IN THE CITY UF C�SHKC)SH AND SPECIFICALLY TC) THE 6th WARUS C)F SAID
CITY.
WHEREAS, an annexation petition duly circulated has heretofore
been signed by the owiiers of more than 5C1`% of t�ie land in the area
within such territory, and a majority of t�ie electors residing in said
territory, notice of intention to circulate an annexation petition for
direct annexatioii having been duly nuUlis�ied , atld a copy of said
notice with a scale map re�sonably sliowing the bo.undaries of the area
sought to Ue annexed aild its relation to the municipalitie� involved ,
having been duly served upon the affected muiiicipal and school
district clerks and the Director of t}ie Planiiiiig FL1I1Ct�0i1 , Uepartment
of Resource Development, State of Wisconsiil , withii� five ( 5 ) days of
the date of publication of said notice , adoption of t�iis t)rdiiiance
shall C011otitute acceptance of tlie petitioii of aIlI1@Xat�021 � EiI1C�
WHEREAS, more than tweilty ( 2f►) days have lapsed since the
publication of the notice of intentioii to ciz•culate such annexation
petition and not more than oile �iundred twenty ( 12(1) days �iave lapsed
since the filing of the annexation petition ; and
� WHEREAS, the Director of Planning Function of the Department of
Resource Uevelopment of the State of Wisconsin has issued his opinion
that the annexation is not contrary to the nublic interest; and
WHEREAS, the Plan Commissioti of the City of Oshkosh has
recommen ded that revised temporary zoning for said property be as follows :
R-1 Single Family Residence and R-3 Multiple Dwelling
(as per the attached Exhibit "B")
NOW, THEREFORE , the Common Council of the City of C�shl�osh do
ordain as follows :

SECTIUN 1 . The following described territory, pursuaizt to a duly
circulated and filed annexation petition for direct annexation is
hereby annexed to and made part of the City of Ushkosh, a municipal
corporation located in Winn�Uago County, more specifically in the
6th Wards of said City and is annexed for schaol purposes also
and is hereby made a part of the City school district , and
sub,ject to all the laws governing the same, all in accardance
with Section 66 . U21 of the Wisconsin Statutes and the amendments
thereto:
The NE 1/4 of the SW 1/4 of Section 21, Township 16 North,
Range 16 East, excepting therefrom the south 100 feet and
the west 90 feet of the nocth 260 feet and also including
the adjoining north cight-of-way of Fourth Street Road
(C.T.H. "E") in the SE 1/4 of the NW 1/4 of said Section 21,
all in the Town of Algoma, Winnebago County, Wisconsin.
Said parcel contains approximately 37.9 acres.
SECTIUN 2 . Section 1-28 , 1-29 , 1C)-1 and 1C1-3 of the t)shkosh
Municipal Code pertaining to Boundaries , Wards , Polls , Benchmarks are
hereby amended so as to reflect the provisions of this C�rdinance and
the proper City officials are hereby authorized and directed to make
such changes .
SECTIt)N 3 . This t3rdinance shall be in full force and effect from
and after its passage .
SECTIC)N 4 . The proper City officials are hereby auth�rized and
directed ta comply witn the �ollowing requirements of Section
66 . 021(S) of the Wisconsin Statutes and the City Clerk shall give
written notice to the appropriate Town Clerk of the acceptance of the
annexation petition and the adoption of this C�rdinance .
SECTIC)N 5 . That said �roperty hereinabove describsd is hereby
temporarily zoned as follows :
R-1 Single Family Residence and R-3 Multiple Dwelling
(as per the attached Exhibit "'B")
