Roskom, Principal Planner; Diane Witzke, Recording Secretary Chairperson McGee called the meeting to order at 3 :38 PM. Roll call was taken and a quorum declared present. e minutes of May 17, 1989 were approved as distributed. I. 45 W. 14TH AVENUE - Gene and Denise Bohlman The applicants are requesting a variance for a deck with a 3 '4" side yard setback which is attached to the house; whereas Section 30-16 (B) (1) (b) of the City of Oshkosh Zoning Ordinance requires a 7 1/2 ' . minimum side yard setback. In answering questions from the Board, Ms. Bohlman explained the following: They bought this house in September last year and expected it to be Code compliant. They did not create this problem and do not know how long the deck has been there. The pool is about 15' from the house and the deck is attached to the house. Motion by Slover to approve a variance for a deck with a 3 '4" side yard setback with the condition that no portion of the deck extends more than 36" above the surface of the deck. Seconded by Hintz. Motion carried 5-0. Regarding the findings of fact, Ms. Hintz stated the situation was not self-created. The infringement could be remedied by removing the deck from the house but that would not change the effect of the deck on the area. There is little negative impact. II. KERSZTYN PROPERTY LOCATED ALONG HWY 45 - Ruth Kersztyn, : owner, Tom S epec , agen The applicant is requesting a variance to construct berms and/or fencing with a maximum heic�ht of 10' within the rec�uired 25' front yard setback; whereas Section 30-29 (E) (1) of the City of Oshkosh Zoning Ordinance states that fences and hedges less than 4 ' high may be constructed within the required front yard setback. In answering questions from the Board, Mr. Shepeck explained the following: They are trying to develop a residential subdivision which the property is zoned for. They are trying to develop an atmosphere that is more desirable on both sides of the hic�hway. A berm is a sound barrier and also a safety barrier for children. The supperclub is very supportive of this request and would like to help landscape the area along their property. They prefer to use berms over fences but they might need to use fencing near the supperclub because there is a lack of space to develop the lots. The fencing in that area may be 3 or 4 ' high and placed on top of a lower berm to save that sp�ce. A smaller berm would take up less space.
