NUISANCE ANIMAL TRAPPING FOR THE CITY OF OSHKOSH STORM WATER
UTILITY
THIS AGREEMENT, made on the 1ST DAY OF MAY 2015, by and between the CITY OF
OSHKOSH, party of the first part, hereinafter referred to as CITY, and SUBURBAN
WILDLIFE SOLUTIONS LLC, N1940 CTY RD CC, KAUKAUNA WI 54130 hereinafter
referred to as the CONTRACTOR,
WITNESSETH:
That the City and the Contractor,for the consideration hereinafter named, enter into
the following Agreement. The CITY'S Bid Specifications and Insurance requirements are
attached hereto and incorporated into this Agreement. The Contractor's proposal is also
attached hereto and reflects the agreement of the parties except where it conflids with the
CITY'S terms within this agreement, in which case the CITY'S Bid Specifcations,
Insurance requirements, and other terms of this agreement shall prevail.
ARTICLE I. PROJECT MANAGER
A. Assignment of Project Manager. The Contractor shall assign the following
individual to manage the project described in this contract:

B. Changes in Project Manager. The City shall have the right to approve or
disapprove of any proposed change from the individual named above as Project
Manager. The City shall be provided with a resume or other information for any
proposed substitute and shall be given the opportunity to interview that person prior to
any proposed change.
ARTICLE II. CITY REPRESENTATIVE
The City shall assign the following individual to manage the project described in this
contract:

ARTICLE III. SCOPE OF WORK
The Contractor shall provide services described in the CITY'S Specifications dated
APRIL 8, 2015, referred to as the "Invitation for Quotation" for STORM WATER
MANAGEMENT FACILITY NUISANCE ANIMAL TRAPPING FOR THE CITY OF
OSHKOSH STORM WATER UTILITY (THIS ATTACHED AS EXHIBIT A)

and the Contractor's quotation proposal form dated APRIL 23. 2075. The Contractors bid
form is attached hereto as Exhibit B. If anything in the Contractor's proposal conflicts with
the CITY'S Bid Specifications or with this agreement,the CITY'S Bid Specifications and the
provisions in this agreement shall govern.
The Contractor may provide additional products and/or services if such
products/services are requested in writing by the Authorized Representative of the
City.
ARTICLE IV. CITY RESPONSIBLITIES
The City shall furnish, at the Contractor's request, such information as is needed
by the Contrector to aid in the progress of the projeci, providing it is reasonably
obtainable from City records.
To prevent any unreasonable delay in the Contractor's work the City will
examine all reports and other documents and will make any authorizations necessary
to proceed with work within a reasonable time period.
ARTICLE V. TIME OF COMPLETION
The work to be performed under this contract shall be completed in the 2015
CALENDAR YEAR.
ARTICLE VI. PAYMENT
A. The Contract Sum.
The City shall pay to the Contractor for the performance of the contract the sum of
S24 577 00 (Twenty four thousand Five hundred Seventv seven dollars and 00/700
adjusted by any changes hereafter mutually agreed upon in writing by the parties
hereto.
Fee schedules shall be firm for the duration of this Agreement.
B. Method of Payment. The Contractor shall submit itemized monthly
statements for services. The City shall pay the Contractor within 30 calendar days
after receipt of such statement. If any statement amount is disputed, the City may
withhold payment of such amount and shall provide to Contractor a statement as to
the reason�s) for withholding payment.
C. Additional Costs. Costs for additional services to be negotiated and set
forth in a written amendment to this agreement executed by both parties prior to
proceeding with the work covered under the subject amendment.

ARTICLE VII. CONTRACTOR TO HOLD CITY HARMLESS
The Contractor covenants and agrees to protect and hold the City of Oshkosh
harmless against all actions, claims and demands of any kind or character whatsoever
which may in any way be caused by or result from the intentional or negligent acts of
the Contractor, his agents or assigns, his employees or his subcontractors related
however remotely to the performance of this Contract or be caused or result from any
violation of any law or administrative regulation, and shall indemnify or refund to the
City all sums including court costs, attorney fees and punitive damages which the City
may be obliged or adjudged to pay on any such claims or demands within thirty (30)
days of the date of the City's written demand for indemnification or refund.
ARTICLE VIII. INSURANCE
The Contractor shall provide insurance forthis project that includes the City of Oshkosh as
an additional insured. The specific coverage required for this project is identified in the
CITY'S Specifications dated APRIL 8. 2015, referred to as the"Invitation for Quotation"for
STORM WATER MANAGEMENT FACILITY NUISANCE ANIMAL TRAPPING FOR THE
CiTV OF OSHKOSH STORM WATER UTILITY dated APRIL 8. 2015, which is fully
incorporated into this Agreement. If applicable, the Contractor is responsible for meeting
all insurance requirements. The CITY does not waive this requirement due to its inaction
or delayed action in the event that the Contractor's actual insurance coverage varies from
the Insurance required.
ARTICLE IX. TERMINATION
A. For Cause.
If the Contractor shall fail to fulfill in timely and proper manner any of the obligations
under this Agreement, the City shall have the right to terminate this Agreement by
written notice to the Contractor. In this event, the Contractor shall be entitled to
compensation for any satisfactory, usable work completed.
B. For Convenience.
The City may terminate this contract at any time by giving written notice to the
Contractor no later than 10 calendar days before the termination date. If the City
terminates under this paragraph, then the Contractor shall be entitled to compensation
for any satisfactory work performed to the date of termination.
This document and any specified attachments contain all terms and conditions
of the Agreement and any alteration thereto shall be invalid unless made in writing,
signed by both parties and incorporated as an amendment to this Agreement.

PROJECTBACKGROUND
City of Oshkosh Storm Water UtiliTy is requesting bids &om interested persons/fums for the
napping o£nuisance animals a[several stoim water detention basins.
The Ciry of OsLkosh understands that managing nuisance animals within the
municipally-owned stoan water management facilities is pazamount [o ensuring the continued
proper operation of the facilities. Nuisance animals, such as muskrats, cause damage to the side
slopes of detention basins and drainage ways and destroy the emergent vegetation planted
within [he facilities. Maintaining the emetgent vegeta[ion is vital in pmtecting the shoreline
&om erosion, as well as removing nuhien[s from stoxm water runoff.
State of Wisconsin Administra[ive Code Section NR72.10 allows landowners, ocwpants,
and/or agen[s to remove nuisance animals &om their property. Administrative Code Sec[ion
NR1210(3)(c) requires that the pecson perfoiming removal to have a valid hunting or happiug
license. The State of Wisconsin does NOT allow trapped muskrats to be released on[o state
lands. Witt� peanission, the animals may be relocated to pdvate land elsewhere, o[herwise
[he animals shall be dispatched. Section 6-10 of the Municipal Code of the City of Oshkosh
prohibits "Any unGcensed traq snare, spring gun, set gun, net or other device or contmance
which might entrap, ensnare, or kill games, or any trap without a metal tag attached as required
by Section 29.03(5) Sta[e of Wisconsin Statutes, except for ]ive traps.° Secfion 17-3 [hrough
17-6 of the Municipal Code of the City of Oslilcosh covers the use and discharge
prohibitions of weapons wi[hin[he CiTy of Oshkosh.
The goal of Uus ConVact is to reduce or elimina[e [he nuisance animal populalion at the
detention basins listed below. The work covered by this proposal shall include the
fumishing of all materials, equipment, and labor to install, maintain, and remove [raps in the
de[ention basins. The CONTRACTOR shal] inspect the [raps at a sufficient interval to
ensure trapping ability, and remove all [rapped animals and dispose of offsite. The
trapped animals shall become the sole property and responsibiliTy of the CONTRACTOR. -

METHOD OF AWARD
Award shal] be made on t6e basis of the criteria below. Awazd is anticipated to be made
as soon as possible following review of bid documen[s. Bidders will be notified indicating
award of the conhact. In determining [he successful bidder, evaluation will be based on the
following criteria:
1. Responsibility/Qualifica[ions: Bidders shall provide proof of a valid hun[ing or
[rapping license wi[h their response to[his IFB.
2. Responsiveness: bids and other required submittals shall be reviewed on fulfillment of
requirements established in this IFB.
3. Cost: bids shal]be reviewed ou competitiveness of cost.
INSURANCE
Attached are insurance requirements for the City of Oshkosh. Contractor shall not
wmmence work under this agreement until it has obtained all insurance requiremenu. Bidders
do NOT need ro submit a certificate of insurance when submitting their quote.
CONTRACTOR QUALIFICATIONS
Contrac[ors are required [o have a valid hunting or happing license in order to perfoxm the
services requested in this IFB.
SAMPLECONTRACTORAGREEMENT
Attached is a sample contractor agreement that will be drawn up with the successfu] bidder.
Bidders do NOT need to submit tlus agreemen[when submitting their quote form.
SCOPE OF SERVICES
Seasonal Trapping Services
A) LocaUOns: The CONTRACTOR shal]install,maintain,and remove traps in the spring
season and again in[he fall season a[the following detention basins:
➢ Fair Acres De[ention Basin, loca[ed in front of Pick-N-Save Nor[h,near the
intersection of Mucdock Avenue(STH 21) and Jackson Street(STH 76).
➢ Oshkosh North High Schoo]Area Detention Basin,locatedjust northwest of Oshkosh
Nor[h High School(I100 Wes[Smi[h Avenue). Access[o[he detention basin shall be
from Morgan Avenue,east ro the gravel driveway along the west edge of the detention
basin. There is a gravel pazking lot neaz the northwest comer ofthe detention basin.
Do not access tkuough the North High School pazking lot.
➢ Westhaven Clubhouse Area Deten[ion Basin,locatedjust south of the Westhaven Golf
Course Clubhouse(1400 South Westhaven Drive). There is on-street parking located on
Westhaven Circle. Do not park in the Golf Course Clubhouse pazking lot.
➢ NoRhwest Industdal Park Detention Basin,located on Femau Avenue,just west of
Vinland Street. There is on-saeet pazking on Femau Avenue.
➢ SouthwestIndustdalPazkDetention Basins(East,Middle,and West),located along
AUas Avenue,just north of STH 91 and west of Oakwood Road. There is on-sheet
pazking available on Atlas Ave�ue and Global Parkway.
➢ � South Oakwood Road Detention Basin,located along South Oakwood Road,
approximately one half(1/2)mile south of Wes[20'"Avenue. There is a grass access
drive along the northem side of[he detention basin ttia[can be utilized for access to[he
site. There is no wrb opening to access[he grass access drive.
➢ Armory Area De[ention Basin, located at I615 Crystal Springs Avenue. Access to the
site can be gained from the vacan[City owned parcel at 1615 Crystal Springs Avenue, or
offthe east end of Menacd Drive(east of South Koeller Street).
B) Scone of Services: The CONTRACTOR shall provide[he following scope of services for
the Seasonal Trapping Services:
1. Mee[with City Project Manager prior to[rap installation to verify location and
discuss number of traps to be installed.
2. Install traps and mazk location with lath. All traps mus[be marked with a]ath, so that the
Ciry of Oshkosh can observe the locations CONTRACTORmay phase happing,but
shall install traps at each site during each season.
3. Notify CiTy Pmject Manager at least three(3)working days prior to setting traps a[
Oshkosh North High School Area Detention Basin. City Project Manager must notify
appropriate OslilcosL Area School district staff prior to trapping at[his location.
4. Notify Ciry Project Manager within tivee(3)working days after setting traps of the
number of haps set at each site. The City will not pay for traps or trapped muskrats at
a site if[he CONTRACTOR fails to properly notify the CiTy Project Manager.
5. Inspect traps in compliance with Wisconsin Department of Natural Resources
regulalions.
6. PrompNy remove and dispose of all trapped animals offsite when traps are
inspected.
7. Remove traps from detention basins afrer each season of trapping,as
deteanined by the City Project Manager aud CONTRACTOR. �
8. Submit invoices no more frequently Ihan monthly during each[rapping season,detailing
the number of traps set, and how many muskrats have been trapped at each site.
9. The CiTy Project Manager may schedule a second site meeting in the fall of 2014,if
necessary. CONTRACTOR to provide a minunum of one(1)week notice prior to
setting[raps in the spdng so the City Project Manager can detennine if a site meeting is
necessary.
Dam Inspection Services
A) Locations: The CONTRACTOR shall conduct monthty"Dam Inspections"at the
following detention basins:
➢ Aimory Area De[ention Basin, located at 1615 Crystal Springs Avenue. Access to the
site can be gained from the vacant City owned pazcel at 1615 Crystal Springs Avenue,or
oFf the east end of Menard Drive(east of South Koellei Street).
➢ 7aznes Road Area Detention Basin,loca[edjust north of 4812 State Road 91. There is a
gravel access drive locatedjust east of 4812 State Road 91 that goes north,and then tums I
east to the gated access enhance to the James Road Area Detention Basin. There is a
grnvel pazking lotjust inside the gate.
B) Scone of Services: The CONTRACTOR shall provide the following scope of services for .
the Dam Inspection Services: I
1. Meet with City Project Manager prior to starting the Dam Inspection Services in the
spang to discuss the project requirements. This meeting may occur as a part of the
meeting required for the seasonal trapping services.
2. Monthly"Dam Inspec[ions"shall occur from Apri]through October,inclusive.
3. Notify City Project Manager at least three(3)days prior[o conducting
inspections.
4. The James Road Area Detentiou Basin site is locked. The CiTy Project Manager has a
key that will be provided for access. The key aLall be picked up no more than one(I)
day in advance of any inspections,and reNrned within one (1)day of completing
inspections or colony removal (if necessazy).
5. Perform montlily inspection oF"Dam Inspec[ion Areas°at the above noted detention
basins to determine if burrowing animals aze present within the"Dam Inspection Area°.
The monthly inspection shall include BOTH sides of the embankment,as burzowing
animals entedng from ei[her side pose a serious risk to the embanktnent. Provide a
summary email of each inspec[ion within[wo(2) days of[he inspection. This summary
shall include whether or no[buirowing animals were presen[,and if so,how many
colonies were present. Some examples oFburrowing animals[ha[could be encountered
include: woodchucks/groundLogs,skunks,muskrats and fox. T7us list is not all
inclusive, and o[her buirowing animals could be encountered.
6. If the burrowing animals are found to be present within the"Dam Inspection Areas",
immediately commence colony removal happing. Trapping shall continue un41 each
colony is removed. All[raps set as a part of colony shall be marked with a lath.
7. Inspect traps in compliance with Wisconsin Department of Natural Resources
regulations.
8. Promptly remove and dispose of all[rapped animals offsite when traps aze
inspecred.
9. Backfill all colony burtows with soil immediately upon completion of colony
Vapping.
