PURPOSE: APPROVE OSHKOSIT YOUTH BASEBALL AGREEMENT
INITIATED BY: CITY ADMINISTRATION
BE IT RESOLVED by the Common Council of the City of Oshkosh
that the attached Agreement between the City and Oshkosh Youth Base-
ball, Inc . for a concession at Red Arrow Park is hereby approved and
the proper City officials are hereby authorized and directed to enter
into same.

OSHKOSIT YOUTH BASEBALL
AGREEMENT
WHEREAS, the City of Oshkosh owns Red Arrow Park, a district park
providing outdoor recreation, and
WHEREAS, Oshkosh Youth Baseball Inc. , a nonprofit organization desires
to provide concession services to the public, and
WHEREAS, the City of Oshkosh believes this service is desired by the
citizens of Oshkosh.
NOW, THEREFORE, it is hereby agreed by and between the parties
1. Oshkosh Youth Baseball, Inc. , with cooperation from the Coca-Cola
Company Inc. of Oshkosh, will place a portable concession stand at a
location mutually agreeable with the City of Oshkosh and Oshkosh Youth
Baseball, Inc. , i.e. Red Arrow Park.
2. The City of Oshkosh will not furnish water, electrical, or sewer service
to the building.
3. Oshkosh Youth Baseball, Inc. will provide liability insurance and secure
the necessary health permits.
4. The building will not be permanently attached to the land.
S. There will be no premise advertising either on the building or adjacent
to the ball diamonds.
6. The building will be removed promptly after the baseball season in
mid August, but no later than September 10, 1990. If the building is not
removed by that date, the City of Oshkosh will make arrangements to move
the building with costs for such removal being paid by Oshkosh Youth
Baseball, Inc.
7. All net proceeds will go to Oshkosh Youth Baseball, Inc. and a report
made to the City of Oshkosh after the season.
8. Oshkosh Youth Baseball, Inc. is responsible for all costs of vandalism
to the building which may occur,
9. This permission is good for the 1990 season only, with no commitment to
the future.
10. Oshkosh Youth Baseball, Inc. is responsible for all garbage and trash
pick up for items generated by the operation of the concession stand.
Said trash shall be picked up immediately after the last scheduled daily
game and deposited in the park dumpsters.
11. Oshkosh Youth Baseball, Inc. is responsible for the payment of sales
tax and the appropriate other federal and state tax.

12. Only authorized persons from Oshkosh Youth Baseball, Inc. can sell and
this permission is not transferable to any other organization or
individual. Failure to abide by this provision revokes permission •
immediately.
IN WITNESS WHEREOF, the parties hereto have caused this agreement to be
signed by their proper officers on this day of , 1990.
