PURPOSE: RENEW CONTRACT WI1'II THE UNIVERSITY OF WISCONSIN-
OSHKOSH FOR RELOCATION ASSISTANCE SERVICES
INTTIATED BY: UNIVERSITY OF WISCONSLN-OSHKOSH, BOARD OF REGENTS
WNEREAS, [he City of Oshkosh has previousLy contracied with ihe
Universi[y of Wiaconsin-0shkosh, Board of Regenis� m provide reloca-
tion assistance services; and
WHEREAS, [he Universi[y desires [o renew [he con[rac[ for said
services.
NOW, THEREFORE, BE IT RESOLVCD by the Common Council of [he Ci[y
of Oshkosh that [he a[tached Con[rac[ for Reloca[ion Assis[ance Services
be[ween [he City of Oshkosh and the ❑niversi[y of Wisconein-Oshkosh,
Board of Regents, is hereby approved, and the proper City officials
are hereby authorized and direc[ed ro enter into [he attached Contrac[.

CONTRACT FOR RELOCATION ASSISTANCE SERVICES
THIS AGREEMENT, entered into this 16 th day of December , 198�, by and
between the City of Oshkosh, State of Wisconsin, hereinafter referred [o as [he "City", and
the Boazd of Regents of the University of Wisconsin System, Chapter 36, central
administrative ofCice located a[ 1930 Monrce Street, Madison, Wisconsin, hereinafter
refeaed [o as the "Boazd",
WITNESSETH: .
WHEREAS, the Boazd under [he provisions of Chapter 32 of the ]aws of Wisconsin
is a Condemnor, possessing the power of eminent domain, and,
W'HHREAS, the Boazd is reyuired to provide relceation assistance ro persons,
families, businesses, fums and others displaced by reason of public acqaisidon acuvities
under Wisconsin Statutes, Chapter 32, and,
WHEREAS, the Board proposes to provide public improvements and will displace
persons, families, businesses, farms and/or others in the course of their activities, and,
WHEREAS, Chapter 32 of the Wisconsin Sta[u[es provides that a Condemnor may
contrac[ with an expedenced �elocation agency to provide relocation assistance under this
Chapter for [hose displaced by the action of the Board, and,
WHEREAS, the Ciry is experienced in residen[ial and business relocauon activities,
and is prepazed ro provide such service under the provisions of Wisconsin Stamtes, Chapter
32,
NOW, THEREPORE, BE IT RESOLVED that the parties do hereby mutually agree
as follows:
1. Swpe of Services. The City shall pedorm all of the necessary relceation
services in connection with and respecting the responsibilities of [he Board as
a Condemnor provided for in the Wisconsin Statutes, Chapter 32.
The jurisdic[ion for adminis[ration of Chapter 32 shall be the corporate limits
of the City of Oshkosh.
The Boazd further agrees that all University depaztments shall provide
complete cooperation ro the City in the City's administration of the
relocation assistance program.
The City shal] perform the following functions which shall include, but not
be limited to,
a. The preparation of relocation plans (or submission ro the Department
of Local Affairs through the Board office.

b. Provide a relocation refelral service available ro all persons displaced
by reason of acquisition projects.
c. Inspect and analyze replacement housing facilities as sewred by
displacee within the defined ju�sdiction ro insu�e [hat fhey meet
D.S.S. standards as provided by law.
d. Prepare the necessary fonns and reports incidental ro the
adminisVation of the program with all fonns and reports to DLAD
being submitted through the Board office.
e. Establish a public information services and provide for the dishibuuon
of such infortnation ro displacees relating [o the relceation assistance
program.
f. Analyze each relocation question and recommend, in writing, the
amo�nt of puyments due each displacee as determined by the Ciry and
submi[ such detertnina[ion to Ihe Board, wlio will make Ihe
appropriate payments ro the displacees.
g. Maintain sufficient professional and administrative staff ro perfortn Ihe
woik herein set forth in accordance with [he Wisconsin Statutes,
Chapter 32.
h. Prepaze all reports relating to appeals of displacees ro [he Depaztment
of Local Affairs and/or cour[s having judsdiction in the matter of �ie
relocation program.
2. Payment to Dieplacees. The City shall have no responsibility for any of the
payments due ro displacees resulting from activities by the Boazd. (Urban
renewal activities undertaken under d�e Wisconsin Statu[es 66.431 excepted.)
3. Method of Pavmgn[ [o the City. The Board shall pay the City for its time,
materials, local travel and overhend .or all services rendered at a rate of
Twenty-five Dollars ($25.00) per hour for each employee working on the
Scope of Services set forth in this Contract,. The City shall bill the Board
at 30-day intervals for aIl services perfonned. Detailed records of the fime
spent under the terms of [his Contract by employees of [he City shall be
kept and forwazded to the Board at time of billing.
Failure by the Boarci to pay monthly invoices for a period of 60 days shal]
be sufficient grounds for the Ciry ro temu�ate [his Conhact.
4. Other Considerations. The Board shall pay the City for the acmal cost of
vavel, food, lodging, and incidental costs resulting from nonloeal travel
necessitated by [he administration of this Contrac[ and matters relating
thereto. The Board must approve aIl such nonlocal travel in advance.

The Board shall pay the City for the acmal costs of long distance phone
calls occurring as a resWt of the administration of this contract.
All costs of appeals and/or court actions for which the Board is alleged
liable resulting from any detertnination of any govemmental agency,
commission or court having jurisdiction over appeals relating to relocation
costs or costs incidental to relocation shall be paid by the Boazd.
All activities herein provided shall be administered by the City without
regard to race, creed, color, sex, or national origin.
5. Tertn of Contract The term of this Contract shall be for a period of four
(4) years ending December 30, 1992, unless tenninated by either party,
which tercnination shall be effected by either party giving nioety (90) days'
notice of such termination.
6. Cost Limitation. It is agreed and undersrood that the fees for services
hereunder furnished by the City in aceordance with the procedures of
pazagraph 3 shall not exceed a maximum allowable amount of Twenty
Thousand Dollazs ($20,OOQ00) for the four-yeaz period.
