PURPOSE: APPROVE RELEASING EASEMENTS; EAST SIDE OF THE 4300
BLOCK OF JACKSON STREET, SOUTH OF JACKTAR AND
SODA CREEK ROADS
INITIATED BY: PREMIER SODA CREEK, LLC
PLAN COMMISSION RECOMMENDATION: Approved
WHEREAS, Premier Soda Creek, LLC is requesting the following existing City
easements to be released to allow for City acceptance of new public easements to
accommodate proposed Soda Creek Estates.
Easement #1 – 10-foot storm sewer and drainage easement located 327 feet west of
and parallel the east lot line beginning at the north property line heading south
approximately 390 feet.
Easement #2 – 25-foot storm sewer and drainage easement located 317 feet west of
and parallel the east lot line beginning at the north property line heading south
approximately 370 feet, then curving to the east down to the south property line.
Easement #3 – 10-foot storm sewer and drainage easement located approximately 80
feet south of and parallel the north lot line beginning at the west edge of Easement #1
heading west approximately 240 feet.
Easement #4 – Storm water detention easement located at the southeast corner of the
subject property. The easement was proposed to be used for construction of a storm
water detention basin for Parkview Heights Subdivision.
Easement #5 – 8-foot wide public access pedestrian easement located along the south
lot line of the subject property beginning at the southeast corner of the property heading
west approximately 180 feet. The easement was proposed to allow for pedestrian
access to the Winnebago County Park trail system.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Oshkosh that the City hereby releases easements at the east side of the 4300 Block of
Jackson Street, South of Jacktar and Soda Creek Roads, as noted above and per the
attached, and the proper City officials are authorized and directed to execute any and all
documents necessary for purposes of same.

BACKGROUND
The subject site consists of three vacant lots with a total area of 16.94 acres located at the
4300 block of Jackson Street, north of Kope Avenue and south of the terminus of Soda Creek
and Jacktar Roads. In 2013 a planned development was approved to construct a multi-family
development (Soda Creek Estates) on the subject site. The areas surrounding the subject
site include multi-family uses to the north, single-family to the south and west,
government/institutional to the west and a county park to the east.
ANALYSIS
The subject easements were accepted by the City as part of the Parkview Heights Plat which
received preliminary plat approval by the Common Council in 2001 and final plat approval by
the Plan Commission in 2002. The final plat did not proceed to the Common Council for final
action however the subject easements were recorded at the Winnebago County Register of
Deeds based on the preliminary plat approval. Since that time, a new development plan is
being proposed making the recorded easements no longer necessary due to changes to the
site layout. The five existing easements requesting to be released are for storm sewer and
drainage, storm water detention, and a public access pedestrian easement. The Department
of Public Works is preparing the pertinent documents for the release of the existing
easements and will be recorded at the Winnebago County Register of Deeds.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of the request at its April 21, 2015 meeting.

Actions Requested:
Premier Soda Creek, LLC is requesting the following existing City easements to be released to
allow for City acceptance of new public easements to accommodate proposed Soda Creek Estates.
All requests are located within the proposed Soda Creek Estates Multi-Family Housing
Development site located at the 4300 block of Jackson Street.

ANALYSIS
The subject easements were accepted by the City as part of the Parkview Heights Plat which
received preliminary plat approval by the Common Council in 2001 and final plat review approval
by the Plan Commission in 2002. The final plat did not go before the Common Council for final
action. The subject easements based on the preliminary plat approval were recorded at the
Winnebago County Register ofDeeds at various times between 2002 and 2005. Since then, a new
development plan is being proposed making the recorded easements no longer necessary due to
changes to the site layout.
This request involves the release of five existing easements previously granted for varying
purposes (see accompanying map).
Easement#1 — 10-foot storm sewer and drainage easement located 327 feet west of and
parallel the east lot line beginning at the north property line heading south approximately 390 feet.
Easement#2 —25-foot storm sewer and drainage easement located 317 feet west of and
parallel the east lot line beginning at the north property line heading south approximately 370 feet,
then curving to the east down to the south property line.
Easement#3 — 10-foot storm sewer and drainage easement located approximately 80 feet
south of and parallel the north lot line beginning at the west edge of Easement#1 heading west

The Department of Public Works is coordinating the preparation of pertinent documents for the
release of the easements and will be recorded at the Winnebago County Register of Deeds.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the release of the five easements as requested.
The Plan Commission approved of the release of the easements as requested. The following is the
Plan Commission's discussion on this item.
Mr. Slusarek presented the items and reviewed the site and surrounding area as well as the land use
and zoning classifications in this area. He also reviewed the approved site plan for the
development which was approved in 2013. He explained the history of the easements requested to
be released and stated that the changes in the site layout are the reason for the request to release
current easements and the acceptance of new easements. He also reviewed the site plan depicting

the five easements to be released and the nine new easements requesting to be accepted. He
further stated that the Department of Public Works has reviewed both requests and are preparing
the appropriate documents which will be recorded at the Winnebago County Register of Deeds.
Mr. Thoms commented that since this is private land, what is the purpose of the acceptance of
Easement#2 which is for pond maintenance. He questioned if maintenance of the detention pond
would be the responsibility of the City or the developer.
Mr. Burich responded that the easement was in the event that the City would have to access the
detention pond area.
Steve Gohde, Assistant Director of Public Works, added that the developer is responsible for
maintenance of the detention basin however the City needs to have the ability to have access to
this area if necessary.
Mr. Gray commented that the planned development approved in 2013 appears to have some design
changes and questioned if the planned development would need to be amended.
Mr. Buck replied negatively and stated that there were no significant changes to the planned
development that would require amendment to the previously approved plans.
Motion by Vajgrt to approve the release and acceptance of easements for property located
at the east side of the 4300 block of Jackson Street, south of Jacktar and Soda Creek
Roads.
Seconded by Nollenberger. Motion carried 7-0.
