Dear Mr. Jungwirth:
On November 8, 2000 the Board of Appeals approved your variance to construct an uncovered parking
spaces along side a garage with a rear yard setback of 5'.
The decision of the Board was filed in the Planning Services Division Office of the Department of
Community Development on November 9, 2000. Per Section 30-6(C)(3) and (4) of the City of Oshkosh
Zoning Ordinance, your variance will expire on May 8, 2001 unless you have obtained a permit for the
activity allowed by the variance. If you fail to get a permit by this date, you must reapply for a variance
if you intend to go ahead with the activity allowed by the variance.
Please be advised that any person or persons aggrieved by any decision of the Board of Appeals may
commence action in Circuit Court within thirty (30) days after the filing of the decision. Permits may
be issued on approval of the Board, but you should be aware that further action could take place
until as much as 30 days �fter the date of the decision.
Building permits may be applied for from the Inspection Services Division in Room 205 at the Oshkosh
City Hall between 7:30 - 8:30 AM and 12:30 - 1:30 PM, Monday thru Friday, or call (920) 236-5050 for
an appointment. Please bring all required building plans and information necessary for review when
obtaining your building permit.

PRESENT: Carl Ameringer, Cheryl Hentz, Randy Husman, Joel Kluessendorf, and John Schorse,
Vice Chairman
EXCUSED: Fred Dahl, and Don Krueger
STAFF: John Bluemke, Principal Planner; and Vickie Rand, Recording Secretary
Vice Chairman Schorse called the meeting to order. Roll call was taken and a quorum declared present.
A motion was made by Hentz to approve the meeting minutes of October 25, 2000 as mailed. Seconded
by Kluessendorf. Unanimous.
I: 402 W 9TH AVENUE
Jordon Jungwirth, applicant for Jason Jungwirth, owner, requests a variance to construct an uncovered
parking space along side a garage with a rear yard setback of 5'; whereas Section 30-36(C)(5)(a)(ii) of
the City of Oshkosh Zoning Ordinance does not allow uncovered spaces between the garage and rear lot
line.
Jordy Jungwirth, 1180 Heritage Trail, stated he was representing his son. He stated his son bought the
house four years ago and had put in a new driveway, however it still doesn't allow enough parking for
all the residents of the house, as the car extends over the sidewalk. He stated they would be able to meet
a front yard setback to create a parking space, however, his son is fussy about his yard and feels a space
along side of the garage would be out of the neighbors view, and an improvement to the area.
Vice Chairman Scharse asked if he was parking on the grass now. Mr. Jungwirth stated he was parking
on the street during the day and in the driveway at night.
Vice Chairman Schorse stated this would appear to be a solution to the parking problem, and because
the space would be surrounded by the neighbors detached garages it wouldn't be detrimental to the
neighborhood.
Motion by Husman for approval of the variance to construct an uncovered parking space
along side a garage,with a rear yard setback of 5'. Seconded by Hentz. Motion carried �-0.
Finding of the fact: Ms. Hentz stated this would solve the parking problem with no adverse impact to
the neighborhood. Vice Chairman Schorse stated the size and location of the lot
creates a hardship.

Grant and Nancy Schultz, applicants and owners, request variances to construct a detached garage in the
side yard with a 2.5' side yard setback and which detached garage will only provide 2 parking spaces;
whereas Section 30-19(B)(4)(c) of the City of Oshkosh Zoning Ordinance requires a 7.5' side yard
setback, and Section 30-36(C)(5)(a) of the City of Oshkosh Zoning Ordinance requires the property to
have at least 4 parking spaces.

19(B)(1)(a)(i) of the City of Oshkosh Zoning Ordinance requires the lot to be a minimum of 60' wide.
IV: 845 CHERRY STREET
Sally Struensee, applicant for Pine Investments, owner, request a variance to expand a 10' wide
concrete driveway by T+ ; whereas Section 30-36(C)(5)(b) of the City of Oshkosh Zoning Ordinance
requires a driveway not exceed the width of a garage.

GENERAL DESCRIPTION AND BACKGROUND
Jordon Jungwirth, applicant for Jason Jungwirth, owner, requests a variance to construct an uncovered
parking space along side a garage with a rear yard setback of 5'; whereas Section 30-36(C)(5)(a)(ii) of
the City of Oshkosh Zoning Ordinance does not allow uncovered spaces between the garage and rear
lot line.
The general azea is chazacterized by residential land uses, and the subject property is zoned R-2 Two
Family Residence District.
ANALYSIS AND RECOMMENDATION
In reviewing a variance request, the following questions should be addressed:
Is there an unusual or unique characteristic about the subject property which
creates a hardship?
Is the hardship self-created?
Is the variance being requested the least possible needed to remove any
hardship?
Will granting of the variance have a considerable adverse impact on the
neighboring properties?
The applicant is requesting a variance to construct an uncovered parking space along side an attached
garage which would result in a 5' rear yard setback. The subject lot is a corner lot, which is only 90'
deep, and this depth presents a hazdship relative to any development on the lot. The proposed
uncovered space would be behind the detached garages of the adjoining properties and as a result
would be screened from these properties. Additionally, parking on the proposed uncovered space
would have less of an adverse impact than if parking were allowed in the front yard.
Based on this information, staff recommends approval of the variance.
