PURPOSE: APPROVAL OF FINAL RESOLUTION FOR SPECIAL
ASSESSMENTS FOR STORM SEWER LATERALS / VARIOUS
LOCATIONS
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
WHEREAS, the Common Council of the City of Oshkosh held a public hearing on
the 12th day of May, 2015, at 6:00 p.m. for the purpose of hearing all interested persons
concerning the preliminary resolution and report of the City Manager (Board of Public
Works) on the proposed improvements as listed below, pursuant to the initial resolution
adopted April 28, 2015, by the Oshkosh Common Council of the following properties:

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh as follows:
1. That the report of the City Manager, acting as the Board of Public Works,
pertaining to the construction of the above described public improvements, including plans
and specifications therefor, is hereby adopted and approved with the following
modifications:

2. That the action of the City Manager in advertising for bids and to carry out the
work of such improvements in accordance with the reports of the City Manager and in
accordance with the said resolution heretofore adopted, is hereby approved, ratified and
confirmed.
3. That payment for said improvements be made by assessing the cost to the
property benefited as indicated in said report, except as modified herein.
4. Assessments shown on the report represent an exercise of the police power and
have been determined on a reasonable basis and are hereby confirmed.
5. That the assessments for all projects included in said report are hereby
combined as a single assessment but any interested property owners shall be entitled to
object to each assessment separately or all assessments jointly for any purpose or
purposes.
6. That the assessments may be paid in cash, or in installments pursuant to
Section 25-83 thru 25-89 of the Oshkosh Municipal Code, said deferred payments to bear
interest at the rate of six percent (6%) per annum on the unpaid balance. The City Clerk
shall publish an installment assessment notice in accordance with Section 66.0715(3)(e) of
the Wisconsin Statutes in the official newspaper of the City.
7. The City Clerk is directed to publish this resolution in the OSHKOSH DAILY
NORTHWESTERN, the official newspaper of the City.
8. The City Clerk is further directed to mail a copy of this resolution to every
property owner whose name appears on the assessment roll whose post office address is
known or can with reasonable diligence be ascertained.

A public hearing is scheduled for Tuesday, May 12, 2015, at 6:00 p.m. in Ihe Common Council Chamber of the
Oshkosh City Hall to consider the improvements to your street S[aRwill be available beginniug at 4:45 p.m.in
Room 310 to answer questious abou[ the project and the esHmated costs. Residents may also call [he
Depar[ment oC Pu61ic Works Engineering Division at (920)236-5065 to have guestious aoswered. The
proposed improvements include: stortn sewer laterals (new and relay) and surface drains and the lery of special
assessmenis that partially cover the cos[ of the improvements. Assessments are not due until the projec[ is
certified as comple[e and then can be paid by any one of the plans as outlined by the City Clerk's infocmation on
payment plan options. Based upon the City of Oshkosh assessment policy, the assessable portions of[he project
have been iden[ified and are outlined on the attached assessment worksheet(s). The final cost will not increase
above the estimated total without another public hearing. Questions in regard to payment of Special Assessments
can be answered by calling [he CiTy Clerk's offce at (920)236-S011. Questions in regard to the construc[ion
project in genecal can be answered by calling Ihe Departmwt of Public Wo�ks Engineering Division at(920)236-
5065.
The sequence of construc[ion has not yet been scheduled wi[h a contracror. Residents will be notified
approximately one week before consvuction will begin on a particular street. All work within [his contrac[ is
scheduled ro be completeA by the end of August 2015.
The project construction will wnsist of the Cotlowing elements: relay or installation of srorm sewer la[erals and
surface drains, u needed, along the pmject to accommodate the drainage needs for the sheet and the adjacent
properties. If you know of any undergmund wires and/or piping (examples: invisible elec[dc fence, condui[for
exterior lighting, irtigation system, etc.) on your proper[y neaz the sidewalk and driveway, please contact the
Engineering Division as soon as possible. Prior to the completion of the project, all disturbed areas will be
topsoiled, seeded, and covered with emsion ma[ ([he property owner is responsible Por watering t6e uewly
vegeta[ed areas). The matting placed over[he seed is biodegradable; please do not remove the mat because i[
serves as mulch for the new grass. Pleue set your lawn mower to the highest setting when mowing the new
grass aceas foc the first few mowings.

pump hoses[o this location. This drain is connected to Ihe srorm sewer system and drains directly to local streams
and lakes. The lateral is to be used fnr"clear water"onty. "Clear wate2'is typicalty groundwa[er dischacged by a
sump pump or runoff from precipitation (i.e. rainfall or snow melt). Do not place pe[ waste, yard waste, or
other was[e ma[erial into the storm sewer system. In [he event conditions on the properry prevent the
installation of Ihe dzain(a retaining wall, for example), a drain will not be installed. The stortn sewer laternl will
be smbbed underground in[o the terrace azea. The drain is part of your private lateral and will be yours to
main[aia The drain will have a fabric filter installed as a part of the construc[ion. Please leave the filter in place
until Ihe grass surrounding Ihe drain is well establisheA. The fabric will pcevent dirt and debris from filling the
pipe until Ihe grass is established. Commercial properties will receive a larger diameter smrm sewer la[eral
smbbed ro the property line.
If the CiTy does not receive a signed Consnuction Acress Agreement from you, the storm laterals will only be
provided in[he City's right-oSway,rypicalty to the terrace area between the sidewalk and curb. The 8"yard drain
will not be ins[alled.
Although[errace trees may need to be removed at specific ]ocations, they will be preserved as much as possible.
Property owners at locations where a tree needs ro be removed will receive advance notice of the removal and
replacement options. Roots and brnnches may be cut ro allow for paving operations. Cutting and pmning will
either be done by, or under[he direction of,the CiTy Forester.

As per Sectlon 27-27,27-28 and 27-29 of the Municipal Code of the City of Oshkash,there is no parking
on[hc City stree[s,2 a.m.to 5 a.m.,unless the owner of vehicle was gran[ed permission or has purchued
a City pazking pertni[.
If your street or sidewalk is under constructioq it is NOT necessary to obtain a parking permit if you park
your car wi[hin[wo blocks of the street under constructioa All City ordinances aud parki�g
mles/guidelines must be followed.
All posted parking restrictions, including time zones a�d no parking areas,must be obeyed.
You will need to follow the odd-even rules. On odd days of Ihe week, [he vehicle should be parked on
the side of[he street with odd-numbered houses. On even days of the week,the permi[holder should
park on[he side of the shee[with even-numbered houses. Each night,the car should be parked on the
opposi[e side of the street as the night before. NOTE: Odd and Eveu da[es are 5gured before
midnight.
If parking is only allowed on one side of the street,the odd-even rules DO apply. Vehicles can only park
on the side of the street tha[does no[have restricted parking and are only allowed[o park overnight on the
appropriate odd-even days.
In the case of a declared Snow Emergency,AI.L vehicles must be removed from the stree[or the vehicle
will be towed a[ownePs expense. It is Iha responsibility oftha vehicle ownedoperator to fiud alterna[e
parking in the event of a snow emergency.
Disabled vehicles aze m[allowed[o park overnight at anytime and should be moved wi[hin 24 hours.
Motor busses;Wck tractors; semi-trailers; and motor trucks designed,used, or maintained primarily for
[he[ransportation of property as defined in City Code 27-26(3)are not permitted to park ovemigh[on �
City sVee[s.
All street packing is subjea to the following guidelines:
• May not park in signed/designated"No Parking"areas.
• Vehicles may mt stop or park in a designa[ed"Fire Lane".
• No parking within 10 feet of a fice hydrant(an offieial Raffic sign may indica[ed that a grea[er
distance is requ'ued).
• No parking in loading zones.
• No parking within 4 feet of an alley or private roadway or driveway.
• No pazking within IS feet[o the near limits of a crosswalk.
Failure to follow the above rules could result in parking citations being issued.

There wil] be stortn sewer work performed in front of your home as a part of the 2015 Mini-Stortn Sewer
Program. In ordar to ef5ciently complete the construoUOn process, [he CiTy is requesting access onto your
properly to perform consWC[ion ac[ivities. These activities may include, but are not limited to, installation of
new or relayed storm sewe� laterals; installation of storm sewec lateral inlets;removal and installa[ion of sidewalk
and driveways;root pruning; grading operations; ]awn restoration; and ins[allation of sidewalk curb, if necessary.
By allowing the City and its Contractors access [o your property, the CiTy will be able to save you money,
wmplete the projec[faster,and provide a better fmal product.
Benefits to Prooerfv Owners:
• Stortn sewer laterals will be installed or relayed past the proper[y.
• If exis[ing underground piping is present, [his will be reconnec[ed [o the new lateral behind the back of
walk.
• Right-of-Way Permits will not be required for future counec[ions to the storm sewer lateral.
If the CiTy does not receive a signed Consiruc(ion Access Agreement from you, [hen the storm sewer la[eral will
not be able to be installed undec[he public sidewalk onto your proper[y. This will result iu increued cosis to tl�e
property owner in the fuNre when connecting to the storm sewer lateral.

final design can be completed in a timely manner to ensure the project can be bid in late spring of 2015.

Storm laterals were not installed to all properties prior to approxima[ely the last ]0 years on mad reconswc[ion
projects within the City. Ma�y property owners have sump pump hoses they wish to route underground [o the storm
sewer system; or have ezperienced backyazd flooding issues, and have requested [o have a storm laternl installed to
their properry. Any storm sewer work being completed at those properties or adjacent to those properties will have a
lateral installed. The insiallation of storm la[erals [o all adjacent properties at this time helps to avoid fumre site work
and extra construction costs.
Who owns and maintains storm sewer mains and s[orm sewer la[erals'
The CiTy owns and is responsible for maintaining the s[o`m sewer main lines. 'Ihe storm laterafs are owned by the
property owner,and the pmperty owner is responsible for maintaining the laterals that serve the proper[y.

property. From previous City wntrac[s, the es�ima[ed cost[o relay or ins[all one (1)storm laterel is $400, and to
iustall a storm lateral and slorm lateral iule[ is $750. This cost is for relaying or ins[alling Ihe smrm sewer lateral
and for removal and replacement ofthe pavement and sidewalk tha[is requved for the la[eral construction. The cost to
remove and replace the pavement and sidewalk for Ihe connection to the s[ortn sewer main is paid for by the City of
Oshkosh.

The C�ty will be mstalhng a new srorm lateral from the existing stortn main to approximately the property line, which
is typicalty tk�e house side of the sidewalk. A stortn lateral is installed on every property adjacen[to the project and
includes a 6' storm lateral, or a B' stonn lateral and an 8"yard drain with a slotted cover. When the 8" yard drain is
insralled, it will be placed several feet on[o your private property. This yard drain is used for"clear water"only. "Clear
water" is typically groundwater discharged by a sump pump or mnoff from precipitation (i.e. rainfall or snow mel[).
The ezact location of the yard drain will be coordinated wi[h the propeRy owner during constmction. If we do not hear
from you on the exact lowtion you would like it installed,[he Engineer will determine the best locatio�for the drain.

If you have a sump pump hose that drains water inm your yard, you will be able [o re-route[he hose to discharge in[o
the new 8" storm sewer yazd draia You can also hire a plumber to bury your sump pump hose atid connec[ it to the
s[orm sewer and storm la[eral inlet tha[lhe City provides. lf you experience backyard flooding,you may be ablc to hire
a plumber to ins[all additional yard drains or drain[ile in your rear yard, and route these systems into your new srortn
lateral. If you wish ro extend the stortn lateral into your private property as mentioned above,the Ciry can assist in the
wordination of this work.

]f Ihe City does mt receive a signed Construction Access Agreement from yoq[he storm laterals will oNy be provided
in the City's right-of-way,typically ro the terrace azea between the sidewalk and curb. Then in the future, if the lateral
is to be extended to the home or backyard, [he property owner would be responsible for ob[ainiug a permit to work
in the righ4of-way and would also be responsible for all costs associated wi[h [he removal and replacement of
any disturbed area within [he righ4of-way, including pavement and sidewalk. If the Construction Access
Agreement is not signed and retumeA,[he City will also not have the abiliTy to install the 8"yard dmin.

Sidewalk squares will need to be removed for the installation of the new or relayed larerals. When sidewalk is
replaced, a fortn needs to be placed a[ Ihe back side of the sidewalk, which in tum encroaches onto your private
property. The concre[e walk[ha[is to be removed and replaced will be done so a[no cost to[he property owner. Also,
any reseeding on private proper[y cannot be completed without a signed Consbuction AccessAgreememt.

Typ�cally, the street right-of-way is bcated approximately at the back of Ihe sidewalk. A srorm lateral is installed on
every property adjacen[[o the projec[and includes a 6"storm Iateral, or a 6' storm lateral and an 8"yard drain with a
slotted cover. When the 8"yard drain is installed, it will be placed anywhere from five feet (5')to a mauimum of ten
feet QO') in[o your private proper[y depending upon Ihe tenain and slope of your lot. The width of the trench will be
approximately four feet (4') wide, centeied on the ]ateral location. The exact location of [he yard drain will be
coordinated with yoq the property owney during constmction. If we do not hear from you on[he exact location you
would like it instelled,the Engineer will detennine the but tocation for[he drain.
Once all storm sewer main and laterals are ins[a]Ied,the trenches in[he street oc[erzace will be graded and patched and
any concrete sidewalk that was removed or daznaged due the cons[mction will be replaced, ff the Consbuction Acress
Agreement was signed and reNrned. If the Construction Acress Agreement is not reNmed, the Conhactor will not
have awess to your property and[he concrete sidewalk can only be patched.
Any dismrbed turf areaz will have 6' of[opsoil placed, fertilized, seeded, and an erosio� mat installed. The property
owner will bc responsible for the watering of the newly-placed grass seed. A door hanger regarding [he walering
instruc[ions will be distri6uted a[a later date.

LOCATIONS
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED BY the Common Council.of the City of Oshkosh as follows:
1. The Common Council hereby declares its intention to exercise its police
power under Section 66.0703 and 66.0705 of the Wisconsin Statutes to levy special
assessments upon property within the following described areas for benefits conferred
upon such property by improving the following:

2. The total amount assessed against such district shall not exceed the total
cost of the improvements and the amount assessed against any parcel shall not be
greater than the benefits accrued thereto from said improvements.
3. The assessments against any parcel may be paid according to the
provisions of Section 25-83 through 25-89 of the Oshkosh Municipal Code.
4. The governing body determines that the improvements constitute an
exercise of the police power for the health, safety, and general welfare of the
municipality and its inhabitants.

5. The Board of Public Works is directed to prepare a report consisting of:
(a) Final plans and specifications for said improvements.
(b) An estimate of the entire cost of the proposed work or
improvements.
(c) An estimate as to each parcel of property within the assessment
district of:
(1) The assessment of benefits to be levied for each
improvement.
(2) The damages to be awarded for property taken or damages
by each improvement.
(3) The net amount of benefits over damages or the net amount
of damages over benefits for each improvement.
(4) The total assessment against each parcel
Upon completion of such report, the Board of Public Works is directed to file a copy
thereof in the City Clerk's Office for public inspection.
6. Upon receiving the report of the Board of Public Works, the City Clerk is
directed to give notice of a public hearing on such reports as specified in Section
66.0703(7)(a) of the Wisconsin Statutes. The hearing shall be held before the Common
Council at the Council Chambers, Room 406 in the City Hall at a time set by the Clerk in
accordance with the Wisconsin Statutes. The assessment against any parcel may be
paid in cash, paid with the first property tax installment, or in ten (10) installments if the
total amount of the assessment is greater than five hundred dollars ($500.00) or fifteen
(15) installments if the total amount of the assessment is greater than one thousand
dollars ($1000.00).
7. The installation of said street improvements shall be accomplished
according to the provisions of Section 253 through 25-11 of the Oshkosh Municipal
Code.

Public Works Department, the fnal amount (quantities and costs) of the special
assessment against your property or properties will be mailed to you. At that time you will
also receive the paperwork to select a payment choice for the special assessments.
PAYMENT CHOICE OR PAYMENT IS NOT ACCEPTED AT THIS TIME.

If after making this selection, the property owner fails to make payment to the City
Treasurer; the entire amount including interest will be placed on the neut property tax bill.

Property owners may elect to pay 100% of the assessment on the next designated real
estate property tax bill, without interest. The total amount of the assessment will be
