HomeMy WebLinkAbout13. 15-209 APRIL 28, 2015 15-209 RESOLUTION (CARRIED___7-0___LOST________LAID OVER________WITHDRAWN________) PURPOSE: APPROVAL OF PURCHASE OF WETLAND MITIGATION CREDITS TH FOR THE 9 & WASHBURN AREA STORMWATER DETENTION BASIN FROM WISCONSIN WETLAND CONSERVATION TRUST ($406,870.00) INITIATED BY: PUBLIC WORKS DEPARTMENT th WHEREAS, construction of the 9 & Washburn Area Storm Water Detention Basin will impact 4.6 acres of wetlands; and WHEREAS, when wetlands are impacted by these types of projects the Department of Natural Resources requires some form of mitigation be undertaken; and WHEREAS, one option for mitigation is the purchase of wetland mitigation credits from the Wisconsin Wetland Conservation Trust (WCCT); and WHEREAS, the Wisconsin Department of Natural Resources and the United States Army Corps of Engineers have determined that purchasing credits through this program is an acceptable option for mitigating the unavoidable impacts to wetlands at this site. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that the appropriate city officials are hereby authorized and directed to purchase mitigation credits through the WDNR’s recently approved “In-lieu Fee Program” for the purpose of complying with the wetland mitigation requirements for the project located in the th 9 & Washburn area. BE IT FURTHER RESOLVED that the proper city officials are hereby authorized to take all necessary actions to purchase such credits, to report to the Department of Natural Resources and Army Corps of Engineers regarding the same and to take any other necessary and reasonable action to comply with the requirements for wetland mitigation for th the 9 & Washburn Area Storm Water Detention Basin project. Gohde, Assistant Director of Public Works s� DATE: April 23, 2015 RE: Approval of Purchase of Wetland Mitigation Credits for the 9th&Washburn Area Storm Water Detention Basins from Wisconsin Wetland Conservation Trust/$406,870 BACKGROUND The 9th & Washburn Area Wet Detention Basin project requires mitigation of impacts to wetlands. There are currently no mitigation credits available from wetland mitigation banks. Therefore, the Department of Natural Resources (WDNR) has authorized the City of Oshkosh to purchase credits from the Wisconsin Wetland Conservation Trust (WCCT). The purchase of wetland mitigation credits through the WCCT is more commonly referred to as the "In-lieu Fee Program". The WDNR and the United States Army Corps of Engineers have determined that purchasing credits through this program is an acceptable option for mitigating the unavoidable impacts to wetlands at this site. ANALYSIS During the design of the 9th & Washburn Area Wet Detention Basin, it was determined that in order to meet appropriate design standards for the detention basin, there would be an unavoidable impact to 4.60 acres of wetlands. During the permitting process, it was determined that the City would mitigate these impacts through the purchase of mitigation credits through the WDNR's recently approved "In-lieu Fee Program" rather than performing onsite mitigation. FISCAL IMPACT The purchase of these mitigation bank credits will cost $406,870. Funds for this project are included in the Storm Water section of the 2015 Capital Improvement Program.
