PURPOSE: AMEND SOLID WASTE ORDINANCE
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING CHAPTER 23 OF THE
OSHKOSH MUNICIPAL CODE PERTAINING TO SOLID WASTE REGULATIONS
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1 . That Chapter 23 of the Oshkosh Municipal Code pertaining
to solid waste disposal is repealed and recreated to read as follows:

SECTION 2. That this Ordinance shall be in full force and effect
from and after its passage and publication.
AMENDED: Sec 23-4(N) - Leaves, Grass clippings and vines will not be
picked up with the solid waste routes between October 15 and
April 15.

SOLID WASTE ORDINANCE
Section 23-1 . Definitions
The following definitions shall apply unless a different meaning
appeacs fcom the context:
(A) "Gaibage" means puteescible animal and vegetable waste
resulting from the handling, preparation, cooking, and
consumption of food , and animal feces.
(B) "RUbbish" means non-putrescible solid waste consisting
of both combustible and non-combustible waste such as
paper, cardboard, tin cans , yaed clippings , wood,
glass, crockery, brush not to exceed thcee (3) inches
in diametec, and similar materials, but excluding dirt,
stones, plastee, concrete and building and demolition
materials .
(C) "Solid Waste" means garbage, rubbish and all other
discarded or salvageable solid materials , including
solid waste matezials cesulting from industrial ,
commercial , and agcicultural operations, and from
domestic use and public service activities .
(D) "TOxic or Hazardous Wastes" ace concentrations of solid
wastes such as pesticides, acids, caustics, pathologi-
cal wastes , eadioactive materials , flammable or
explosive materials, and similar chemicals and ha�mful
wastes which xequire special handling and disposal to
protect and conserve the environment .
Section 23-2 . Standards of Service
(A) Residential Areas
(1) Solid waste shall be collected once a week from
dwelling units according to a schedule set by the
City.
(2) The City will pick up plastee and building
matezials at a frequency not exceeding once per
month from residential areas, providing however,
that the total amount does not exceed 30 gallons
in capacity and is placed in containecs, the gross
weight of which does not exceed 50 pounds.
(B7 Commercial Areas and Indust[ial Areas
(1) Solid waste shall be collected from commercial and
industxial establishments a maximum of two (2)
times pe� week and the amount of collection shall
not exceed seven (7) cubic yards per week. Any
commeroial or industrial establishment accumulat-

ing or generating moce than seven (7) cubic yacds
of solid waste shall not receive a pick-up from
the City and must arrange for disposal of all
their solid waste .
Section 23-3 . Point of Storaae and Point of Collection
(A) Solid waste shall be stored to the cear of a dwelling .
(H) All solid waste must be placed at the curb or alley
line foc pick-up, but not before 5 o'clock P.M. of the
day preceding a regulacly scheduled pick-up oc a
pceviously announced date for pick-up of cecyclable
materials and containers shall be returned by the
pecsons to the point of storage within twelve (12)
houes after pick-up.
Section 23-4 . Prepacation of Rubbish and Garbaae for Collection
(A) All garbage shall be drained and wrapped in paper and
kept in containers of galvanized iron or othez ❑on-
rusting metal , non-breakable plastic or cubber, with
tight-fitting covecs and lifting handles, and of a
capacity of not more than thixty (30) gallons. The
combined weight of the container and the material shall
❑ot exceed fifty (50) pounds.
(B) Rubbish shall be stored in durable containers not to
exceed thirty (30) gallons i❑ capacity or a combined
weight of fifty (50) pounds. Metal containe�s shall be
equipped with lifting handles. Bulky items such as
brush, large cardboard boxes, flooc covering and news-
papers shall be tied in bundles not to exceed fou� (4)
feet in length, nor fifty (50) pounds in weight .
(C) Solid waste may be placed in larger mechanical contain-
ers provided that said containers aee adaptable to the
mechanical dumping devices cuzcently in use on the City
Sanitation tcucks. Mechanical containers shall be
limited to one (1) cubic yard capacity unless approval
has been given by the Sanitation Superintendent .
(D) The owners of all containecs shall keep them clean and
in a sanitary condition. Maintenance and repaic of all
containecs shall be the responsibility of the owner .
(E) If garbage and rubbish are mixed, it shal l be placed in
containers complying with the above Section as if all
materials were garbage. If garbage oe rubbish is not
prepared in the peoper manner, or not placed in a suit-
able container oc location, oc if the containec is
damaged, employees of the Sanitation Division shall tag
these containers and pick-up shall not be made until
the condition is remedied in compliance with this
ordinance.

(F) Plastic bags may be used foc the placing of refuse for
collection at the curb provided that such bags have a
thickness of no less than two (2) mils and further
provided that said bags are intended for such use and
are disposable and fuether provided that said plastic
bags are designed to be used as inserts in the
containers described in this ordinance. Said bags must
be properly secured , and the total weighb can not
exceed fifty (50) pounds.
(G) Where it is moce economical and advisable to the City
because of extreme building setback, looped driveway,
or other similar conditions, and where property owners
sign a Waiver of Release, releasing the City fcom
damage liability to curbs, gutters, sidewalks and
dciveways, the Sanitation Division employees may go on
private property with a vehicle to pick up both rubbish
and garbage. Material and/or containers shall be
placed in an easily accessible location free of
obstructions such as parked vehicles.
(x) Ashes shall be placed in plastic bags not less than two
(2) mil thickness. No more than twenty-five (25)
pounds of ashes shall be placed in each bag .
(I) Animal feces shall be propecly disposed of by wrapping
in paper, then placing it in a suitable plastic dispos-
able containers .
fJ) Paper sacks or bags shall not be consideced an adequate
container , and shall not be picked up unless such bag
is designed fo� purposes of solid waste disposal .
(K) Stones, concrete and dirt are not allowed i❑ the solid
waste stream and any container with stones, concrete or
diet will not be picked up.
(L) Newspapers and magazines must be kept sepacate fcom
othec solid waste and bundled , or tied in bundles not
exceeding fifty (50) pounds.
(M) Grass clippings, vines and leaves must be kept separate
fcom all other solid waste and placed in biodegradeable
paper bags clearly macked with a factory seal as such.
(N) Leaves, grass clippings and vines will not be picked up
with the solid waste coutes between $�7(R�bl(tb�%XAAk and
April 15 . October 15
(0) Toxic or hazardous wastes ace not allowed in the solid
waste stream, and will not be picked up.

Section 23-5 . Litterina Prohibited
No person shall throw, place o� deposit any garbage or rubbish in
any stceet, alley, public place, or peivate property within the
city limits except in garbage containers or in rubbish containers
as herein pcovided .
Section 23-6 . Private Collections
Private parties, firms oc corpo�ations may be authorized by the
Common Council , on a cevocable basis, to collect refuse at no
cost to the City, provided that such collection is pecformed in
accordance with the p�ovisions of this Chapter and produces no
objectionable conditions in and on the stceets of the City.
Section 23-7 Non-Resident Refuse Disposal Prohibited
(A) No person residing outside the city limits shall bring
into the City for disposal any ga�bage, rubbish or
other items of a combustible or noncombustible natuce.
(B) Any pexson violatinq the provisions of this Section
shall be assessed the actual costs incuered by the City
of proper disposal together with an administrative
charge of 525.00 for each disposal. The imposition and
collection of any forfeiture prescribed by this Chapter
shall not bar the right of the City to collect the
costs of disposal as herein provided .
Section 23-8 Dumoing Grounds Regulations
The Police Department , through its Chief, and the Public Works
Department, through its Director, acting i❑ concert, shall
regulate the dumping, depositing , or placing of trash, brush,
yard waste, or any other solid waste or recyclables on and within
any land or place within the City. Any land or place designated
as dumping grounds, or drop off site for any material including
recyclables shall be published by the ecection of signs in
conspicuous places on such grounds, containing suitable instruc-
tions to the public.
Section 23-9 Penalties
Any peeson who shall violate any of the provisions of this
Chapter oc of any Section thereof, shall , upon conviction
thereof, be punished by a forfeituce of ❑ot less than 550.00,
nor more than 5500.00, together with the costs of prosecution,
and in default of payment thereof, by imprisonment in the County
Jail for a peiiod not to exceed sixty (60J days. Each violation
shall constitute a sepaxate offense.
