PLAN COMMISSION MINUTES
May 19, 2015

Chairperson Fojtik called the meeting to order at 4:00 pm. Roll call was taken and a quorum declared
present.
The minutes of May 5, 2015 were approved as presented. (Propp/Gray)
I. GRANT PRIVATE UTILITY EASEMENT ADJACENT TO 2200 BADGER AVENUE
EAST OF UNIVERSAL STREET
Wisconsin Public Service Corporation is requesting the granting of an easement through a vacant city-
owned parcel west of and adjacent to 2200 Badger Avenue east of Universal Street.
Mr. Slusarek presented the item and reviewed the site and surrounding area. He explained the reason
for the proposed easement and reviewed the site plan depicting the location. He further stated that the
easement was necessary for Bemis Corporation’s planned expansion of their industrial site and the
location of the easement would not interfere with any city utilities located in that area.
There was no discussion on this item.
Motion by Lohry to approve granting a private utility easement adjacent to 2200 Badger
Avenue east of Universal Street.
Seconded by Hinz. Motion carried 5-0.
II. EXTRATERRITORIAL TWO-LOT LAND DIVISION/CERTIFIED SURVEY MAP AT
THE 3600 BLOCK OF NEKIMI AVENUE IN THE TOWN OF NEKIMI
The owner/petitioner is requesting a two-lot land division/certified survey map of one existing
unplatted parcel containing a total of 35.20 acres. Sizes of the proposed lots are as follows:
Lot 1 = 5.00 Acres
Lot 2 = 28.96 Acres
Right-of-Way Dedication = 1.24 Acres
Mr. Nau presented the item and reviewed the site and surrounding area as well as the zoning
classifications and land use in this area. He also reviewed the submitted certified survey map and
explained that the land division was proposed to enable the owner to sell the western five acre Lot 1 to
a prospective buyer for industrial use. This use is consistent with the City’s Comprehensive Plan and
he described the other uses adjacent to this site. The Department of Public Works has reviewed the

proposed land division and noted that there may be wetlands present on the site which may require a
wetland delineation be conducted prior to any development on the property.
There was no discussion on this item.
Motion by Lohry to approve the extraterritorial two-lot land division/certified survey map at
the 3600 block of Nekimi Avenue in the Town of Nekimi.
Seconded by Gray. Motion carried 5-0.
IIIA. THREE-LOT LAND DIVISION/CERTIFIED SURVEY MAP LOCATED AT 3101 ELK
RIDGE DRIVE
IIIB. STREET RIGHT-OF-WAY DEDICATION OF ELK RIDGE DRIVE FROM W.
WAUKAU AVENUE TO RUFFED GROUSE WAY
The applicant is requesting a three-lot land division from one existing parcel containing a total of
19.7468 acres. The petitioner is also requesting the right-of-way dedication of Elk Ridge Drive located
east of the proposed land division. Sizes of the proposed lots and right-of-way dedication are as
follows:
Lot 1 = 8.2355 Acres
Lot 2 = 4.9399 Acres
Lot 3 = 4.1852 Acres
Right-of-Way = 2.3862 Acres
Mr. Nau presented the items and reviewed the site and surrounding area as well as the zoning
classifications and land use in this area. He explained that the subject site is part of the Hunters Ridge
Development which is a mix of multi-family apartments and condominiums. He reviewed the certified
survey map of which the proposed Lot 1 is completely developed, Lot 2 is partially developed with
three completed buildings and space for an additional three structures, and Lot 3 is currently vacant but
is planned for development of three apartment buildings. He stated that the development configuration
meets the requirements of the subdivision regulations and that cross-access easements between the lots
will be required and appropriate easement documents have already been recorded. Mr. Nau also
reviewed the street dedication of Elk Ridge Drive which is proposed to be a 60-foot wide right-of-way
extending from W. Waukau Avenue south to Ruffed Grouse Way which meets the City’s standards for
a local classed street. He further explained that the northern portion of the street was paved in
accordance with the developer’s agreement and the Department of Public Works recommends
requiring that the southern portion be completed per that agreement. The Department of Public Works
and the Transit Department have reviewed the proposed street dedication and have expressed no
concerns with the design layout. He also reviewed the conditions recommended for the land division.
Mr. Hinz commented that when Elk Ridge Drive is completed and connects with Ruffed Grouse Way,
would this connection be to an uncompleted road as Ruffed Grouse Way does not appear to be paved.
James Rabe, Civil Engineer Supervisor, indicated that Ruffed Grouse Way is currently a gravel road.
Mr. Hinz questioned what the timeline was for the completion of this street.
Mr. Nau stated that streets should be constructed within three years of utility placement but was not
sure when this occurred.

Mr. Rabe confirmed that the period has expired for the street construction and that was the reason for
the City’s request for the letter of credit to be renewed or extended to ensure the paving of Elk Ridge
Drive is completed.
Mr. Gray questioned that the area appears to have two different zoning classifications.
Mr. Nau responded that the zoning designations did not change when the development commenced
and that there was a portion of C-2 zoning that crosses over into the apartment development. He stated
that with the zoning update under way, this would be addressed at that time.
Mr. Gray questioned if the Commission would be voting on these items together or separately as one
of the items does not require Common Council approval.
Mr. Buck replied that the Commission would vote on the two items separately.
Ms. Propp stated that since the project meets the City’s subdivision regulations that the development
would not require Plan Commission and Common Council approval and questioned if a storm water
management plan was in place and adequate.
Mr. Rabe responded that a regional storm water management plan was completed at the time of the
subdivision approval and noted the location of it.
Motion by Propp to approve the three-lot land division/certified survey map located at 3101
Elk Ridge Drive with the following conditions:
1. Developer shall comply with approved developer’s agreement to finish construction of
Elk Ridge Drive.
2. Developer shall renew letter of credit with the City for construction of Elk Ridge Drive.
Seconded by Lohry. Motion carried 5-0.
Motion by Gray to approve the street right-of-way dedication of Elk Ridge Drive from W.
Waukau Avenue to Ruffed Grouse Way.
Seconded by Hinz. Motion carried 5-0.
There being no further business, the meeting adjourned at approximately 4:17 pm. (Hinz/Propp)
