WHEREAS, on Sep[ember 17, 1987 [he City of Oshkosh Co�mnon Council
created [he Downtown Oshkosh Business Improvemen[ Dis[ric[ and adop[ed [he
Initial Operating Plan for said District; and
WHEREAS, the Down[own Oshkosh Business Improvemen[ Disiric[ Hoard has
made changes in [he Ini[ial Operating Plan deemed appropria[e [o implement
said Plan.
NOW, THEREFORE, BE IT RESOLVED by [he Common Council of [he Ci[y of
Oshkosh ihai [he aitached Down[own Oshkosh Basiness Zmprovemen[ Distric[
Final Opera[ing Plan is hereby approved and adopted.

INTFODUCTION
Many poslt!ve improvements have been matle in Cowntown Oshkosh tluring the
past year. Ne have a nev hotel anG convention centre, a restoretl GranG
Opera Nouae, Mlsconsin Natianal Life's office ezpansion, streetscaping on
the �00 block ot N. Main, n�merous building facade improvements vith nev
bu91ne99e9 opening on N. Haln Street antl in Park Plaza Mall. the challenge
far the future will be Co keep the momentum going as a means Co protect
antl capltalize on these investments.
Creating an active anC economically vital downtown takes more Chan �ust
physlcal i�provements -- it takes aggressive and organizeC business promo-
tion anC recruitment efCorts, ihis involves alerting the community antl
outside interests to the goods, services antl 6usiness opportunities
available dovntown vhile establlshing a favoraDle image antl enviror.ment
La Go Ousiness.
Two years ago a number of concerned community leaders antl Gawntown business
interests came together Co learn about the National Main Street program
anG the types of promo[ional acitvitie9 antl business development strategies
which have proved successful for numerous cities across Che country. The
consensus ot the participants vas Chat there uas a need to tlevelop such an
approach in Cshkosh.
An atl hoc committee was formed in July 1986 by the Oshkosh Commercial
Development Carporation (OCDC) to Develop a plan for esta�lishing a
Business Improvement Cistric[ (B2D) Sn tlowntavn Oshkosn. A ser!es of .
infocmational meetings were held betue=n February antl June 7987 vith dawn-
town property awners and merchants to prese�t the BID concept, and to
Cetermine the 1eve1 of sucport for es[ab1!sning a dovntoWn improvement
tlistrict prodram. The presentation of this BiD operati�g plan is a
result of Che positive interest expressetl by meeting participan[s in tne
B:D concep[ and proposeG programs, antl a response Lo their tles:re to
establish x BID Sn dovntovn Oshkosh. �
This plan presents a DovnCown Oshkosh Business :mpravement Distric[

THH BID LAW
On April 6, 198L, the State of Nlsconsin passed a lav (ACt 184) which
allous for the creatlon of Buainess Improvement Districcs. The purpose
oC the law Ss to authorize citles, villages, anG towns Co cr<ate one or
more Duslness improvement QSatricts to alloa Dusinesses Nithin Chose
tliatrlcts to Qevelop, manage, maintain, and pramote their districts and
Lo estaDllsh an assessment method to fund these activities. A BID must
be a geographic area within a municipality consisting of contiguous
parcels ultich are sub,Ject to real estate Caxes.
The formation of a business improvement Clstrict aL'oes tlountovners
(Dusir.ess people, property owners, merchants, ci[y offLcials antl otttersJ
to figure out what needs Lo be don_ to upgrade antl strengttten dovntoun
and to pay the cost of tloing i[, in whole or in part. It is a uay for
downCOwners Co tlecide vhat they want and Co finance it.
A BID Ss tlte Oest avallable methoG for business people to organize,
coorCinate marketing antl promotion efforts, provide management, and
malntenance programs, and encourage Ousiness tlevelopmen[. IL affortls
property owners and Cuslness people a very real role in airecting those
affairs vit:tin the tlistrict which influence their invesca�nt and environ-
ment. It also insures Chat all beneCiciaries of Dis[rict programs parti-
cipate in the funding of the programs.

. Upon creation of tha Oowntovn Oshkosh Business Iaprovement DSStMct by '
Cne city, the Clty Manager is required to appoint Che members ot the
DSStrict Boartl subJect La confirmation by the Common Council.
Thla plan praposes Chat the Boartl be composed of 9 members represent-
ing Lhe folloving Sntereats:

2 - Non-occupant owners:

--- 1 - service provider
4 - pvner occupants:

In adtlitiun, Board members shoultl be representative of different areas
wi[hin the DisGrict, as veil as 1arg= antl small businesses. As a city
entity, the 6oard aill conduct i[s affairs unGer [he open mee[ing
law and public recortl requirements.
The Board will 6e responsible for the management o[ Che Business
Improvement District. Aesoonsibilities oF tne BoarG 1ncluCe implement-
ing the operating plan and preparing annual reports on the Gistrict.
The Board vi11 also anwally consider antl make changes to the opera-
ting plan antl su0mi[ the operating plan to the CLty Council for
approval.
Once establ!shed the Board uill arrange wi[h the Oshkosh Chamber of
Commerce to provide personnel to carry out the GeveloomenC and aay-
to-day aa.^.agement ai the 6ID program activities.
2. OPERATIONS
During its firs[ year, tne Dovntovn Oshkosh Business Improvement
�istrict will carry out the proposed program of activities Listetl on
[he Collowing page. Inclutletl are the expentlitures associated with
each activity. These pro�ected costs include a11 services r=lated to
prograo development, materials znd management.

1. Free Shori Term Parking Subsidy $55,000
A. Reimburae City Parking O[ili[y for loas of parking meier

ing in accotdance with the Parking Agreemen[ be[ween the
BID and the Ci[y.
08JECTIVE: Alleviate customer concern abou[ plugging
meters and having correct change, e[c. , to encourage
longer shopping time, <onvenience in conducting 6usiness
transactions and esiablishing bet[er public rela[ions.
2. Business Recrui[ment $ 6,000
A. Develop leasing packe[ for downtown area.
OBSECTIVE: To provide necessary eronomir/market da[a and
available space inFormation io prospec[Lve businesses
considering a downtown loca[Son.
B. Targeted Business Prospec[ Developmen[ (consLs[s of, 6ut
no[ limi[ed [o, in-person and [elephone business recrui[-
menis, mailings� adver[isemenis , travel expenses, prospec[
accommoda[ions, targe[ed promo[ions. )
0B7ECTIVE: To fill vacan[ retail and office spece in pro-
viding needed goods and services no[ available downiown or
in Oshkosh, which in [urn genera[es additional commercial
traffic for exis[ing downtown businesses.
3. Marketing/Promo[ion $ 4,000
A. Develop marketing s[ra[egy/logo/Theme [o promo[e and enhance
down[own basiness image.
08JECTIVE: De[ermine effective ways to attract additional
downtown business pa[ronage. Establish common down[own logo
for use by bvsinesses in [heir advertising which reenforces
public perception of doing business in down[own Oshkosh.
B. Develop Business Directory - includes all busicess listings
wi[h map indica[ing free parking areas, long [erm parking
and public fa<ilities.
OBSECTIVE: To inform downtawn business people, cus[omers�
clients, Oshkosh m`mnuni[y and visimrs wha[ goods and ser-
vices are available downiown� where to find ihem, and [he
mos[ <onvenien[ place to park.
4. General
A. Activities and programs [o improve [he BID District as
required or permii[ed by S[ate Sta[u[es, that are in com-
pliance wi[h [he Operating Pian and approved by the BID
Board, providing sufficien[ program funds are avaialble.

RELATIONSHIP TO DOWNTOWN PLANNING
In 1980 the C!Ly Council adopted the Downtown fledevelopmen[ Plan antl
Implementation Strategy. The Ci[y has been actively Smolementing
physlcal elements oC Che Plan �y constructing new comention center anC
ho[el facilltles, making inFrastructure ana streetscape improvements,
' asslsting in Cuilding rehabilltation. The Plan also recommentlea increas-
ing organizational efforts between the publlc anC prlvate sectors as
well as establishing a voluntary spe<Sal assessment district. A follou-
up stutly, Planning Report - Central Ci[y Oshkosh, aDprov._d by [he City
Council Sn 1987 expanded various elements of the prevlous pians and in
particular recommentletl the cr_ation of a management vehicle antl funtling
base Co serve the tlovntown area. The management Coo1 recommenQeQ vas a
Business Improvement District. � �
The �owntown Oshkash Business Improvement District (BID) is conslstent
with and critical to the continued successful implementation ot Chese -
downtovn plans. The 8ID w111 e�able [he private sec[or Co untlertake
promotion, management, marketing, and other programs essential Co a
prosperous downtown.
82D ASSESSuENT METHOD .
The City of Oshksoh Dovntovn Business Improvement District (BID7 special
assessment methotl utilizes assessed value information antl prooerty street
footage da[a, bo[h of uhich are availaole from the City Assessor's �ffice.
As the absolute values of assessetl va'_ue antl footage cannot be comoinetl,
the values are calculated as a percentage of the total assessed value and
a percentage of Che street footage. The two perce�tages are aGQeC with
the sum �ivided by 200 percent, vhicn resalts in a proportionate value
oC the to[al district. A properCy's proportiona[e value of the total
District is multiplzetl by the Distric! buaget, resulting in the special
assessment for the property.
ihe ra� daGa, assessment calculations, and proposed District assessm=nt
for each property in the downtown Business improvement Dis[rict, are
pr_sen[etl on Che folloving pages. ihe data for the assessment method
have been obtained from the files of the City Assessor and are subject
[o final tabulation by the City. To account for stroet tootag_s, rancing
from very short tront foocages to entire blocks, [he footage was compuCed
in a mar.ner similar to the City's mrmal soecial assessment meenodology.

� I have reviewed 1983 Wisconsin Act 184 which created
Wis. Stats. Sec. �66.608. Z have also reviewe3 the
operating plan subnitted for Business Improve.ment
District M1 for downtown Oshkosh, and I have reviewed
this specificaliy with regard to Wis. Stats. Sec.
66. 608 (1) (f) 5 which calls for a legal opinion as to
certain requirements being made for an operatiag plan.
It is my opinion that the plan which has beea adopted does
provide for a special assessment method aad that said
method will include manufacturing prer,u.ses. It is fur-
�. ther my opinion that the expenditures have been listed -
and that a time for making said expenditures, at lezst
initially, has been set forth.
The operating plan certainly describes why and how the

and speci£ically relates this plan to t7e cectral business
district plan. It is, therefore, my opinion that Sec, fi6 .608
