WHEREAS, pe[itions were submitted to the CI[y from downtown property
owners in Ju1y, 1987, asking that [he Ci[y of Oshkosh create a Downtown Oshkosh
Busineae Improvement District to provide for the implemenCa[ion of ac[ivLties
as set forth wiihin the a[tached Lnitial Operating Plan; and
WHEREAS, the Plan Cormnisslon reviewed eaid request and designated [he
boundaries of the propoaed Downtown Oshkosh Business Improvement Diatrict and
adop[ed the Initlal Operating Plan at Lts Ju1y 13, 1987 meeting; and
WHEREAS� the Plan Co�mniasion held a pablic hearing on August 10, 1987
and provided for the no[ifica[ion to all property owners wi[hin said Dis[ric[
as set forth under Section 66.608(2)(c) , of the Wisconsin Statutes; and
WHEREAS, petitions have not been filed wi[h [he Ci[y of Oshkosh by [he
ownera of property [o be assessed under Che proposed initial operating plan
having an asaessed valuation eqnal to more than 40% of the assessed valuatlon
of all proper[y to be assessed under [he proposed initial opera[ing plan; and
WHEREAS� the City Attorney has determined Cha[ [he provisions of Sec[ion
66.608(1)(f)1-4, of the Wisconsin Sta[utes, have been wmplied with; and
WFIEREAS� the creation of the Downtown Oshkosh Business Imprwemen[ District
would fos[er the continued development and revitalization of the downtown and
is consistent wi[h the objectives of previoue down[own developmen[ plans;
NOW, THEREFORE, BE IT RESOLVED by the Co�mnon Council of the City of Oshkosh
that, pureuant to [he power and authority conferred by Section 66.608, of the
Wisconsin 5[atutes, as crea[ed 6y 1983 Wisconsin Ac[ 184� ihe Down[own Business
Improvement District of the Ci[y of Oshkosh is hereby created, the same [o be
effective and in exis[ence as of Octo6er 1, 1987, [he established houndaries of
which being more specifically defined in [he a[tached no[ice of public hearing.

INTRODUCTION
Many positive improvements have been made in Qovntoun 09nkosh during the
past year. He have a nev hotel anQ convention centre, a restoreC Grantl ,
Opera 9ouse, GSSCOnain National LSfe's ofrice expansion, streetscaping on �
t5e Y00 block of N. Main, numerous bulltling facade improvemen[s vith nev
Duslnesses opening on N. Main Street anG in Park Plaza Mall. The challenge
for the future vlll he to keep the momentum going as a means to protecC
and capitalize on Chese investments.
Creating an active and economically vital dountovn takes more than just
physlcal improvements -- it takes aggressive antl organized business promo-
tion and recruitment efforts. This involves alerting the community antl
o�tsitle interests to the goods, servlces and business opportunities
available downtoun while establishing a favora7le !mage anG environment
to Co business.
Tvo years ago a number of concernea community leaders anC tlowntown business
interests came togethe� to lea�n about Che National Main Str=et program
anG the types of promotional acitvities antl Ousi�ess developmen[ strategies
vhich have proveC successful for numerous cities across Ehe country. The
consensus of ttte participants vas that there Nas a neetl [o develop such an
approach in Oshkosh. .
An aG hoc committee was formetl in July 1986 by the Oshkosh Commercial
Development Corporation (OCDC) to tlevelop a plan for establishing a
Business Improvement District (BID) in dawntown Oshkosn. A series of
informational meetings were held betueen February antl June 1987 with doWn-
tovn property owners and mevchants to present the BID concept, anG to
determine the 1eve1 of support for establlshing a downtown improvement
district progeam. The presentation of this BIC operating plan is a
result of the positive interest expressetl by meeting participants in the
BID concept antl proposeG programs, an7 a response to tkeir tles:re to
establish a BID in tlOwntOwn Oshko9h.
This plan presents a Dovntovn Oshkosh Business Improvement District
proposal. The plan inclutles a map of the district, an operating plan
antl butlget for 1988, property assessment methodology and tables, an
_zplanation of how BID relates to existing dovntown planning efCOrts antl
a iegal opinion regarCing th? coclent of this ep_rzcing plan.

THE BID LAW
On April 6, 1984, the State of Nisconsin passed a lav (ACt 184) which
allowa For Lhe creatlon of Business Improvement �istricts. The purpose -
ot the law Sa to authorize cities, villages, and towns to creaCe one or
. more Eusiness Smprovement Cistricts to a11ow Cusinesses within those
districts to Qevelop, manage, maintain, anE promote their tlistricts and
to esta�lish an assessment methotl to fund Chase activities. A BID must
be a geographic acea vithln a municipality consisting of contiguous
paccels which are subject to real estate tazes.

(business people, property owners, mercnan[s, city o£ficials antl others)

A BID is the best available method for business people to organize,
coordinate marketing antl pCOmOtion effoCts, provide management, anC
maintenance programs, an7 encourage Dusiness Gevelopment. It afforas
property owners antl business people a very real roie in dSrecting tnose
affairs wittlin the district which influence their investa_nt antl environ-
ment. I[ also insures that all Eeneficiaries oF Distr:ct programs parti-
cipate in the funtling of the programs. '

1988 OPEHpTING PLAN
� . OFlGANIZATION
Upon creation of the Downtoun Oshkosh Business ImprovemenC District by '
the city, the City Manager is requiretl to appoint Che memCers of the
DSStrict Board subject to confirmation by the Common Councll.
Thle plan proposes Chat the Board Oe composed of 9 members represent-
ing the fallowing interests:

In adaitiun, Board members shoultl be representative of different areas
within Che District, as vell as large and smail businesses. As a city
entity, the Board will contluct its affairs under Che open meetin5
law and pu�lic recortl requirements.
The Boartl Nill be responsible for the management of the Business
Improvement District. Responsibilities of the Board inclutle implement-
ing the operating plan antl preparing annual reports on the ais[rict.
The Boartl will also annually consltler and make changes to the opera-
[ing plan antl submit the opera[ing plan to the City Council for
approval.
Once established the Boartl uill arrange with the Oshkosh Chamber of
Commerce to proviae personnel Co carry out Che tlevelopment and Gay-
to-day management of tbe BID program activities.
2. OPERATIONS
During its first year, tne Downtovn Oshkosh Business Improv_ment
Dis[rict vi.l carry out Lhe proposea program of ac[ivities listetl on
Che following page. Inclutled are the expenditures associaCetl with
each activity. These proJectetl costs include all services r=latetl Co
program tlevelopment, materials znd management.

OBJeCTIVE: To provide necessary economic/market aata antl

(mnsists o£ in-person and Celephone business recruitments,
mailings, aCVertisements, Cravel expenses, prospect acom-
motlations, targetetl pcomotions) .
CBJECTrVE: To fill vacant retai! antl affice soace in
providing neeCed goods antl services not available downtoun
or in Oshkosh vhich in Curn generates atltlitional commercial
traffic for ezisting tlovntovn businesses.
3- Marketing/Promotion
A. Develop marketing strategy/logo/[heme to promote and enhance $ 2,5p0
tlovntown business image.
OBJECTIVE: Determine effective ways to attract aGtlitional;
tlountown Cusiness pa[ronage. Establish common �owntawn logo
for use by bus!vesses in [heir ativ_r[is±ng wnicry reinforces
public perception of Going business in downtoun Oshkosh.
6. Develop business directory - includes all bus.ness listings $ „CO
uitn aap indicating fr?e parking areas, long t=rm parking
antl publlc facilities.
OBJECTIVE: To inform dountown businesspeop:e, custamers,
clients, Oshkosh communiCy anti visitors what gooCS and
services are available Cowntown, ahere to find them and tne
most convenient place to park.

RELATIONSHIP TO DOWNTOYN PLANNING
In 1980 the City Council adopted the Downtown Redevelopment P1an and
Zmplemen[ation Stra[egy. The Ci[y has been actively implementing
physical elements of the P1an Dy co�structing new conventlon center and
hotel fac!li[ies. making infrastructure and streetscape improvements,
- assisting in building rehabilitation. The Plan also recommended Sncreas-
Sng organizational efforts betueen the public antl private sectors as
rell as establishing a voluntary special assessment tlistrlct. A fo11oW- �
up study, P1an�ing fleport - Central City Osrtkosh, approved by the City
Council in 198� expandetl variaus elements of the previous plans antl in
particular recommenCeQ the creation of a management vehicle antl funtling
base to serve the aovntown area. The management tool recommenaea Was a
Business improvement District.
The �awntown Oshkosh Business Improvement District (BID) is consistent
with and cri^ical to the cont?nuetl successful implementation of Chese �
downtoun plarts. The BI� vi11 enable the private sector to undertake
promotion, management, marketing, and other programs essential to a
prosperous dawntoWn.
BID ASSESSMENT METHOD .
The City of Oshksoh Downtown Business Improvement Distric[ (BID) special
assessment �etnoa utilizes assessed value inForma[ion and property street
footage data, boGh of uhich are available from tn_ City qssessnr's Office.
As the absolute values of assessetl value antl foo[age cannot be combinee,
the values are calculatetl as a percentage of the to[a1 assessed value antl
a percentage of the street footage. The two percentages are aCdetl vith
the sum divitletl by 200 percen[, which res�lts in a proportionate value
of the total district. A property's proportionate vaiue of the Cota1
District is multiplied 6y the �istrict buaget, r_sulting in th.e special
assessment for the property.
The raw data, assessment calcula[ions, and proposetl District assessm_n[
for each p�operty in the doun[ovn Business Improvement District, are
presen[etl ov Lhe folloving pages. The data for the assessment methotl
have been obtainea from tne files of the City Assessor ana are su0ject
to final tabulaCiov by the City. To accoun[ for streec footag=s, ranging �
from very short front footages to entire blocks, the footage uas computed
in a manner similar to the City's normal special assessment mechoaology.

2 have reviewed 1983 Wisconsin Act 184 which created
t�is. Stats. Sec. -66.608. 2 have also reviewe3 the
operating plan subnitted for Business Improvement
District !k1 for downtown Oshkosn, and Z have reviewed
this specifically with regard to Wis. Stats. Sec.
66.608 (1) (f) 5 which calls for a legal opinion as to
certain requirements being made for an operating p1an.
It is my opinion that the plan which has been adopted does
provide for a special assessment method aad that said
method will include manufacturing premises. It is fur-
� ther my opinion that the expenditures have been listed �
and that a time for making said expenditures, at least
initially, has been set forth.
The operating plan certainly describes why and how the
BID will promote the orderly development of t:�e municipality
an3 specificnlly r_lates thi=_ nlan to the central business
district plan. It is, therefore, my opinion that Sec. 66. 608
(f) 1-4 has been met and complied with.
