PURPOSE: APPROVE ACCEPTING EASEMENTS; EAST SIDE OF THE 4300
BLOCK OF JACKSON STREET, SOUTH OF JACKTAR AND
SODA CREEK ROADS
INITIATED BY: PREMIER SODA CREEK, LLC
PLAN COMMISSION RECOMMENDATION: Approved
WHEREAS, Premier Soda Creek, LLC is requesting acceptance of the following
easements by the City of Oshkosh for the proposed Soda Creek Estates development:
Easement #1 – 20-foot storm sewer easement extending from the Soda Creek right-of-
way to approximately 286 feet south to the north edge of the proposed pond
maintenance easement (Easement #2).
Easement #2 – Pond maintenance easement for access to proposed detention pond.
The proposed easement is187.35 feet by 390.45 feet (73,151 square feet or 1.68 acres)
located near the center of the proposed development.
Easement #3 – 40-foot pedestrian and drainage easement extending from the east line
of the subject property west approximately 470 feet to the Soda Creek Road right-of-
way. This easement will be used for storm water drainage as well as pedestrian access
to Winnebago County Park to the east.
Easement #4 – 40-foot storm sewer and drainage easement located near the center of
the east property line extending west approximately 210 feet to the proposed pond
maintenance easement (Easement #2).
Easement #5 – 30-foot drainage easement extending adjacent to and parallel to the
east line of the property approximately 666 feet for drainage purposes.
Easement #6 – 15-foot drainage easement located parallel and adjacent to the south
line of the subject property approximately 724 feet for storm water drainage purposes.
Easement #7 – 12-foot utility easement located along the southerly right-of-way line of
Soda Creek Road for public and private utility purposes.

Easement #8 — 12-foot sanitary sewer and water main easement located along the west
property line approximately 327 feet for installation of City sanitary sewer and water
main.
Easement #9 — 35-foot drainage easement located along and parallel to the south line
of the subject property extending approximately 222 feet from the east property line for
storm water drainage purposes.
NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of
Oshkosh that the proper City officials are hereby authorized and directed to accept
easements on the east side of the 4300 block of Jackson Street, south of Jacktar and
Soda Creek Roads from Premier Soda Creek, LLC as noted above and per the
attached, and to execute any and all documents necessary for purposes of same.

BACKGROUND
The subject site consists of three vacant lots with a total area of 16.94 acres located at the
4300 block of Jackson Street, north of Kope Avenue and south of the terminus of Soda Creek
and Jacktar Roads. In 2013 a planned development was approved to construct a multi-family
development (Soda Creek Estates) on the subject site. The areas surrounding the subject
site include multi-family uses to the north, single-family to the south and west,
government/institutional to the west and a county park to the east.
ANALYSIS
The petitioner is requesting acceptance of nine easements by the City for the proposed Soda
Creek Estates development. All of the easements are located within the proposed Soda
Creek Estates Multi-Family Housing Development site located at the 4300 block of Jackson
Street and south of Jacktar and Soda Creek Roads. The nine easements requested are for
storm sewer, detention pond maintenance, pedestrian and drainage, utilities, and sanitary
and water main connections. The Department of Public Works is preparing the pertinent
documents for the acceptance of the requested easements which will be recorded at the
Winnebago County Register of Deeds.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of the request at its April 21, 2015 meeting.

Premier Soda Creek, LLC is requesting acceptance of nine easements by the City of Oshkosh for

ANALYSIS
The proposed Soda Creek Estates development will require the City's acceptance of nine
easements for various purposes (see attached map).
Easement#1 —20-foot storm sewer easement extending from the Soda Creek right-of-way
to approximately 286 feet south to the north edge of the proposed pond maintenance easement
(Easement#2).
Easement#2 —Pond maintenance easement for access to proposed detention pond. The
proposed easement is187.35 feet by 390.45 feet (73,151 square feet or 1.68 acres) located near the
center of the proposed development.

The Department of Public Works is coordinating the preparation of pertinent documents for the
acceptance of the requested easements and will be recorded at the Winnebago County Register of
Deeds.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the acceptance of the nine proposed easements as requested.
The Plan Commission approved of the acceptance of the proposed easements as requested. The
following is the Plan Commission's discussion on this item.
Item —Accept Easements 4300 blk Jackson St 2
Mr. Slusarek presented the items and reviewed the site and surrounding area as well as the land use
and zoning classifications in this area. He also reviewed the approved site plan far the
development which was approved in 2013. He explained the history of the easements requested to
be released and stated that the changes in the site layout are the reason for the request to release
current easements and the acceptance of new easements. He also reviewed the site plan depicting
the five easements to be released and the nine new easements requesting to be accepted. He
further stated that the Department of Public Works has reviewed both requests and are preparing
the appropriate documents which will be recorded at the Winnebago County Register of Deeds.
Mr. Thoms commented that since this is private land, what is the purpose of the acceptance of
Easement#2 which is for pond maintenance. He questioned if maintenance of the detention pond
would be the responsibility of the City or the developer.
Mr. Burich responded that the easement was in the event that the City would have to access the
detention pond area.
Steve Gohde, Assistant Director of Public Works, added that the developer is responsible for
maintenance of the detention basin however the City needs to have the ability to have access to
this area if necessary.
Mr. Gray commented that the planned development approved in 2013 appears to have some design
changes and questioned if the planned development would need to be amended.
Mr. Buck replied negatively and stated that there were no significant changes to the planned
development that would require amendment to the previously approved plans.
Motion by Vajgrt to approve the release and acceptance of easements for property located
at the east side of the 4300 block of Jackson Street, south of.Iacktar and Soda Creek
Roads.
Seconded by Nollenberger. Motion carried 7-0.
