HomeMy WebLinkAbout35703 / 90-471 JANUARY .18 1990 #471 RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE AGREEMENT / HOUSING AUTHORITY INITIATED BY: DEPARTMENT OF COMMUNITY DEVELOPMENT BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached Agreement for Services between the City of Oshkosh Housing Authority and the Winnebago County Housing Authority is hereby approved and that the proper City officials are authorized to execute said Agreement. � S�B!;i��'TE?l 3Y� �i # � � ___.�._..._........._ I ,s:'�:_' ,�;��i — 22 — � Res. #471 Ar;�n�rrr FoR s�xvicEs BETWEEN THE HOIISING AIITHORITY OF THE CITY OF OSHKOSH AND THE WINNEBAGO COIINTY HOIISING AIITHORITY THIS AGREEMENT, made pursuant to Section 66.30 (2g) , Wisconsin Stat. and entered into this day of , 19 , by and between the HOUSING AUTHORITY OF THE CITY OF OSHKOSH, hereinafter referred to as the "City Authority" and the WINNEBAGO COUNTY HOUSING AUTHORITY, hereinafter referred to as the "County Authority", and the CITY OF OSHKOSA, hereinafter referred to as the "City", WITNESSETH, that WHEREAS, under Section 59.075 Wisconsin Statutes, the County of Winnebago duly created the Winnebago County Housing Authority by Resolution No. 2, April 23, 1974, and WHEREAS, under Section 59.075 Wisconsin Statutes, the establishment, organization and administration of a County Housing Authority is to be carried out pursuant to Sections 66.40 through 66.404, and WHEREAS, under Section 66.404 of the Wisconsin Statutes, the City is authorized and empowered to do any and all things necessary and convenient to aid in the planning, construction, and operation of various housing projects and mav enter into agreements with other housing authorities with respect to such action. NOW, THEREFORE, the parties hereto do mutually agre� as follows: 1. By the terms of this agreement, the City Authority agrees to administer all functions of the County Authoritv and maintain� a close working relationship with Winnebago County in the - development, construction and operation of County Authority low rent projects and other housin� programs necessary for the elimination of unsafe or unsanitary housing conditions and the furnishing of safe, adequate, and sanitary accommodations for persons of low income throughout WinnPbago County. • 2. The City Authority agrees to furnish all personnel and facilities necessary for the administration and operation of the County Authority more generally described as follows: A. Office space for the County Authority at the offices of the City Authority, 600 Merritt Avenue, Oshkosh, Wisconsin and other administrative facilities as needed to carry out the required functions of the County Authority operations. B. Administrative, accountin�, clerical, legal, health - 2 2 a - � Res. #471 Agreement for Services Between The Housing Authoritp of The City of Oshkosh and The Winnebago County Housin� Authority PaRe 2 and social services, and maintenance personnel on a full or part time basis as needed. C. Supplies, materials, and other services such as, but not limited to, postage, offiee supplies, publications, accounting and computer services, dues and fees, car allowances, travel and training e:�penses, and purchasing services. 3. The Executive Director and Secretary of the City Authority shall serve as the F.�cecutive Director and Secretary of the County Authority. The Executive Director shall carry out the legal requirements of the position as required by State Statutes, Department of Housing and Urban Development (HUD) and Wisconsin Housing and Economic Development Authority (WHEDA) regulations and other regulatory and legal requirements as applicable. The Executive Director shall also be responsible for the daily administrative functions of the County Authority. 4. For the operation of the County Authority, the number of admini�trative and clerical personnel positions shall be detPrmined by the County Housing Authority's ability to provide fundin� for salaries and benefits, staffing recommendations from HUI) and/or WHIDA and work load determined in cooperation with the Citq Authority. A. New positions shall be added only after recommendations by the County Authority Board of Commissioners. B. All administrative, clerical, and other positions with the exception of maintenance personnel and Resident Advisors shall be employees of the City of Oshkosh, pursuant to the Agreement for Services between the City Authority and the City of Oshkosh and shall be hired under the provisions of that agreement. 5. Maintenance employees and Resident Advisors for County Authority housing projects shall be employees of the County Authority. SalariPS and benefits for these positions shall be the responsibility of the County Authority. Ch3rges for supplies and any maintenance functions performed by City Authority personnel shall be billed back to the County Authority on an actual cost basis. - 22b - � Res. #471 Agreement for Services Between the Housiag Authority of The City of Oshkosh and The Winnebago County Housing Authority Page 3 6. Legal services for the .County Authority shall be provided by the City of Oshkosh attorney's office under the provisions of the Agreement for Services between the City Authority and the City of Oshkosh. The City Attorneq shall cooperate with the Winnebago County Corporation Counsel in all legal matters affecting the County Authority. 7. Administrative and Operating Policies required �y h�TD and WHEDA shall be developed by the ExPCUtive Director and Administrative staff and approved by the County Authority Board of Commissioners. Such policies shall be consistent � with those policies of the Oshkosh Housing Authority whenever possible and/or appropriate. Other policies may be developed from time to time and approved by the Board of Commissioners as desirable. 8. Annual budgets for each County Authority housing project or program and various books of accounts shall be� developed by the Executive Director and administrative staff. Salaries and benefits of staff, administrative expenses, office supplies, travel and training expenses, dues, etc. , and all other expenses of administering and operating the various County Housing Authority housing projects and programs shall be billed back to the respective budgets and accounts for those programs. Dispersal of these expenses and accounting records and procedures shall at all times conform to the fiscal requirements of HUD, WHIDA, or other agencies or funding sources that have sponsored the various County Authority housing programs. � A. ihe rxecutive Director shall provide the Board of Commissioners with fiscal reports and records at the monthly meeting of the Authority as they shall require. The Commissioners shall consider approval of said reports and authorize payments of just due accounts and bills. B. On an annual basis, or as ma}� be required, the Executive Director shall make arrangements for an audit by a Certif ied Public Accountant of the accounts and records of the County Authority housing projects and programs pursuant to the requirements of HUD, WHEDA, or other agencies or funding sources. Such audits shall be made available to the Commissioners and to the City and County upon completion. - 22C - � Res. #471 Agreement for Services Between The Housin�; Authority of The City of Oshkosh and The Winnebago County Housing Authority Page 4 C. All records and accounts maintained for the County Authority shall at all times be open for inspection and audit by the City or County, to the United States Government, and to any agency, public or private, that has a bonafide proprietar� interest in the monies under the control of the County Authority. D. It shall be understood by all parties to this agreement that neither the City Authority or the City of Oshko�h shall be responsible for any debts or defaults incurred in the administration and operation of the County Authority's housing projects or programs. 9. The Execut�ve Director shall schedule a regular monthly meeting of the Commissioners of the County Authority. In addition to the fiscal reports and presentation of bills, the Executive Director shall make all other necessary reports to accurately inform the Co�issioners as to the nperation of the County Authority, proposed applications and plans for � additional housing programs, development of County Authority policies, and any other pertinent information for the efficient operation of the Authority; and such additional reports as the Commissioners shall request. A. Meetings shall be scheduled and held according to the open meeting law requirements of the State of Wisconsin. B. The proceedings of° each monthly meeting and any special meeting shall be distributed to the Commissioners and both Citq and County offices. 10. The services of the City Authority and any agreements entered � into between the City Authority and the County Authority, and any other agreements, contracts, or understandings entered into by the City Authority or County Authority, either jointly or separately, under the terms of the Agreement For Services Between the Housing Authority of the Citv of Oshkosh and the Winnebago County Housing Authoritv, dated March 31, 1977, shall continue in effect unless they are in conflict with this document. 11. This Agreement for Services, together with all applicable provisions of the Agreement For Services Between the Housing Authority of the City of Oshkosh and the City of Oshkosh, - 22d - � Res. #471 Agreement for Servi.ces Between The Housing Authority of The City of Oshkosh and The Winnebago C�unty Housing Authritv � Page 5 Wisconsin dated June 12, 1985, evidence the entire agreement between the City Authority and the County Authority and no changPS shall be made thereto except in writing upon approval of the parties thereto. 12. Either party hereto may terminate this Agreement For Services by giv�r.g siXty (60) days written notice of its intention to do so to the other party.
