PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the City
hereby accepts right-of-way for Elk Ridge Drive from West Waukau Avenue to Ruffed
Grouse Way, per the attached, and with the following conditions:
1) Developer shall comply with approved developer’s agreement to finish
construction of Elk Ridge Drive.
2) Developer shall renew letter of credit with the City for construction of Elk Ridge
Drive.

BACKGROUND
The subject site is part of the Hunters Ridge Development, a mix of multifamily apartments
and condominiums. Since 2007 the developer has built ten apartment buildings containing a
total of 78 dwelling units located on the northern half of the subject property and plans to
further develop the south half with six additional buildings adding approximately 48 more
dwelling units. Elk Ridge Drive was reserved for future right -of -way on previously recorded
certified survey maps but to date has not been formally dedicated. The area surrounding the
subject site includes the Universal Business Park to the north, condominium developments to
the east, vacant/undeveloped lands to the south and a single - family subdivision to the west.
ANALYSIS
The dedication of Elk Ridge Drive is proposed to be a 60 -foot wide right -of -way extending
from W. Waukau Avenue south 1,740 feet to Ruffed Grouse Way and meets the
requirements in the Subdivision Regulations for a local classed street. In 2008, the north
1,100 feet of Elk Ridge Drive was paved in accordance with a developer's agreement
between the City and developer and the Department of Public Works is requesting that the
developer complete the southern portion as required as well as a letter of credit to the City be
renewed or extended to ensure the paving of Elk Ridge Drive is completed. The Department
of Public Works and Transit Department have reviewed the dedication and have expressed
no concerns with the designed layout.
FISCAL IMPACT
None anticipated.
The Plan Commission approved of the request at its May 19, 2015 meeting.

GENERAL INFORMATION
Applicant: Carow Land Surveying Co., Inc.
Owners: Briarwood of Hunters Ridge, LLC
Actions Requested:
The applicant is requesting a three -lot land division from one existing parcel containing a total of
19.7468 acres. The petitioner is also requesting the right -of -way dedication of Elk Ridge Drive
located east of the proposed land division. Sizes of the proposed lots are as follows:
Lot 1 = 8.2355 Acres
Lot 2 = 4.9399 Acres
Lot 3 = 4.1852 Acres
Right -of -Way = 2.3862 Acres
Applicable Ordinance Provisions:
Land division criteria are found in Section 30- 71(M)(5) of the City's Subdivision Regulations
Property Location and Background Information:

ANALYSIS
A: Land Division:
The petitioner is proposing to divide the subject site into three parcels, each containing either
existing or fiture apartment developments interconnected by a series of private drives.
Proposed Lot 1, the northernmost as well as the largest is proposed to be 8.2355 acres in size. The
parcel is irregularly - shaped with several "steps" and angles for a boundary. The site is considered
completely developed containing five eight -unit and two six -unit apartments, a recreational
building and associated off - street parking facilities and dumpster enclosures.
Proposed Lot 2, located immediately south of Lot t is proposed to be 4.9399 acres and is more or
less rectangular in shape. The proposed parcel currently contains three completed 8 -unit buildings
with space for an additional three eight -unit buildings. The site also has a series of private drives
connecting to Lot t development to the north and Lot 3 to the south, as well as two driveway
connections to Elk Ridge Drive.
Proposed Lot 3, the southernmost parcel located at the northeast corner of Elk Ridge Drive and
Ruffed Grouse Way is proposed to be 4,1852 acres and is currently undeveloped. The submitted
CSM does show three proposed apartment buildings (1 six -unit and two eight -unit) with a private
drive heading north onto Lot 2 and one driveway leading to Elk Ridge Drive.
The proposed lot configuration meets the requirements of the subdivision regulations and staff
does not have concerns with the parcel layout. Staff obtained a digital CAD drawing of the CSM
to verify that the existing and proposed apartment buildings meet the 10 -foot side yard setbacks
required in the R -3 District. Staff also reviewed the impact of unit density based on the proposed
land division, Lot 1 will have a density of 6,899 square feet per unit, Lot 2 will have 4,483 square
feet per unit and Lot 3 will have 8,286 square feet per unit, all exceeding the 3,000 square foot per
unit requirement in the R -3 District.

During review, staff noted that the zero-foot setbacks for the off-street parking facilities that will
be created by the land division is permitted, provided that cross-access easements be approved by
the City Attorney and recorded at the Winnebago County Register of Deeds. (30-36(A)(2)(b)(ii),
City of Oshkosh Zoning Ordinance). This concern was conveyed to the petitioner and appropriate
easement documents have been recorded.
B: Street Dedication:
The dedication of Elk Ridge Drive is proposed to be a 60-foot wide right-of-way extending from.
W. Waukau Avenue south approximately 1,740 feet to Ruffed Grouse Way. The 60-foot width
meets the requirements outlined in the Subdivision Regulations for a local classed street.
In 2008, the north 1,100 feet of Elk Ridge Drive was paved in accordance with a. developer's
agreement between the City and developer. The Department of Public Works is requesting that the
developer complete the southern portion as required by the developer's agreement and also
requests that the letter of credit to the City be renewed or extended to ensure the paving of Elk

proposed.
