NOW� TNEREFORE� IT IS HEA.Fpy AGR£ED between the City of Oshkosh, a municipal corporation located in Winnebago County, Wisconsin, hereinafter called "CSty"� and the Cathollc Cemetery Associaiion of Oshkoah, Oshkoeh, Wlsconeln, hereinafter called "The Catholic Aasoclation", ae followe: A. The City of Oshkosh agreee to provlde the following services on the aforementioned Calvary Cemetery and Riverside Catholic Cemetery: 1. Turf maintenance commonly associated with a ceme[ery including cutting� eodding, Srrigation, ' weed contzol, and trSmming; 2. Snow removal on cemetery [oade ueed for funeral servlces. 3. Locatinq� spotting� and eatablishing the pzoper locatione for immedlate internments and their corresponding markere. 4. Labor for the repalr o£ irrigatlon linea and valves. The coat of needed eupplies and materials will be billed to the CatholSc Association. 5. The Cathollc Aeeociatlon may request the City of Oshkoah conduct Snternment aervlces at the approved rate schedule end that the City Snvoice the approprlate requesting party� and the City of Oshkosh may agree to do same. The City of Oshkosh v111 now ehow, locate, or propose infoxmation for lot eales or for slmilar purposes. B. The CaGhollc Aeeoclation wlll pay to the City of os�kosh the amount of 525,000.00. Said paymente to be matle in quar[erly Snstallmenter payable by the 15th daY of the months deemed to be appropriate by the Oepartment oP Finance of the City of Oshkosh, to the Collection Depattment, City Hall, 215 Church Avenue, Oshkosh, Wieconsln. C. The Cathollc AssoclalSon and the Dltector of Pazks of the City of Oehkosh or hle designae� will cooperate with each other in the uee, operatlon� eecurity� and houre of operation or similar matters with regard to tha cemeterles, in order to protect, maintain, and to eecure t�e phyaical components located wlthin t�e cemetery and to provlde proper service within the cemetery. However� the decielon oY tha City oP Oshkosh will be f1na1 whanevet a conflict arises. The Catholic Association agrees to provide propar eupervieion of the offices to be ranted by it and to use all reasonable efforte to prevent vandalism or damage <o City propertY. and [he Aseociation agrees [o leave any premises occupled by them at tha end oP the year Sn qood condition at the termina{Son of tha aq[eement. D. The Catholic Aseociation will be responeible £or any and al7 cemetery related activltiee, including but not limited to, the selling of lote, publishing and advertisinq� and collec[ion of fees. The Clty will not invoice or collect any fees for lot salee and other eervices except in direct correlation vith Clty servicee. The Cathollc Association will be responsible for cemetery activikles related to Gree care� i.e. , - 16b - � C�"��ir�, removal, di�posal o£ all vood, limba, antl leaves a.,sociaGed vith the trees.
