PURPOSE: APPROVE WORK EXPERIENCE PROGRAM AGREEMENT
WITH WINNEBAGO CORRECTIONAL CENTER
INITIATED BY: CITY ADMINISTRATION
BE IT RESOLVED by the Common Council of the City of Oshkosh that the
attached Work Experienw Program Agreement between the Winnebago Correctional
Center and the City of Oshkosh is hereby approved and the proper City officials
are hereby authorized and directed to enter into same.
Money is hereby appropriated from Account No. 310-550, General Fund
Equity, to be repaid from the operational accounts of the departments utilizing
the services rendered under terms of this agreement.

This Work Pro,lect ABreertient has been entered into this 17th day
op Februarv , 19 89 between the above two Agencies/Department for the
purpose of establishing a meaningful work experience training program
by the CitY uf Ushkosh for pre-release inmates housed at the Winnebago
Correctional Center . �
Isach party hereby agreee to the folloaing conditions , terms , ancl
provisions :
Agency/Department "A" will :
1) Provide selected inmates to participate in the Work 1'raining
Proeram not to exceed 5 placements at any eiven time . .
2) Provide work clothing, Nork shoes , or Goots suitable for
performance.
3 ) Provide a bag lunch .
. 4 ) Traneport selected inmates to and from the uark eite in
accordance with the prearranged work sctiedule .
5 ) Provide occassional on site monitoring oP inmate per£ormance .
6 ) Provide a mor�thly etatement oP inmate hours aud taaees for each
inmate participating in the program .
7 ) Remove or transfer from the prograni immediately any
indivi�lual.( s ) that ean or will not accept directions from
the Agency � "B° -suFervisor, or in the opinion of Agency "B"
supervisor is unebla to perform the Norlc assigned � in a
satis£actury rtianner . Said vacancy Nill be replaced without
delay by Agency "A" in order to eta£f a full complement o£
workers as epecified in Cot�dition tll of the � responsibilitiee

Agency/Uepartment ".B" will :
1 ) Provide rcieaning£ul Norlc experience pro,lect�• £or pre-release
inmates that uill assist them in identi£ying with and learning
good work habits and reeponsible ,�ob performance .
2 ) Provide daily on site instrucbional eupervision and behavior
monitoring . �
3 ) Provide all neceesary tools and equipment , including sa£ety
equipment , vhich ie necessary to perform all requlred taeko .
4) Provide work per£ormance informatiun to Center and to
prospective community employers . �
5 ) Provide ealary reimbursement to the State af Wisconsin,
Division of Corrections for all inmate wagee for actual hours
worlced at a rate of a0 • 75 per tiour per inmate , on a nionthly
basis . Salary reimbursement does not inlcude insurance , sick
leave , or other fringe tenefits .
6) Report inimediatelv to Center staif any irregularities in
inmate behavior.
7 ) Require inmate compliance with rulee , policiect , and proceduree
as outlined by Winnebago Currectional Center ataf£ .
11�er�cy/Department "B" reserves the righC to determir�e the daily ,1ob
tasks and nature of work to be performed by inmates . All ,�ob taske
must Ge identified ' as non-routine , departmerh provided services .
Absolute approval will be bY the Superintendent oi the Winneba�o
Correctional Center.
It is further understood � that �gency/Department "A" is classified as
an independent contractor, providing contracted labor services to
Agency/Department "B" .
In the event a labor diaYUte erupte betWeen permaneut party employeen
and mana�ement , resulting in an identified form of ,1ob action , the work
experience program will be suspended until such time Lhe dispute ie
resolved and the agency, resumes normal operation . .
No inmate participaut is � to be claseified as or �to Ge ronsidered tu
be a permanent party employe° . �11 such poeition vacanciea occurrin�
during the term o£ this program rtiust be fillecl .according to agency
policies and procedures . "

Correotional Center Superintendent reserves the right to aeeien or
euepend inmatee in caee of Nork etoppage , eeneral etrike , lockout or
� other oircumetancee relating to the inmate ' e incarceration or i£
eecurity o£ the general� public may be �eopardized .
The State Risk Pool is responsible for aorker' e compensation Ntiile
rtdnimum security inmatee are involved in a structured � uork pruHram uff
grounda performing public service at inmate Waaea .
