BOARD OF ZONING APPEALS MINUTES 3 WEDNESDAY, NOVEMBER 7 , 1979 , 3 : 30 P.M. MEMBERS PRESENT : Oliver LaLond, George Last , Norman Miller, and Mel Carpenter STAFF PRESENT: Edward Reimer , Chief Building Inspector Roland Miller, Deputy Dir. Community Development Gail Luther , Recording Secretary Chairman Mel Carpenter called the meeting to order and the roll cal� was taken. There was a quorum of four (4 ) members present . Mr�. Reimer no-ted there were a few typographical errors in the minutes of the October 24 , 1979 meeting. Mr. LaLond made a motion to approve the minutes of the October 24 , 1979 meeting with the corrected changes . Mr . Last seconded the motion. The minutes were unanimously approved . I . Appeal of Donald W. Bowen , owner of the property located at 403 West 15th Avenue , proposes to convert an existing nouse to a two-family residence . The existing house is 3 ` U" from the side property line , whereas a 7 1/2 ' side yard setback is required . Mr. Reimer- explained that the property in question is located on the soutwest corner of 15th Avenue and Iowa Street . He stated the appellant proposes to convert an existing house into a two ' family residence . The existing house is 3 ' 0" from the west � property line, whereas the Zoning Ordinance req_uires a 7 1/2 ' � side yard setback. Mr. Bowen stated he purchased the house in 1949 and has used it as a single family residence since that time. The house is 2-story and has five (5 ) bedrooms Cthree on the upper level ? . Mr. Bowen stated the house is much too large for two people and wishes to convert it to two-family so the upper �evel can be rented for additional income . He p,^efers to continue living in the house because his wife is blind and she has become very ' familiar with the house . Norman Miiler asked what arrangements have been made for parking . : Mr. Bowen stated there is a two car garage in the rear of the lot and there is also a cement platform which two additional cars ' can park on. . � Board of Zoning Appeals Minutes November 7 , 1979 Meeting Page Two � Roland Mi�ller stated he received a communication from three surrounding neighbors stating they do not objec� to Mr. Bowen ` . converting his house into a two-family residence . . Mr. LaLond m�de a motion to approve the appeal. Mr. Last seconded the motion. Motion carried , 4-0. II, Appeal of Douglas Bresser , owner of the prqperty at 316 Shorelane Street , proposes to construct a rear addition to his house on the above property that would be located 4 ' from the north property line , whereas a 7 1/2 ' side yard setback is rec�uired. It was noted that this �tem has been laid over twice in order that Mr. Bresser could appear before the Board to answ�r any questions members may have. At the last meeting Roland Miller was instructed to send a letter to Mr. Bresser asking for his a-�tendance at the next meeting. Roland Miller stated he sent a letter to Mr. Bresser on November 1 , 1979 which stated it is the responsibility of the appellant to be p�esent , or have a representative present , at : the meeting in order to answer questions . Mr. Miller felt that since Mr. Bresser was not in attendance , perhap� he is no longer interested in obtaining a variance. Mr. LaLond made a motion to deMy the appeal . Mr. Last seconded the motion. The appeal was denied , 4-0 . III. DISCUSSION - The Board will di.scuss an amendment � to the Bqard of Zoni;�g Appeals operating rules � and procedures . Roland P•liller distributed a list of proposed amendment to the procedures and regulations of the City of Oshkosh Board of Zoning Appeals. The amendments incorporated the suggestions made by Norman Miller at the last Board of Zoning Appeals meeting. The following statement was proposed to be inserted under� Article IV - APPEALS AND APPLICATIONS : No construction shall be started o� continued after an appellant has been informed of' the zoning violation nor before a hearing on the variance has b�en held before the Board of Zoning Appeals . . The following amendment was also proposed to be inserted under Section VIII - DECISION (5) Follow-up on any violation shall be made by the Chief Inspector, or his designee , and then submitted to the City Attorney for prosecution. Both the property owner and the contractor shall be held responsible for the violation. ! Board of Zoning Appeals Minutes November 7 , 1979 Meeting Page Three ! Baard members agreed that contractors should be aware of any � and all permits that are necessary for the construction of a • building. They should, in turn , inform the public of any permits that should be obtained. It was suggested that a letter be distributed to all contractors informing them they will be neld responsible , along with the property owner, for the violation. Mr. LaLond made a motion to approve the amendments to the procedures and regulations of the City of Oshkqsh Board of Zoning Appeals . Norman Miller seconded the motion. Motion carried , 4-0 .
