PURPOSE: ADOPT STATE FIRE PREVENTION CODE
INITIATED BY: FIRE DEPARTMENT
A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 13-13
AND CREATING SECTION 13-13 . 1 OF THE OSHKOSH MUNICIPAL CODE
PERTAINING TO FIRE PREVENTION CODES
The Common Council of the City of Oshkosh do ordain as follows:
SECTION 1. That Section 13-13 of the Oshkosh Municipal Code
pertaining to adoption of the Fire Prevention Code as
recommended by the American Insurance Association is renumbered
as Section 13-13 . 1.
SECTION 2 . That Section 13-13 of the Oshkosh Muncipal Code
pertaining to the adoption of the State of Wisconsin General
Hazard Fire Prevention Code is created to read as follows:
SECTION 13-13 GENERAL HAZARD FIRE PREVENTION CODE
(A) Adoption
The provisions of Chapter ILHR 14, Wisconsin Administrative
Code, entitled "General Hazard Fire Prevention Code", are adopted
and fully incorporated into this Code by reference. It is
intended that all modifications, amendments, recodifications and
renumberings of this provisions as may occur from time to time
shall likewise be immediately adopted and fully incorporated into
this Code by reference. Any act prohibited by these provisions
is prohibited by this Code; any act permitted by these provisions
is permitted by this Code.
(B) Conflicting Provisions
Wr,erever a prcvisicn of this Secti�n conflicts with a provision
adopted by Section 13-13 . 1 of this Code, the terms and conditions
of the provision of this Section shall prevail.
SECTION 3 . This ordinance shall be in full force and effect
from and after its passage and publication.

1 . Pursuant to section 101 .02(15)(a) , Stats. , the Department of Industry�
l.abor and Human Relations h�s the respons1b11ity for m�king publlc
buildings and places af emplayment s�afe and for protecttng the ltte,
health� safety and welfare of employes, frequenters, tenanfis and the
public in public buildings and plates of employment. A1so, settion
1o1 . t4, Stats . , allows the Department to promuigate regulattons retdtiny
to fire prevention and lnspectl4ns. Early thls year� the Department
adopted a rule 1n cha�pter ILHR 14 -- Generat Hazard F1re Prevention Code
requlring ftameproofing of natural and arttt'tcial Chrlstm�s tre�s.
� 2, The neighboring states of I111nois, Michigan and Iowa do not have Any
rules requiring flameproofing of natural Christmas trees. The
Underwrlters �aboratories , inc. , does not 11st any products for

3. The Ndtional Fire Protection Assotlation lndicates that tfie
flameproofing treatments fpr nntiural trees are not effetttve. They
repvrt that proper care of llve trees, suCh as recutting the trunk and

4. Christmas tree qrowers are preparing for the Chrtstmas season. The
exiSting rule wili place an undue economic burden on the Wlsconsln
lndustry.
The rule deletes the reqvlrement for flameprooti�g of natural Christma�s tre�a�
requlring flameproofing of arti�lcla] trees only. For na�tural Christnw�s

Protectian Assotiation to recut the tree trunk dnd malntain it in w�ter� thus

These rules are, therefore, adopted as emergency rules to tak� effect upon
publlcutlon and f111ng with the Secretary af State a�nd thQ Revisor of Statutes
as provlded tn section 227.24 (1 )(c) � Stats.
