organizational efforts betueen the public antl private sectors as rell as establishing a voluntary special assessment tlistrlct. The City of Oshksoh Downtown Business Improvement Distric[ (BID) special assessment �etnoa utilizes assessed value inForma[ion and property street footage data, boGh of uhich are available from tn_ City qssessnr's Office. As the absolute values of assessetl value antl foo[age cannot be combinee, the values are calculatetl as a percentage of the to[a1 assessed value antl a percentage of the street footage. The two percentages are aCdetl vith the sum divitletl by 200 percen[, which res�lts in a proportionate value of the total district. A property's proportionate vaiue of the Cota1 District is multiplied 6y the �istrict buaget, r_sulting in th.e special assessment for the property. The raw data, assessment calcula[ions, and proposetl District assessm_n[ for each p�operty in the doun[ovn Business Improvement District, are presen[etl ov Lhe folloving pages. The data for the assessment methotl have been obtainea from tne files of the City Assessor ana are su0ject to final tabulaCiov by the City. Sec. -66.608. 2 have also reviewe3 the operating plan subnitted for Business Improvement District !k1 for downtown Oshkosn, and Z have reviewed this specifically with regard to Wis. Stats. Sec. 66.608 (1) (f) 5 which calls for a legal opinion as to certain requirements being made for an operating p1an. It is my opinion that the plan which has been adopted does provide for a special assessment method aad that said method will include manufacturing premises. It is fur- � ther my opinion that the expenditures have been listed � and that a time for making said expenditures, at least initially, has been set forth. The operating plan certainly describes why and how the BID will promote the orderly development of t:�e municipality an3 specificnlly r_lates thi=_ nlan to the central business district plan.
