A GENERAL ORDINANCE OF THE CITY OF OSHROSH REPEALING AND AHCREATINC
SECTION 18-48 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO SPEED
LIMITS FOR BOATS
The Common Council of the City of Oshkosh do ortlain as follows :
SECTION 1 . That Section 18-48 of the Oshkosh Municipal Code
pertaining to Speed Limits is repealed antl recreated to read as
follows :
SECTION 18-48 SPEED LIMITS FOR MOTOPBOATS
(A) No person shall drive or operate a motorboat at a speed
in excess of slow-no-wake speed on the folloWing wateruays :
( 1) Fox Aiver, under or through the Chicago & Northwes-
tern Aailroad Bridge, under or through the Mai❑ Street
bridge, Detween the Main Street bridge and the Oregon
Street Bridge , under or through the Wisconsi❑ Central Rallroad
bridge, under or through the Oregon Street Sridge, under
or through the Wisconsin Street bridge , under or through
the Oshkosh/Congress Avenue bridge from a point 1200 ft.
, south downstream to a point 1900 feet north/upstream of
� said bridge. The slow/no wake zone downstream and up-
'� stream from the Oshkosh/Congress Avenue Britlge shall be
- valid for Fridays at 12:00 midnight thru Sunday 12:00
; i mid�ight and legal holidays only.
. (2) Miller's Hay , the Special Anchorage Area, approved by
the U.S. Coast Cuard antl Army Corp. of Engineers located
at Latitude N44°O1'36" and Longitude N88°31'5", con-
sisting of an area 300 feet by 500 feet in size .
(8) No perso❑ shall drive or operate a motorboat in Miller's
Bay in excess of itlling speed for the particular craft
except in the case of an emergency or unless prior
approval has been granted by the Common Council .
SECTION 2. The proper City officials are authorized to place, or to
cause to be placed , the appropriate navigational aides and buoys to mark
the locations of the speed limit restrictions of this Section.

Boating Ordinance Review
The attached ordinance (our number 33) is consistent with Chapter
30 of the Wisconsin Statutes and Department rules adopted to
implement those sections.
Section 18-48 (B) seems redundant and uses a different speed "idling
speed" than that used in Section 18-48 (A) which uses "slow-no-
wake" .
The Department of Natural Resources has been directed by Section
30.77 (3) of the Wisconsin Statutes to provide advisory review of
local regulations pertaining to the equipment, use or operation
of boats on inland lakes and to determine whether those
regulations are consistent or inconsistent with ss. 30. 60 to
30.71 of the Wisconsin Statutes as to public health, safety or
welfare.
