Prior to receiving this letter, numerous correction notices have been sent to you indicating the noncompliances found during the rough inspection on September 29, 1997. In these previous correction notices it was stated that a stop work order was going to remain in place until a reinspection verified that all the corrections indicated in the notice were approved. � During our phone conversation on 10/1/97, you indicated that more time was needed to evaluate the violations due to your husband leaving you and your children. At that time I agreed to allow you some time to determine how the violations were to be corrected and who was going to correct them. At that time I also indicated that no further construction could take place until I reinspected the corrected violations. As of December 17, 1997, I have never been contacted by you and/or a contractor regarding the noncompliances located at 431 W 9th Ave. Therefore no reinspections have taken place and the stop work order is in your file and remains in place. Unfortunately the letter stated that your contractor completed the job with disregard to the violations he created, thus never calling for a reinspection. The fact remains that the violations need to be corrected and reinspected to verify their compliance with al( state and local building codes. Therefore, I am requiring that the walls and ceiling area be opened to verify the items in the correction notice have been corrected. I would advise you to contact your contractor and let him know that the corrections were never verified, thus he will have to open the walls and ceiling of the porch/living room area. I am giving you until January 15, 1997 to comply with this order. If a response is not received by our office, legal action will be taken. I am still requesting a written schedule of how and when the items contained in the correction notice of 9/29/97 will be completed. In addition to the schedule, it will be beneficial and necessary to meet at your property and discuss the scheduled items in addition to the items � contained in the correction notice. Sorry for any inconvenience to your family, this could have been prevented if the correction notices were complied with. We are making reference to the corrections that you noted on issue ; t date of 9/29/97. ; � It was our understanding, prior to beginning the project, that we did not need permits for putting in new windows, (a drive by was done by an inspector of your department). Also, ' � at that time, we asked if we needed a permit for putting up drywall and we were told that ; we only needed one if we were doing work with a bearing wall. The electricity was - already there...we did not do anything with this, but put new plate covers on and prior to � ; putting up the drywall, the house was heavily insulated, outside and insidewith vapor t barrier applied. It was also our understanding that our contractor was working with you � on the issues that needed to be resolved and that all compliances were met. Since then, he has completed his job, been paid in full, and the room has been finished. � In conclusion, it would be highly cost ineffective to remove the finished walls and would = # � also cause a great inconvenience to our family. Again, we were under the assumption that all corrections were made by our contractor. The following municipal codes have been violated. Mun 7-31(B) States that no work shall be concealed until approved by the building inspector. Mun 11-32 States that permits are required for electrical work. ����'� C° `✓� � Brief historv review: Mrs. Langhoff was found enclosing the front porch in August of 199T and a correction notice was mailed. The owners obtained the permit on 9/25/97, and an inspection was scheduled on 9/29/97. Numerous violations were found upon the rough inspection that took place on 9/29/97, and a correction notice was sent to the owners. Soon after the notice was mailed, I received a call from Mrs. Langhoff crying that her husband left her and she did not have the money and did not know how she was going to correct the violations and finish the project. At this time I stated that she could have some time to figure out how to correct the violations but that no further construction could continue until the violations were corrected. It was also stated that the stop work order that I posted on 9/29/97 was to remain in affect until an electrical permit was obtained and the violations were corrected. Noted violations included improper framing of the skylights, inadequate ventilation, notched/cut headers, new electrical without a permit, and improper heating. I sent a letter on 12/4/97 due to the fact that I had not received any communication from Mrs. Langhoff in regard to the noted ��iolations after the final correction notice was mailed. Upon mailing this letter I received a letter from Mrs. Langhoff stating that the project was finished by their contractor and it would be a great inconvenience to their family to have to remove the drywall so the violations could be inspected. An additional letter was mailed on 12/17/97 from our office, requiring the wall and ceiling area to be opened so the violations could be inspected. The compliance date for this order was 1/15/98, and I have yet to be contacted by Mrs. Langhoff and no electrical permit has been taken out. It appears that Mrs. Langhoff thought that the orders would be forgotten and never checked due to the fact that construction continued after numerous correction notices were sent and a stop work order posted. It is unfortunate that actions like these have to take place but we have to let owners know that there are consequences to not following correction notices. It was our understanding, prior to beginning the project, that we did not need permits for pirtting in new windows, (a drive by was done by an inspector of your department). Alsq �,r at that time, we asked if we needed a permit for putting up drywall and we were told that we only needed one if we were doing work with a bearing wall. The electricity was already there...we did not do anything with this, but put new plate covers an and prior to putting up the drywall, the house was heavily insulated, outside and inside with vapor barrier applied. Tt was aiso �ur understanding that our contractor was working with you on the issues that needed to be resolved and that all compliances were met. Since then, he has completed his job, been paid in full, and the room has been finished. In conclusion, it would be highly cost ineffective to remove the finished walls and would also cause a great inconvenience to our family. Again, we were under the assumption that all corrections were made by our contractor. As we are a bit confused and surprised to receive this notice, we can't help but wonder if your records are showing you a clerical error. As we recall, you made us do quite a bit of work in order for our reconstruction to pass your approval. On the final day of inspection, after we tore down a wall, we were told the house did pass on your and your offices' approval and that all we had yet to do was bring $10.00 into the Building Inspector's office to pay for the electrical permit. This was done immediately as we wanted no more problems with this job. We were not given the actual electrical permit because the job was already done, but the $10.00 was collected by your office and paid in full. Now,to locate the paperwork reflecting this will take quite sometime as we have moved twice since this construction was completed and many files are in storage, if not misplaced and keeping in mind this was appro�mately 2 '/2 years ago. Further, it would appear after checking our records, that we paid for the same building pernut twice on our home. The first pernut was paid for by us on 9/25/97. Prior to beginning the roof, we contacted your office in questioning if the roof permit was covered under the original building permit we purchased on 9/25/97. On April 14, 1998, we received a letter from you stating that the roof pernut is included with the porch remodeling permit. On May 27, 1998, Hickey Roofing was told by your office that he needed another building permit for the roof. He purchased one of which was reflected as an incurred charge on our bill from him,thus we had to pay for it again. Why did your oi�ice issue another permit when one was already in force for the same reason? Rightfully, we should have a credit coming on this oversight. In fact, I have researched your property file,as stated in the previous letter, and the file only contains a late pernut for the front porch remodel and a pemut from Hickey roofing for a partial re-roof. I would invite you to come and review your property file and/or provide copies of the alleged permits that were issued twice so we can provide a refund for the duplicate permit. I would also like to state it is unfortunate that you feel the City of Oshkosh is harassing you over the requirement to obtain an electrical permit. I first contacted you with the correction notice dated 9/29/97 stating an electrical permit ' � was required for the porch remodel that was started prior to obtaining the required building pemut. It should also be noted that I allowed you an extension on 10/26/97 when you called to state you were having financial trouble and needed more rime to comply. The workcard for the electrical permit was created on 1/25/1998,which has never been obtained. Unfortunately,our office does not have the staff or the time to follow up on all correction notices on a timely matter. This however does not dispute the fact that the electrical permit is required. Upon your request I am sending a copy of the electrical workcard with the amount due noted on the"Notice of Payment Due". The original fee(which was$15.00)has been doubled due to the fact that the permit has never been obtained since it was first created on 1/25/1998. =""a" -�' �I would advise you to make an appointment with our electrical inspector,Kevin Benner 236-5046,to schedule an appointment so the electrical work can be inspected. I would also like to inform you that the dwelling must comply with the Minimum Housing Code due to the residence being used as a rental. I would hope that you could see that our department provides a service to the community in ensuring tenants and homeowners are provided with safe housing. State and local building code requirements are established to provide safety to the community. It is unfortunate that you feel that this is just a"political game".
