BE IT FURTHER RESOLVED that money for this purpose is hereby appropriated from: Account No. 338-999 -- Street Improvement Fund Expenditures. This agreemen[ establishes the condi[ions and estimated cos[ to provide preliminary engineering for the above project. We ask you to approve [his agreement by signing and returning [wo copies to our office. The contract calls for the consultant to submit bills to our office for payment by [he D.O.T. You should submi[ your share of the preliminary engi- neering cos[ with this agreement. Your share is estima[ed at $11,820. Please make checks payable to [he Wisconsin Departmen[ of Transportation. Such atltlltional work as is necessary to enmre a complete improvement accep[able to the Division of Highways antl the Federal HigM1way Atlministration will be underlaken indepentlenUy by the Municipalily without mst to the Stale antl wlthout Fetleral par Pmipa[ion. Such work is qenerally delineatetl herein. 5. The performance of surveys,plans, preconshuction engineering antl right ot way acquisition is the responsibillty of the Munici- pa�iry. 6. The Dishict Office of the Division of Highways will moperate with and ativise the Munlcipallty during the survey ana plan tlevel� opment antl right of way acQUisi'.ion phases of the project. ]. It is understood that,upon mmpletion of the plans antl prior lo the execution ot a mntract for lhe work,the prqect will be sub- ject to further agreement between lhe Municipality antl the S�ate wilh respect to tletails oF tleslgn,approval of plans,and certain re� quirements to v[isfy provisions of the FetlerabAitl Highway Ac[and lhe regulations issuetl pursuant therero. 8. Subsequent to the recelpt of bids but prior to the execution of a mntract,[he Municipallty will tleposit with Ihe Division of High- ways the funds estimated by lM1e Division as necessary to tlefray all costs incident to lhe project which are mt remverable from Fetl- eral funtls allocatetl to the project. Any balance remaining of mch deposit will be re[umed to Me Municipality upon flnal audit. Should the Municipality decline to make zuch a deposit,it is untlerstaotl that no wntract will pe entered into for lhe ezecufion ot the work antl that [he further tlisposition of the prolect will be tM1e subject of negotiation between the Municipalily and the Dlvision of Hiqhways. 9. In such even[,or ii the M1tunicipality should withtlraw the project for other reasons, it will al ihat time �eimburse the Division of HigM1ways tor any msts incu«etl by it In behalf of Ihe project. 10.
