We have a new hotel and Convention Centra, a restored Grand Opera Houae, streetscaping on the 400 Block, and a number of buildings with rehabilitated facadea. Projects currently in the early stages of development include the east side oP the 10o Block of N. Main Street and the new municipal bus transfer center on the corner oP Pearl and Market Straets. Realizing that it takea mora than just physical improvements to maintain an active and ecnomically viable downtown, business people and property owners petitioned the City to create the Downtown Oshkosh Businesa Improvement District (BID) . Established by the Common Council in November, 1987, the BID�s goals were to implement free parking, increase promotion and marketing, and enhance business recruitment efforts. Under the diraction aP the HID Board, movement towards the achiavement of these qoals was undartaken. Free parking was implemented throuqh an aqreement with the City Parkinq Utility. An attractive downtown business Directory was devaloped to be used as a marketing piece for both local and out of town customers and clients, and the HID contributed to the oshkosh Commarcial Developmant Corporation's (OCDC's) tele-marketing campaign for business recruitment. While it is diEficult to judqe the overall success of the BID after only one year, there are indfcations of a positive trend. OCDC conducted a telephone survey in September, 1988 asking merchants to indicate the percent oP change in sales, comparing the Pirst aix months of 1988 to tha pirst six months of 1967, p majority of the responses indicated ihere is (on the average) a 7.58 increase in sales. Merchants reporting no increase or decrease attributed it to a very qood previous year, a soft retail market, or increased competition. The merchants noting increases attributed it to increased cuatomer trafEic, proper promotions, free parking and/or a more attractive shopping district. Another indicator oP what is happening in the BID is the assessed value of the properties in the BID. Overall, the assessed valua of the HID decreased during 1988. However, the decrease was due to the property with the largest assessed value taking a significant reduction in 1988. If the assessed value of that property had not changed, the BID would have shown a net qain in assessed value of $234,000 in 1988. Zn order to maintain what is seen as positive improvementa in the downtown, the SID Board has prepared this 1989 Operating Plan for submittal to the Oshkosh Common Council. - 22c - � . Res. #353 2 T8E BID LAW On April 6, 1984, the State oP Wisconsin passed a law (ACt 184) which allows for the creation of Business Improvement Districts. The purposa oP the law is to authorize cities, villages, and towns to create one or more businesa improvement districts to allow businesses within those districts to deve o , manaae, maintain, and promote their districts and to establish an assessment method to fund these activities. A BID must ba a geographic area within a municipality consisting of contiguous parcels which are subject to real estate taxes. The formation of a business improvement district allows downtowners (business people, property owners, merchants, City officials and others) , to Pigure out what needs to be done to upqrada and atrengthen downtown and to pay the cost of doinq it, in whole or in part. It is a way for downtowners to decide what they want and to finance it. A BID is the best available method for business people to organize, coordinate marketing and promotion ePforts, provide management and maintenance programs, and ancourage business development. It affords property owners and business people a very real role in directing those affairs within the district which influence their investment and environment. ORGANIZATION Pursuant to Section 66.08 (3) , Wis. Stats. , a Downtown Business Improvemant District Board has baen appointed by the City Manager and confirmed by tha Common Council. The Board is comprised oP 9 members representing the following interests: 2 Non-Owner Occupants: --1 retailer --1 service provider 2 Non-OCCUpant Owners: --1 retailer --1 servica provider 4 Owner Occupants: --2 ratailers --2 aervice providers 1 Peraon-At-Large In addition, Board members represent dif£erent areas within tha District, as well as large and small businesses. As a City entity, the Board will conduct its affairs under the open meeting law and public record raquirements. The Director of Community Development or his designee serves as the Secretary of the Board. BZD Board meetings are held the third Tuesday of the month in Room 204 of City Hall. A roster of the 1989 BID Hoard members is included as Appendix D. Tha Board will be responsible for the management of the Business Improvement District. Responsibilities of the Board include implementing the operating plan and preparing annual reports on tha District. The Board will also annually consider and make changes to the operating plan and submit the operating plan to the Common Council for approval. City sta£Y will be assisted by the Oshkosh Commercial Development Corporation (OCDC) in the development and implementation of BID program activities. II. OPERATIONS During 1989, the Downtown Oshkosh Husiness Improvement District will carry out the proposed program of activities listed on the following pagas. Included are tha expenditures associated with each activity. These projected costs include all services related to program davelopment, materials and management. - 22f - Res #353 5 PROPOSED 1989 BID PROGRAM/BIIDGET DOWNTOWN OSBROSH PROGRAM ACTIVITIEB EBPENDITORE3 I. Free Short Term Parking Subsidy $ 60, OOo A. Reimburse City Parking Utility for loss of parking meter revanue in return for establishing frea short term parking in accordance with the Parking Agreement between the BID and the City. OBJECTIVB: AlleViate customex' conCern about plugging meters and having correct change, etc. , to encourage longer shopping time, convenience in conducting business transactions and establishing better public relationa. II. Business Recruitment $ 6, 000 A. Maintain leasinq packat £or downtown area. O&7ECTIVE: To provide necessary economic/market data and available space inPormation to prospective businesses considering a downtown location. B. Targated business prospect development (consists of, but not limited to, in- person and telephone business recruitments, mailings, advertisements, travel expenses, prospect accommodations, targeted promotions) . oa7ECTIVE: To fill vacant retail and oPFica space in providinq needed goods and services not available downtown or in Oshkosh, which in turn generates additional commercial traffic for existing downtown businesses. _ Zz9 _ Res. #353 6 E%PENDITIIRE9 III. Marketing/Promotion $ 4, 000 A. Implement a marketing strategy to promote and enhanca downtown businesses images. OHJBCTIVE: Develop effective ways to attract additional downtown business patronage. Consideration will be qiven to sponsoring summer concerts, making storefronts and displays more attractive, coordinated cleaning efforts, and other activities to improve the image of downtown. B. Maintain business directory -- includes all business listings with map indicating frea parking areas, long tarm parking and public facilities. O&TECTIVE: To inform downtown business people, customers, clients, Oshkosh community and visitors what goods and servioes are available downtown, where to find them, and tha most convenient place to park. IV. General A. Activities and programs to improve the HID District as required or permitted by State Statutes, that are in compliance with the operating Plan and approved by the BID Board, providing sufficient program £unds are available. DISTRICT BDDGBT Total $Xpenditures - Program Activities $ 70,000 Total Revenue - District Assessments $ 70, 000 - 22h - Res. #353 7 RELATION88IP TO DOWNTOWN PLANNING In 1980 the Common Council adopted the Downtown Radevelopment Plan and implementation Strategy. The City has been actively implementing physioal elements oP the Plan by constructing new convention cantre and hotel facilities, making inErastructure and streetscapa improvaments, assisting in building rehabilitation. The Plan also recommended increasing organizational efforts between the public and private sectors as well as establishing a voluntary special assassment district. A follow-up study, Planning Report - Central City Oshkosh, approved by the Common Council in 1987, expanded various elements oP the previous plans and in particular recommendad the creation oP a management vehicle and funding base to serve tha downtown area. The management tool recommended was a Business Improvement District. The Downtown oshkosh Business improvement District (BID) is consistent with and critical to the continued successful implementation of these downtown plans. The BID enables the private sector to undertaka promotion, management, marketing, and other programs essential to a prosperous downtown. BID ASSES62S8NT MET80D The City of Oshkosh Downtown Business improvement District (BIDJ special assessment method utilizes assessed value information and � property street footage data, both of which are available Prom the City Assessor's Offica. As the absolute values of assessed value and footage cannot be combined, the values are calculated as a percentage oP the total assessed value and a percentage oP the street Pootage. The two percentages are added with the sum divided by 20o percent, which results in a proportionate value of the total district. A property�s proportionata value oP the total District is multiplied by the District budget, resulting in the special assessment £or the property. The raw data, assessment calculations, and proposed District assessment £or each property in the Downtown Business Improvement District, are presented on the following pages. The data for the assessment method have been obtained from the files of the City Assessor and are sut�ject to Yinal tabulation by the City. To account for street footagea, ranging from very short front footages to entire blocks, the footage was computed in a manner similar to the City�s normal special assassment methodology. Property used for commercial and manufacturinq purposes in the District will be assessed. I have also revie�ved the operating pl�an su6nitted for Business Improvement District RL for downtown Oshkosh, and I have reviewed this specifically with regard to Wis . Stats. Sec. 66. 608 (1) (f) 5 which calls for a legal opinion as to certain requirements being made for an operatin9 plan. It is my opinion that the plan which has been adopted does provide for a special assessment method and that said method will include manufacturing premises. It is fur- ther my opinion that the expenditures have been listed and that a time for making said expenditures, at least initially, has been set forth. The operating plan certainly describes why and how the BID will promote the orderly development of the municipality and specifically relates this plan to the central business district plan.
