P�RPOSE: APPROVE DEVELOPER AGREEMENT - VARIOUS SUBDIVISIONS
INITIATED BY: DEPARTMENT OF PUBLIC WORKS
BE IT RESOLVED by the Common Council of the City of Oshkosh Lhat the
attached �eveloper Agreements for Kaitlynn Plat (Lots 14 thru 29) , Second
Addition to Flora Kuhn Krueger Plat (Lots 49-60) and Westhaven Circle Plat
(LOts 1-27) are approved and the proper City officials are authori�2d and
directed to execute ihe proper agreements.

AMENDMENT TO DEVELOPER 'S AGAEEMENT
THIS AMENDMENT is made to a certain developer's agreement ,
dated July 7 , 1988� for financing improvements in Kaitlynn Plat
recortletl July 13 . 1988, at 2:30 p.m. in the Winnebago County
Aegistry in Volume 15uC of LIS Pendens on page "0" as tlocument
numDer 704916 . �
WHEREAS, the City of Oshkosh has heretofore approved an
agreement whereby the developer of Kaitlynn Subplat would prlvately
install certain publie lmprovements and pay for staking and
insDection services in Dhase one of Lhe development and would
utilize City contractors for phase two; and
WHEREAS� the developer noW tlesires to privately install certain
puDlic Improvements in phase two of the development in consideration
for the City waiving all staking and inspectlon service fees in
phase one and englneering fees in phase two;
NOW� THEREFORE, IT IS HEREBY AGREED Lo by and between the City
of Oshkosh, a municipal corporatlon locatetl in Winnebago County ,
Wisconsin ("City") and Kurt and Judith Koeppler ("OWNEA") , in
reliance on the reprsentations and covenants made herein� that the
developer agreement referretl to above is amended as follows :
1 . Owner shall intall � at no expense to the City , the
following improvements in Dhase two of the development :
KAITLYNN SUBPLAT � LOTS 14-29
Sanitary Sewer Storm sewer
Water Main Grading 6 graveling
Laterals
2. CSty shall waive staking and Snspection service fees for
phase one and engineering fees for phase two .
3• Owner deslres installation by City , pursuant to the
financing terms in the origlnal agreement dated July 7 � 1988, of
conerete paving antl sidewalk in Kaitlynn Subdivision .

being true antl correct� are incorporated by reference as if fully
stated herein .

, DEVELOPEA ' S AGREEMENT
FOR FINANCING IMPROVEMENTS
THIS AGREEMENT is made pursuant to Section 66 .60( 1D) of the
Wisconsin Statutes providing for levying and assessing the cost of
various improvements to the property herei❑ described .
WHEREAS, the Common Council of the City of Oshkosh approvcd
initial and final resolutions pursuant to Section 66.60 of the
Wisconsin Statutes upon execution and approval of a waiver,
executed by the undersigned , owner of property herein described , o£
special assessment notices and hearing � and
WHEREAS, the undersigned owner has heretofore agreed , in
consideration of installation of various improvements , to pay the
full cost of such improvements and related costs through. special
assessment financing pursuant to Sectio❑ 25-83 and 25-89 of the
Oshkosh Municipal Code upon certification by the City Engineer for
the City of Oshkosh that said improvements have been completed ; and
WHEREAS, the Common Council of the City of Oshkosh by resolu-
tion adopted May 4 , 1989 , authorized and directed the proper City
oFficials to enter into an appropriate agreement with the under-
signed owner to provide for full payment by the undersigned owner of
said improvements and related costs;
NOW, THEREFOPE, IT IS HEAEHY AGREED to by and between the City
of Oshkosh� a municipal corporation located in Winnebago County ,
Wisconsi❑ ("CITY") and ELVA IDA HINTZ AND SHIPLEY MAE JUEDES,
("OWNER") � in reliance on the representation and covenants made
herei�, as follows:
1 . Owner covenants and warrants that it is the owner of all.
property described as follows :
SECOND ADDITION TO FLOAA KUHN KRUEGEP PLAT (LOts 49-60 )
2. Owner has requested installation by City of various
improvements to said property described as follows :
Sanitary Sewer Grading & Graveling
Sanitary & Water Laterals Co�crete paving
Water Mai� Concrete Sidewalk
Storm Sewer Engineering Services
3. City � or its designee, shall cause such improveme�ts to be
installed according to the plans and specifications of the City
Engineer .
4. Special assessments may be paid by Owner in cash , or in
installments pursuant to Section 25-83 and 25-89 of the Oshkosh
Municipal Code in which case such deferred payments are to bear
interest at the rate of ten percent ( 10$) Ger a�num o❑ the unpaid
balance .

5• The attached exhibit , acknowledged by City and Owner aa
being true and correet , is incorporated by reference as if fully
stated herein .
EXHIHIT "A" - Waiver of Special Assessment Notices and

6. Owner, immediately upon voluntary divestiture of title to
any of the property heretofore described , shall fully pay the
outstanding assessments against the particular parcel subjeet Co
divestiture. Divestiture shall mean the tra�sfer of legal title
providing owner does ❑ot retain any lien or mortgage interest in
such parcel . In the event owner retai�s a lien or mortgage
interest in such parcel , the assessments shall be paid in full
within one ( 1) year from the date of sale. In the event' owner
sells by land contract , the assessments shall be paid in full
within one � 1) year from the date of the land contract.
7 . Any refund which may be due Owner as a result of any
special assessment being in excess of the actual amount paid by
City for said improvements is assignable by Owner .
8. This Agreement and its attachments , may be recorded at
City's option and if so done , shall serve as Notice of Lien against
such properties .
IN WITNESS WHEAEDF , the parties heretofore have caused Lhis
Agreement to be signed by the proper persons of each parCy and
their corporate seals , if any � to be hereunto affixetl .
