PURPOSE: APPROVE PRELIMINARY PLAT/COUNTRY SIDE ESTATES
INITIATED BY: SECURITY LAND DEVELOPMENT INC .
PLAN COMMISSION RECOMMENDATION: Approved 8-0 w/lpresent w/conditions
BE IT RESOLVED by the Common Council of the City of Oshkosh that
the Preliminary Plat known as Country Side Estates , described below,
is hereby approved.
A part of the NE 1/4 of the SW 1/4 of Section 21, T18N, R16E, 6th Ward, City of
Oshkosh, Winnebago Coi.mty, Wisconsin containing 12.3398 acres and being described
by: Camiencir� at the Center of said Section 21; thence S 00°-31'-16" E 50.00 ft.
along the E line of the SW 1/4 of said Section 21 to a point on the S line of Witzel
Ave. and being the true point of beginning; thence continue S 00°-31'-16" W 1277.05
ft. along the E line of the SW 1/4 of said Section 21 to the SE corner of the NE 1/4 of the SW1/4
of said Section 21; thence N 89°-S1'-47" W 426.61 ft. along the S line of the NE 1/4
of the SW 1/4 of said Section 21 to the NW corner of Lot 5 of Abbey Subdivision;
thence N 00°-31'-16" E 1277.79 ft. to a point on the S line of Witzel Ave.; thence
S 89°-45'-47" E 426.61 ft. along the S line of Witzel Ave. to the true point of
beginning.
BE IT FURTHER RESOLVED that approval of the Preliminary Plat known
as Country Side Estates is contingent upon the following:
1 ) A covenant be placed on the face of the final plat requiring a
$100 per unit fee in lieu of parkland dedication.
2 ) That a $100 per lot fee be paid in lieu of parkland dedication
prior to approval of the final plat .
3 ) That the final plat meet all requirements of Section 30-68
Final Plat of the City of Oshkosh Subdivision Ordinance.
4 ) The developer be responsible for all capital improvement
costs.
5 ) A drainage plan be submitted and approved prior to submitting
the final plat .
6 ) A covenant be placed on the face of the final plat prohibiting
direct vehicular access onto Witzel Ave . for Lots 1-5 .
7 ) A covenant be placed on the face of the firial plat prohibiting
direct vehicular access onto Westhaven Dr. for all lots , excluding
Lot 16 and Outlot 17 .
8 ) That the legal description be corrected prior to final plat
approval. �
9 ) That Lot 9 be increased in area to meet or exceed 10 , 000
sq. ft .
