BOARD OF ZONING APPEALS MINUTES
WEDNESDAY, APRIL 4 , 1979

Mel Carpenter callea the meeting to order and the roll call was
taken. There was a quorum of five members present.
Mr. Last made a motion to approve the minutes of the meeting of
March 7 , 1979 . Mr. Miller seeonded the motion. The minutes
were approved.
I. Appeal by Nancy and Robert Hartman, owners of the property
located at 217 W. 15th Avenue, propose to convert an
existing single family residence to a two-family residence.
The house has an existing side yard setback of 6 ' , whereas
a 10 ' side yard setback is required. The lot is a
total af 7500 sq. ft. in area, whereas the lot is
required to be a total of 7520 sq. ft. in area.
Mr. Reimer s�tated that this property is located in a C-3
Commercial Zone. This C-3 Zone requires that they provide
3600 sq. ft of lot area per unit , glus 160 sq. ft. per bedroom.
This would be a total of 7520 sq. ft , whe�eas the existing lot
is only 7500 sq. ft. in area. :
Mr. Hartman �tated that there is no market for a six bedroom
home for single family use. They would like to make it a
two-fama.ly home, with two bedrooms upstairs and four bedrooms
downstairs .
Mr. No�man Miller asked how they would provide parking.
Mr. Hartman stated that they would widen the driveway to 16 1/2
feet so that two cars could be parked side by side.
� Roland Miller s�ated that he received a phone call from a
neighbor, Mrs. Isner. She was in favor of the Hartmans converting
this home, and she felt many of the neighbors she had spoken with
were also in favor of this .
Mr. Hartman stated that by taking out part of the stairwell and
making it the bath, they would not have to alter the outside of
the building.

Mr. Last made a motion to approve this appeal.
Norman Miller seconded the motion. Motion carried 5-0 ,
II. Appeal by Arlin W. Krause , owner of the property located
at 525 West Murdock Avenue , proposes to construct a 24 '
X 24 ' accessory building, which constitutes the second
accessory building on this parcel . The ordinance provides
that only one accessory building be allowed. ;
Roland Miller explained that Lots 13 and 14 have been used as
one lot for quite some time , and the owner has expressed a
desire to have these lots be considered as one lot .
Mr. Krause stated that he has a three car garage located on
another piece of property in the City. This garage is used
for storage of things from his residence. Now the City is
planning on extending Fernau Avenue , and this will necessitate
the removal of this garage. Since he will not have enough
room to store this material on his �esidence property, he
would l�ke to build another accessory building on this property.
This would make the second accessory building in his lot , since
he already has a small 4 ' X 8 ' shed.
Mr. Fischer asked why he could not just incorporate the existing
shet into the proposed 24 ' X 24 ' building.
Mr. Krause said that the she�.1. has a hip roof, and this would not
work into his new building.
Mr. Last asked if the proposed building would have overhead garage
doors and would the driveway go out to Murdock Avenue.
Mr, Krause said , "yes. "
Norman Miller asked if he would consider removing the smaller '
shed, if the Board approved this appeal.
Mr. Krause said that it has a plank floor and is quite heavy. ;
If it were n:oved , it would fall apart .
Mike Sammons , owner of the property at 522 W. Murdock, stated
that he is required by the Oshkosh Zoning Ordinance to put up
a fence to screen his commercial property from the adjoining
residential properties . He feels that because he must comply
with the Zoning Ordinance , Mr. Krause should also have to comply
with the Ordinances that apply to his property. Therefore, he
is opposed to the granting of this variance.
