PLAN COMMISSION RECOMMENDATION: Approved
BE IT RESOLVED by the Common Council of the City of Oshkosh that the City
hereby accepts right-of-way for Waupun Road adjacent to 4233 Waupun Road, per the
attached.

BACKGROUND
The subject site was formerly owned by Oshkosh Youth Baseball Inc., and recently
purchased by Fox Valley Technical College Foundation, Inc. when the site was located in the
Town of Nekimi. The State of Wisconsin required a Certified Survey Map (CSM) as part of
the purchase agreement which triggered an immediate attachment to the City of Oshkosh per
guidelines in the Cooperative Plan between the City of Oshkosh and Town of Nekimi.
Waupun Road was never formally dedicated to the public so as part of the CSM approval, the
City requested the street be dedicated. The subject site as well as lands to the north, east
and south is currently and has been historically used for agricultural purposes. Fox Valley
Technical College's newly constructed Advanced Manufacturing Technology Center and the
Military Veterans Museum is located west of the subject site.
ANALYSIS
City Administration is requesting a 66-foot wide right-of-way dedication of a portion of the
parcel located adjacent to 4233 Waupun Road located two-thirds mile northeast of the U.S.
Highway 41/State Highway 26 interchange. This area is currently designated as reserved for
future right-of-way but is not included in the Comprehensive Plan's Transportation element.
The current and proposed dedication is mapped for a 66-foot right-of-way which is consistent
with the Comprehensive Plan's recommendation for Collector-Classed streets. The
Department of Public Works reviewed the dedication and determined that the standards are
adequate for current and future needs. The proposed right-of-way dedication is consistent
with requirements of the Subdivision Regulations as well as the Comprehensive Plan.
FISCAL IMPACT
None anticipated.
RECOMMENDATION
The Plan Commission approved of the request at its April 7, 2015 meeting.

GENERAL INFORMATION
Petitioner: City Administration

Action Requested:
City Administration is requesting a 66-foot wide, trapezoidal-shaped right-of-way dedication of a
46,266 square foot(1.062 acre) parcel located adjacent to 4233 Waupun Road. The subject site is
located approximately two-thirds mile northeast of the U.S. Highway 41/State Highway 26
interchange.
Applicable Ordinance Provisions: N/A
Property Location and Type:

right-of-way which is consistent with the Comprehensive Plan's recommendation for Collector-
Classed streets. The Department of Public Works reviewed the dedication and determined that
standards for Collector-Classed streets are adequate for current and future needs.
Staff is in the opinion that the proposed right-of-way dedication is consistent with requirements of
the Subdivision Regulations as well as recommendations identified in the Comprehensive Plan.
RECOMMENDATION/CONDITIONS
Staff recommends approval of the right-of-way dedication of Waupun Road as requested.
The Plan Commission approved of the right-of-way dedication as requested. The following is the
Plan Commission's discussion on this item.
Mr. Nau presented the item and reviewed the site and surrounding area and explained the history
of the site. He stated that the property was recently attached to the City and Waupun Road was
never formally dedicated to the public. He explained that this section of Waupun Road is not
included in the Comprehensive Plan's Transportation element however the current designation and
proposed dedication is mapped for a 66-foot right-of-way which is consistent with the
Comprehensive Plan's recommendation for collector-classed streets. The Department of Public
Works has reviewed the request and determined that the dedication was adequate for current and
future needs.
Mr. Thoms questioned who would be responsible for maintaining this section of the roadway.
David Patek, Director of Public Warks, responded that since this property has been annexed into
the City, the maintenance of this section of the road would be the City's responsibility.
Motion by Thoms to approve the right-of-way dedication for property located adjacent to
4233 Waupun Road.
Seconded by Gray. Motion carried 7-0.
