HomeMy WebLinkAbout35581 / 89-320 I October 19, 1989 #320 RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE AGREEMENT WITH WINNEBAGO COUNTY/911 SYSTEM INITIATED BY: CITY ADMINISTRATION WHEREAS, Section 146 . 70(9) of the Wisconsin Statutes requires the City of Oshkosh to enter into a Joint Powers Agreement with Winnebago County, and WHEREAS, the City has reviewed said Joint Powers Agreement provided by Winnebago County, NOW, THEREFORE, BE IT ESOLVED by the Common Council of the City of Oshkosh that the Joint Powers Agreement providing for basic and sophisticated gll System in Winnebago County as amended is hereby approved and the proper City officials are hereby authorized and directed to enter into the said Joint Powers Agreement . APPROVFD L��/�� - 12 - ' Res. #320 JOINT POWERS AGREEMENT Re: Winnebago County Basic and Sophisticated 911 System Between Winnebago County and City of Oshkosh Dated: WHEREAS, Winnebago County and the municipalities located within the boundaries of Winnebago County have been operating a Basic 911 System in the County and will be implementing a Sophisticated 911 System on or about September 1 , 1990 , all for the purpose of providing emergency services to residents of these municipalities , including fire fightinq, law enforcement , ambulance, medical , and other emergency .services; and WHEREAS, a photocopy of sec . 146 . 70 Wis . Stats . as amended from time to time since its original effective date of May 24 , 1978 entitled , " State-Wide Emergency Services Number " , is attached hereto and by reference is made a part hereof , together with all such future amendments; and WHEREAS, Sec . 146 . 70 (9) , "Joint Powers Agreement, " requires that in implementing a Basic or Sophisticated System as has been done and will continue to be done in Winnebago County , municipalities shall annually enter into a joint powers agreement, which agreemen� shall be applicable on a daily basis and which shall provide that if an emergency services vehicle is dispatched in response to a request through the Winnebago County system, such vehicle shall render its services to the persons needing the aid. THEREFORE , in consideration of the mutual promises , agreements, and conditions contained herein, it is hereby - 12a - ' Res. #320 jointly agreed between Winnebago County and the City of Oshkosh, hereinafter referred to as "municipality", as follows: l. That the agreement shall be effective immediately upon its execution as to the Basic 911 System presently in operation in Winnebago County and shall continue to be applicable on a daily basis until the Sophisticated 911 System becomes operational in Winnebago County, the anticipated date of which is September 1, 1990; that the agreement shall continue to be applicable on a daily basis when the Sophisticated 911 System becomes operational ; that this agreement shall renew automatically at each succeeding anniversary date, which for purposes of this agreement shall be August 31st of each year, unless either party hereto in writing notifies the other party, not less than thirty (30) days prior to any succeeding anniversary date, that such party will not be renewing this agreement. 2 . That if an emergency services vehicle operated by the muncipality, or operated by an agency with which the municipality contracts for that particular emergency service, is dispatched in response to a request through the Basic or Sophisticated 911 System in Winnebago County, such vehicle (whether owned and operated by the municipality or by the agency) shall render its services to the persons needing the services, regardless of whether the vehicle is operating outside the vehicle's normal jurisdictional (or as defined by contract) boundaries. In the event jurisdictional uncertainty causes a vehicle to be dispatched outside the normal boundaries, the dispatched vehicle shall render aid until such time as the jurisdictional agency can reasonably respond. The City of Oshkosh reserves the right to assign its resources and will not allow its equipment or personnel to leave its boundaries when such action might 2 - 12b - ' • ReS. #32� jeopardize the safety of its citizens. The parties hereto specifically agree that it is not the intent of this Agreement to provide non-jurisdictional emergency vehicle dispatching from the 911 Communication Center. 3 . A User Committee will be established to serve in an advisory role to the 911 Communications Center operation. Membership on the User Committee shall consist of sixteen (16) representatives from the following: Cities of Menasha, - Two (2) representatives (one Neenah and Oshkosh (1) from Police Department and and Town of Menasha one (1) from Fire Department City of Omro and - One (1) representative (from Village of Winneconne Police Department) Winnebago County - One (1) representative Sheriff's Department Rural Fire Department - One (1) representative Winnebago County - One (1) representative Emergency Government UW-Oshkosh - One (1) representative Winnebago County Board - Two (2) representatives of Supervisors 4 . That a copy of this agreement shall be filed with the State Department of Justice and the State Department of Administration, as required by Section 146.70 (9) (c) , Wis. Stats.
