INITIATED BY: DEPARTMENT OF PUBLIC WORKS BE IT RESOLVED by the Common Council of the City of Oshkosh that the attathed Developer Agreements for Graceland Subdivision, Luebke Plat and First Addition to Shadow Creek are approved and the proper City officials are authorized and directed to execute the agreements. SUBE4ITTED BY APPROVED ��i���/,rW'/L�" � � - 29 - Res. #185 DEVELOPER 'S AGREEMENT FOR FINANCING IMPAOVEMENTS THIS AGAEEMENT is made pursuant to Section 66.60( 18) of the Wisconsi❑ Statutes providing for levying and assessing the cost of varlous improvements to the property hereln described . WHEFlEAS, the Common Council of the City of Oshkosh approved initial and final resolutions pursuant to Section 66.60 of the Wisconsin Statutes upo❑ execution and approval of a waiver, executed Dy the undersigned � owner of property herein described , of special assessment notices and hearing ; and WHEAEAS, the undersigned owner has heretofore agreed , in consideratlon of installation of various improvements , to pay the full cost of such improvements and related costs through special assessment Finaneing pursuant to Section 25-83 and 25-89 of the Oshkosh Municipal Code upon certification by the City Engineer for the City of Oshkosh that said Smprovements have been completed ; and WHEREAS, the Common Council of the City of Oshkosh by resolution adopted July 21 � 1988 authorized and directed the proper City officials to enter into an approprlate agreement with the undersigned oWner to provide for full payment by the undersigned owner of said improvements and related costs; NON� THEREFOPE� IT IS HEAEBY AGAEED to by and between Lhe City of Oshkosh, a municipal corporation located in Ninnebago County, Wisconsin (^CITY") antl Ronald C. Leichtfuss ("OWNER") , in reliance on the representation and covenants made herein, as follows: 1 . Owner covenants antl warrants that it is the owner of all property described as follows : GRACELAND PLAT ('/i Lots) 2. Owner has requested installation by City of various improvements to sald property described as follows : Sanitary Sewer Water Main Laterals Grading & Graveling Concrete Paving Storm Sewer Concrete Sidewalk Engineering Services 3. City� or its designee , shall cause such improvements to be installed according to the plans a�d specifications of the City Engineer . 4. Special assessments may be paid by Owner in cash, or in installments pursuant to Section 25-83 and 25-89 of the Oshkosh 1 - 29a - REVISED Res. if185 Municipal Code in which case such deferred payments are to bear interest at the rate of ten percent ( 10$J per annum on the unpaid balance . 5. The attached exhibit(s) , acknowledged by City and Owner as . being true antl correct, are incorporated Dy reference as if fully stated herein . EXHIBIT "A" - Utility Cost for Subdivision Agreement 6. Owner� immediately upon voluntary divestiture of title to any of the property heretofore described � shall fully pay the outstanding assessments against the particular parcel sub�ect to divestiture. Divestiture shall mean the transfer of legal title providing owner does not retaln any 11en or mortgage interest in such parcel . In the event owner retains a lien or mortgage interest in such parcel , the assessments shall be paid in full within one ( 1) year froo the date of sale. In the event owner sells by land contract , the assessments shall be paid in full within one � 1) year from the date of the land contract. 7 . Notwithstanding the foregoing , in consideration of the City's pendi�g interceptor sewer praject through this subdivision, payments inc�uding interest on the following lots shall be deferred for a two-year period from date of certification of special assessments or until voluntary divestiture of title , whichever occurs earlier: Lots 26 thru 41 , 52 thru 56 and 61 thru 71 8. Any refund which may be due Ow�er as a result of any special assessment being in exeess of the actual amount paid by City for said improvements is assignable by Owner . 9. This Agreement and its attachments , may be recorded at City's option and if so done � shall serve as Notice of Lien against such properties . Owner, immediately upon voluntary divestiture of title to any of the property heretofore descriDed , shall fully pay the outstanding assessments against the particular parcel subject to divestiture. Divestiture shall mean the transfer of legal title providing owner does not retain any lien or mortgage interest in such parcel . In the event owner retains a lie� or mortgage interest in such parcel , the assessments shall be paitl in full vithin one ( 1) year from the date of sale.
