Roskom, Principal Planner; Patricia Wendorf, Recording Secretary Chairman Slover called the meeting to order at 3: 30 P.M. Roll call was taken and a quorum declared present. Motion by Husman for approval of the March 17, 1993 minutes as distributed; Seconded by Slover. Motion carried 4-0. Chairman Slover informed the applicants that 4 affirmative votes are required to approve a variance; if 3 affirmative votes, the item will be laid over; less than 3 affirmative votes, the item is denied. He also explained the process for obtaining building permits, if the variance is approved, or the appeal process, if the variance is denied. II. 913/917 WINNEBAGO AVENUE - Kurt S. Johnson, owner/applicant Kurt S. Johnson, owner/applicant, is requesting a variance to create two substandard lots. Lot 1, located at 917 Winnebago Avenue is proposed to be 57 ft. x 87 ft. ford a total area of 4,959 sq. ft. with Lot 2, located at 913 Winnebago Avenue, proposed to be 47 ft. x 87 ft. for 4, 089 sq. ft. of total area; whereas Section 30-16 (B) (1) (g) Lot Area of the R-2 Two Family Residence District of the City of Oshkosh Zoning Ordinance requires that any newly created lot have a minimum width of 60 ft. , a minimum depth of 100 ft. , and a minimum lot area of 7, 200 sq. ft. Mr. Johnson gave a brief history of the property in question and reiterated his variance request noting that he wished to move the lot line of the two properties, thereby subtracting 3 ft. from 917 Winnebago Avenue & adding the 3 ft. to 913 Winnebago Avenue. Mr. Schorse stated he was under the impression there was a driveway there at present and Mr. Johnson stated there is a driveway which overlaps both properties and he wished to move the lot line 3 ft. from 917 to 913 Winnebago Avenue to have the driveway on one parcel of land. At the time the driveway was developed, they were not aware that the driveway encroached the lot line. Mr. Dellantonia inquired if his understanding was correct that the driveway is there presently which overlaps two properties and it is intended to give the driveway to a single lot and Mr. Johnson indicated that was correct. Motion by Dellantonia to approve the variance as requested. Seconded by Slover. Motion approved 4-0. As to the Findings of Fact, Mr. Slover stated that the request to move the lot line for a total of 3 ft. , would appear to be the minimum variance required to satisfy the owner/applicant's intent. There is no viable alternative for placement of that driveway.
