HomeMy WebLinkAbout90-122 h June 7, 1990 # 90-122 RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE SEWER CONTRACT (Dept. of Social Services and Winnebago County) INITIATED BY: CITY ADMINISTRATION BE IT RESOLVED by the Common Council of the City of Oshkosh that the attached Agreement between State of Wisconsin, Department of Social Services, Winnebago County and the City of Oshkosh to provide for temporary sewer service to the Winnebago County Fairgrounds and the Winnebago County Landfill on Sunnyview Road is hereby approved and the proper City officials are hereby authorized and directed to enter into sa.me. crr�e,.�:1�1`ED BY i � . , c�� P.. :�' _.__.��.___ ,:`I;i; - 21 - Resol. 90-122 �, AGREEMENT THIS AGREEMENT, made this day of , 1990, by and between the State of Wisconsin, Department of Social services (Department) , Winnebago County (County) and the City of Oshkosh (City) to provide for. temporary sewer service to the Winnebago County Fairgrounds and the Winnebago County Landfill on Sunnyview Road. WITNESSETH: WHEREAS, the County desires sanitary sewer service from the City to the Winnebago County Fairgrounds and the Winnebago County Landfill on Sunnyview Road a/k/a County Trunk Highway "X" ; and WHEREAS, the City intends to construct a sanitary sewer t�ansportation system to accomcdat� preser.t 3evelopment and future growth north of the City; and WHEREAS, the uncertainty of immediate City growth and the magnitude of construction do not permit prompt construction of such a system; and WHEREAS, at the request of � the Department, the City conducted an analysis of the exisitng sewer system operated by the Winnebago Mental Health Institute; and WHEREAS, the analysis conducted by the City concluded that the existing sewer system has adequate capacity to allow the addition of the County Fairgrounds and Landfill with no detrimental effect to the system, and the Department is relying on these conclusions to be accurate; and WHEREAS, the Department is willing to provide the City with a temporary connection to the existing sewer system operated by the Winnebago Mental Health Institute (WMHI) whose flows are treated by the City's wastewater treatment facilities; NOW, THEREFORE, IT IS HEREBY AGREED to by and between the parties named above as follows: 1 . Tr,e City shal� prcvide sanitary sewer trar.sporat�on and treatment services to the County at the Fairgrounds and Landfill on Sunnyview Road. 2 . The Department shall permit the City to connect inflow lines into the existing sanitary sewer system presently operated by the Winnebago Mental Health znstitute. 3 . The City shall clear out the WMHI sewer lines between the new hookup and the lift station with a root cutter device to insure full flow through the sewers lines. 1 - 21a - Resol. 90-122 � � 4 . The City shall be responsible for maintenance of the inflow line into the WMHI lift station excluding laterals into private properties served by the WMHI sanitary sewer system; except that, the City shall be responsible for any repair of damage to private property attributable to the increase flow. 5. With prior approval by the Department, the City may connect other wastewater sources to the inflow line provided that the additional flows do not exceed the lift station capacity. 6. The City shall appropriately meter inflows into the existing sanitary sewer system to prevent increased calculated sewage charges to WNSHI and shall, in the event such flows inappropirately increase such charges, reimburse the Department for the amount of such increaseo 7 . This agreement is entered into under the authority provided in Section 66. 069 (2) (d) , Wis. Stats. (1987-88) .
