Section 1 of T17N, R16E, 14th Ward, City of Oshkosh, Winnebago County, Wisconsin containing 22.102 acres of land, rrore or less, and being described by: Cortmencing at the N 1/4 corner of said Frac. Section l; thence N 89-52- 27 E 715.18 ft., along the N line of said Goverrunent Lot 1 to the true point of beginning; ruruzing thence S 09-20-28 E 224.37 ft.; thence N 89-52-27 E 120.00 ft.; thence S 09- 20-28 E 200.00 ft.; thence S 89-52-49 W 250.21 ft.; thence N 09-20-28 W 150.00 ft.; thence S 89-52-27,W 157.77 ft., to a point on the centerline of U.S.H. "45"; thence S 09-20-28 E 833.89 ft., along the centerline of U.S.H. "45"; thence Sly 307.87 ft., along the arc of a curve to the right being the centerline of U.S.H. The afore described being subject to an ease�nent for the purpose of ingress and egress as recorded in Vol. 1032 on Page 628 and in Vol. 1020 on Page 469 of Records in the Winnebago Ccu�nty Registry. "45") BE IT FURTHER RESOLVED that approval of the Preliminary Plat known as Old Orchard Subdivision is contingent upon the following: SCtBMITTED BY �''�Z�L��i� - 23 - a��o�rEr� JULY 6, 1989 #173 RESOLUTION (cont'd) 1) Payment of park fees in lieu of parkland dedication of $100 per lot prior to final plat approval. 2) A covenant be placed on the face of the final plat requiring a $100 per unit fee in lieu of parkland dedication. 3) That a grading and drainage plan be submitted and approved prior to final plat approval. 4) The developer be responsible for all capital improvement costs incurred by this development. 5) . A covenant be placed on the face of the final plat relative to storm drainage and grading plan pursuant to Section 30-69(H) of the City of Oshkosh Subdivision Ordinance. 6) A plan to provide a 60 ft. right-of-way in the southeast corner of the plat be submitted and approved prior to the submittal of the final plat. 7) Permanent zoning be assigned prior to the submittal of the final plat. 8) The structure on Lot 23 and within the proposed right-of-way for Old Orchard Court be removed within 6 months of final plat approval. 9) The street name Old Orchard Court must be changed and a new street name submitted and approved prior to the submittal of the final plat. - 24 - � .
