Dear Mr. Kremer: I am writing you as a follow up to my letter of August 28, 1987 . I understand that the City has determined that it would continue zoning property as R-2 and allow others to bid on the property to date of October 9, 1987 at 4 : 30 P.M. In this regard, I have revised my earlier letter and you will note the following changes: 1. The Buyer is now correctly listed as Znnovative Interests, Inc. , a Wisconsin corporation. 2 . We have provided that the property can be zoned R-2 . 3 . We have provided that the offer can be accepted within thirty (30) days so that we have extended its duration. 4 . Of additional particular importance is the purchase price and we have provided that we would not lower the purchase price but that we would have a right to increase the purchase price by supplementary offer prior to 4 : 30 P.M. , Octo6er 9, 1987 . I would appreciate it if you would file our current offer with the understanding that we may sapplement it pending further review of potential use of the site if zoning is not changed to C-2 . Box 1130 Oshkosh, WI 54901 Re: Our Clients: Jet Strean and Walter M. TacY, and Patrick J. McCUllough/Innovative Interests, Inc. Dear Mr. Kremer: Our office represents the above clients who are doing business in Oshkosh under the name Set Stream Car Wash at a location on Witzel Avenue in the City of ashkosh. You were kind enough to assist us in prior acquisition of a piece of property in the fall of 19a5 which was excess property owned by the City of Oshkosh. I now understand that there is some additional property that the City is interested in disposing of and my clients have asked me to correspond with you in that regard. The purpose of this letter is to outline a proposal for acquisition of this additional parcel of real estate with terms and conditions to be as follows: I . SELLER The Seller would be the City of Oshkosh, a political sub- division of the State of Wisconsin. II. BUYER The Buyer would be Eanovative Interests, Inc. , a wisconsin corporation. III . PROPERTY SUBJECT TO SALE The property subject to sale would be a qenerally rectangular piece of property described as Parcel No. 6-351-3 and shown on attached Exhibits A and B. - 15b - , . Res. #325 Mr. Boyd Rremer Page Two September 30, 1987 IV. PURCHASE PRICE The purchase price would be the sum of $500. 00 to be paid in cash at closing. Provided further, my clients reserve the right to increase the bid on the subject property at any time prior to 4 : 30 P.M. , October 9, 1987 after evaluation of utility of the parcel and after reflection upon effect that possible R-2 zoning may have on future stility of the parcel. V. CONDITION TO CLOSING The obligation of purchaser to close the transaction would be conditioned on property being zoned C-2 or designate the same as existing parcel owned by Mr. Tack and Mr. McCUllough or in the alternative, that the parcel be zoned R-2 . VZ . CIASING/EVIDENCE OF TITLE Closing would be subject to the followinq conditions: a. Expenses prorated in accord with normal real estate transactions involving municipality. b. Conveyance to be supported by appropriate copy of resolution authorizing execution of deed and by � certified copy of resolution showing rezoning. c. Evidence of title to be by title insurance, abstract, or letter report at option of City. d. Closing be held on seven (7) days notice at mutually convenient time and place upon fulfillment of conditions or requirements centained herein. VII. ACCEPTANCE OF OFFER This offer of purchase shall remain open for a period of thirty (30) days. It may be accepted by providing written notice of acceptance to the undersigned at his business address. At the expiration of thirty (30) days, this offer shall expire if not accepted and be null and void. SUMMARY If the above meets with your approval, I would appreciate it if you would have an authorized representative of the City sign in the place provided below for signature. - lsc - . � Res. @325 Mr. Boyd Kremer Page Three September 30, 1987 It would be understood that if the City Council did not subsequently approve the transaction by appropriate resolution, that this offer would be null and void. We would then trust that you would proceed with appropriate procedures for rezoning and authorization of execution of the deed.
