To construct a parking lot with a 7 1/2 ft. side yard setback with the � condition that appropriate landscaping be placed along the lot line per Section 30-30 (D) (2) of the City of Oshkosh Zoning Ordinance. According to Section 30-25 (B) of the City of Oshkosh Zoning � ordinance your variance(s) will expire on July 17, 1990 unless you have obtained a permit for the activity allowed by the variance(s) . BOARD OF ZONING APPEALS MINUTES . � JAIVUARY 17, 1990 PRESENT: Scott McDonald, Kevin McGee, Gary Ruhl, Terry Slover � STAFF: Bruce A. Roskom, Principal Planner; Darlene Matulle, Recording Secretary � Chairman McGee called the meeting to order at 3:30 PM. Roll call was taken and � and a quorum declared present. Due to a four member Board, Mr. McGee informed the applicant that four affirmative votes would be required to approve a request. A 3-1 vote would be an automatic � lay over until the next meeting, and a 2-2 vote would be a denial. The minutes of January 3, 1990 were approved as distributed. � ! I. 1760 WEST 7TH AVENUE - Good Shepherd Lutheran Church, owner ; � � Tfie applicant is requesting a variance to construct a parking lot with a 7 1/2 ft. � side yard setback, whereas Section 30-29(B)(1)(c) of the City of Oshkosh Zoning Ordinance requires a 25 ft. side yard setback. The property is zoned R-3 Multiple Dwelling. � In answering questions from the Board, Mr. Reinhard Roehlig, agent for Good Shepherd Lutheran Church, explained the following: The parking lot is existing � and was constructed in 1988 �ccording to existing regulations at that time. The contractor who did the paving had indicated that no permit was required. However, due to adjacent residential properties, transitional yard requirements � must be met, as well as a building permit obtained. There is no new additional parking being proposed, this issue just needs to be straightened out. It was also noted that the landscaping would be completed next spring along mutual lot lines. Shrubs will probably be p.lanted because most of the area is already � fenced and the Church does not want double fenced areas. Discussion ensued relative to height requirements for landscaping. � Mr. & Mrs. Gerald Ringe, 511 Lilac Street, stated they live to the rear of the church property, and as long as all codes are met, they support this request. � Motion by Slover to approve a variance for a 7 1/2 ft. side yard setback for the construction of a parking lot with the condition that appropriate land- scaping be placed along the lot line per Section 30-30(D)(2) nf the City of � Oshkosh Zoning Ordinance. Seconded by Ruhl. Motion carried 4-0. . Regardfng the findings of fact, McDonald stated the parking plan was approved � under the old guidelines and it would be unfair to deny the request because the applicant was caught in the middle of a change in guidelines and policies.
