NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh, that the attached Downtown Oshkosh Business Improvement District Final 1990 Operating Plan is hereby approved and adopted. We have a new hotel and Convention Centre, a restored Grand C)pera Houre, streetscaping on the 40C1 Block, new municipal bus transfer center, Walkway East improvement project, as well as a number of awning projects which improved building facades downtown. Proje�ts currently in the early stages of development include a 200-3C1C► Bloeks of Main Street streetscaping project, which will add decorative lighting, landscaping and new sidewalks, and the redevelopment of the 1UC� Block of Main Street for an upscale office develapment . Reali�ing that it takes more than just physical improvements to maintain an active and economically viable downtown, business peaple and property owners petitioned the City to create the Downtown C)shkosh Business Improvement District (BID) . Established by the Common Council in November, 1987, the BID"s goals were to implement free parking, increase promotion and marketing, and enhance business recruitment efforts . Under the direction of the BID Board, movement towards the achievement of these goals was undertaken. 199C1 will see the continuance of free parking downtown, with the cooperation of the Gity Parking Utility, and continuance of tele-marketing campai�n by UCDC for business recruitment, with contributions by the BID. The BID also financed a downtown �lean up pro,�ect and co-sponsored the Concerts in the Park program, which was held at Riverside Park located downtown. While it is difficult to ,�udge the overall success of the BID, there are indications of a continued positive trend. In the Spring of 1989 , a two day Strategic Planning Session was held to identify the Business Improvement Distriet.'s strengths and weaknesses and to set goals and ob,jectives to act as a guide in order to continue the positive trends which began in 1987 when the BID was created. For 1990 , the BID has contracted with OCDC to implement some of the BID programs as identified by the Uperating Plan . In the City's downtown, there were a total of S new businesses and 15 relocated ar expanded businesses , with two buildings currently being renovated. The assessed value of the properties in the BID decreased during 1989 . The decrease was primarily due to properties being removed from the assessment roll . These properties are either slated for redevelopment or for parkin� lot development. However, had these properties not been removed from the assessment rolls , the BID would have shown a net gain in assessed value in 1989 . In order to maintain what is seen as positive improvements in the downtown, the BID Board has prepared this 199U Operating Plan for submittal to the OshkoBh C�mmon Council . - 24c - - Res. #398 . 2 T�iE. B�I2 IrAit Qn April 6 , 1984 , the State of Wisconsin passed a law (Act 184) which allows for the creation of Business Impravemeilt Districts . The purpaae Qf the law is to authoriae citi.es, villages , and towns t� create one or more business improvement districts to allow businesses within those districts ta v ��p. manage. maintain. �. promote their districts and to establish an assessment method to fund these activities . A BID must be a geographic area within a municipality consisting of contiguous parcels which are subject to real estate taxes . The formation of a Uusiness improvement district allows downtowners (business people, property owners , merchants , City officials and others) , to figure out what needs to be done to upgrade and strengthen downtown and to pay the cost of doing it, in whole or in part. It is a way for downtowners to decide what they want and to finance it . A BID is the best available method for business pe�ple to organize, coordinate marketing and promotion efforts , provide management and maintenance programs , and encourage bixsiness �evelopment . It affvrds prQperty owners and busineas people a very real role in direating those affaira within the district which influence their investment and environment. '�:� , Res. #398 � 4 1990 QPERATING �1I I . ORGANIZATION Pursuant to Section 66 . E►5(3) , Wis . Stats . , a Downtown Business Improvement District Board has been appointed by the City Manager and confirmed by the Common Couneil . The Board is comprised of 9 members representing the following interests � 2 Non-OwnPr �ccupants : --1 retailer --1 service provider 2 Non-accupant C�wners : --1 retailer --1 service provider 4 Owner 4ccupants : --2 retailers --2 service providers 1 Person-At-Large In addition, Board members represent different areas within the District, as well as larg�e and small businesses . As a City entity, the Board will conduct its affairs under the open meeting law and public record requirements . The Director of Community Develapment or his designee serves as th� Secretary of the Board . BID Board meetings are held the third Tuesday of the month in Room 2�4 of City Hall . A roster of the 1990 BID Board members is included as Appendix D. The Board will be responsible for the management of the Buainess Improvement District. Responsibilities of the Board include implementing the operating plan and preparing annual reports on the District. The Board will also annually consicter and make changes to the operating plan and submit the operating plan to the Commman Councii far approval . City staff will be assisted by the C)shkosh Commercial Development Corporation (OCDC) in the d�velopment and implementation of BID program activities . II . OPERATIONS During 1990 , the Dawntown �shkosh Business Improvement District will carry out the praposed program of activities listed on the following pages . Included are the expenditures associated with each activity. These projected costs include all services related to program development, materials and management . - 24f - Res. #398 5 PROPOSED 1990 �IIZ PROGRAM�BODGET = DOWNTOWN OSHKOSH PROGRAM ACTIVITITS EXPENDITDRES I . Free Short Term Parking Subsidy $ 45, f1t)(►. 00 A. Reimburse City Farking Utility for loss of parking meter revenue in rzturn for establishing fre� ahort term parkin� in accordance with the Parking Agreement between the BID and the City. OBJSCTIVT: Alleviate customer concern about plug�ing meters and having correct change, etc. , to encourage longer shopping time, convenience in conductin� business transactions and establ.ishing better public relations . II . Business Recruitment $ 7 , 5C1C1 . 00 A. Maintain l�asing packet for �owntown area. OBJSCTIVB: Ta provide necessary economic/market data and available space information to prospective businesses considering a downtown location. B. Tar�eted business prospect d�velopment (consists of, but not limited ta, in- person and telephone business recruitments , mailings , advertibements , travel expenses , prospect accommodations, tar�eted promotions) . OBJECTIVE: To fill vacant retail and office space in providing needed goods and services not available downtown or in Oshkosh, which in turn generates additional commercial traffic for existing downtown busin�sses . - 24g - Res. #398 6 EXPENDITURES III . Marketing/Promotion $ 5 , 500 . p0 A. Implement a m�rketing �trategy t,o promote and enhance downtown businesses images . OBJgCTIVS: Devel�p effective ways to attract additional downtown business patronage. Consideration will be given to sponsorin� summer concert� , making storefrants and �isplay� m�re attractive, coordinated cleaning efforts, and ot,her activities to improve the image of downtown. B. Maintain business directory - includes all business listings with map indicating free parking areas , long term parking and public facilities . OBJBCTIVg: To inform downtown business people, customers , clients , C)shkosh community and visitors what goads and services are available downtown, where to find them, and the mast convenient place to park . IV. BID Management $ 12, �00 . 00 A. Funds to be used to contract with an agency to assist the BID Board in achieving goals and ab�ectives established by the BID in conformance with the Qperatin� Plan. The City has been actively implementing physical elements of the Plan by constructing new convention centre and hotel facilities, making infrastructure and streetscape improvements , assisting in building rehabilitation. The Plan also recommended increasing organi2ational efforts between the public and private sectors as well as establishing a voluntary special assessment district. A follow-up study, Planning Report - Central City Oshkosh, approved by the Common Council in 1987 , expanded various elements of the previous plans and in particular recommended the creation of a management vehicle and funding base t� serve the downtown area. The management tool recammended was a Business Improvement District . The Downtown Oshkosh Business Improvement District (BID) is consistent with and critical to the continued successful implementation of these downtown plans . The BID enables the private sector to undertake promotian, management, marketing, and other programs essential to a prosperous downtown . �Ip ASSfiSSMENT j�$�'HOD The City of Oshkosh Downtown Business Improvement District (BID) special assessment method utilizes assessed value information and property street footage data, both of which are available from the City Assessor's Office. As the absolute values of ass�ssed value and foota�e cannot be combined, the values are calculated as a percentage of the total assessed value and a percentage of the street footage . The two percentages are added with the sum divided by �C)C1 percent, which results in a proportionate value of the total district. A property"s proportionate value of the tota� District is multiplied by the District budget, resulting in the special ass�ssment for the property. The raw data, assessment calculations , and proposed District assessment for each property in the Downtown Susiness Improvement District, are presented on the following pages . The data for the assessment method have� been obtained from the files of the City Assessor and are subject to final taUulation by the City. To account for street footages , ranging from very short frant footages to entire blocks , the footage was computed in a manner similar to the City's normal special assessment methodology. Property used for commercial and manufacturin� purposes in the District will be assessed. I have also reviecaed the operating plan subr�itted for Business Improvement District #1 for downtown Oshkosh, and I have reviewed this specifically with regard to Wis . Stats. Sec. 66. 608 (1) (f) 5 which calls for a legal opinion as to certain requirements being made for an operating plan. It is my opinion that the plan which has been adopted does provide for a special assessment method and that said method will include manufacturing premises. It is fur- ther my opinion that the expenditures have been listed and that a time for making said expenditures, at least initially, has been set forth. The operating plan certainly describes why and hvw the BID will promote the orderly development of the municipality and specifically relates this plan to the central business district plan.
