Claim I am here because I believe the plaintiff has not completed the home improvement contract. I ha.ve already paid $26,818 for a new roof, siding, replacement windows, solar tubes, and a new front porch. I have withheld $3,286.13 until the plaintiff ha.s completed the rest of the contract; corrected the 9 building code violations; and, reedited the complaints about the work conforming to the standard of trade in workmanship, which he received during the court ordered mediation session. Since that mediation session I have not heard one iota from Mr. Wong. My complaints are governed by the Wisconsin Administrative Code, Agriculture, Trade and Consumer Protection (ATCP) 110 regarding Home Improvement Practices .The plaintiff has a copy of those complaints and I've given you a copy a well. I have subpoenaed Brian Noe, Oshkosh Building Inspector who will corroborate the fact that Mr. Wong has not answered the 9 violations included in my complaint. I will offe�ibits, which will also show that the work that has been completed is already, begun defective. I believe I was enticed to signing a very vague contract by many verbal promises ` made by the plaintiff and he has defaulted in the stand measure of practice in workmanship. Under ATCP 110.02(2)[g] he has failed to perform certain functions. For example, the photos show that the solar tubes have not been installed correctly and leak. I believe the integrity of a sealed roof has been put at risk because the tubes were installed ` more than a month after the roof was completed. The front door handle has not been installed properly and has come loose several times. The deadbolt lock does not secure because it, or the door was not installed and secured to the standard of the profession. I have purchased for Mr. Wong the required house numbers and the door bells (2) but he has made to attempt to contact me to fix these problems. My closing argument is to ask the court to consider the state statues that authorize payrnent for the damages that I have incurred, twice the amount of the pecuniary damages plus all court costs a maximum of$5,000 (small claims max.). Based on the amount of money($23,818) I have already paid, I ask the court to find the following misrepresentations and enticements. by direct and indirect implication by his verbal promised and behavior regarding the entire work,the problems and violations listed in detail below. I request the court to dismiss the plaintifPs claim and order a judgment of $5000 for my counter claim plus costs. I filed a counter-suit against Pat Wong Window& Siding because Mr. Wong demanded from me the balance of $3,286.13 (plus interest) after he forced his way into � my home, unannounced and uninvited, and then tried to intimidate me with threats to start ripping of the siding if I didn't pay up, or file a lien on me. It was late October, • 2001, and the verbal contract we made in April, 2001, had still not been completed. These are the items under contention: 1. "To sweeten the pot" some more, he agreed that instead of installing the "6`n„ solar tube through the roof that was already done, he would install a new range hood with outside vent (which I would purchase) at no additional cost. At the end he said that type of installation was structurally impossible to do, and has refused to follow through. Since the contract specified 6 solar tubes to be installed and only 5 were, I believe that arrangement would have been a fair trade-off. 2. At the beginning and throughout the work in progress, I kept asking for reassurance that the new eaves would not leak or create big icicles around the house. He promised that it would not happen and I would be very happen with the quality of the work. Photos attached speak for themselves; and those were taken in late February, 20002, when I realized I would need proof, even though the icicles pictures were not at their winter worst. When I called him in October to complain there were already drips from the seams, he did send over a man to make some adjustments. However, it did not remedy the ice build up in the winter. 3. I have no copy of the building plans that Mr. Wong submitted to the Building inspector, so I don't know if the finished job is what he told the inspector he would do. 4. I have no warranties for the materials and supplies, or services used for this home improvement job. Wisconsin State Administrative Codes described below, state that I have the right to expect copies of the warranties for the roofing materials, the siding, the 14 double hung replacement windows,the sofit, fascia, eaves, porch construction, labor, etc. 5. The contract was signed in Apri122; Mr. Wong promised he would begin my job the following Monday because he was just finishing up another house on East New Your Ave. in Oshkosh. As it happens I pass that sight each day on my way to work. The job was fmished within that ne� week as he said;however, only a dumpster(rented from Johnson's in Neenah) arrived in my driveway in May but the roofing work did not begin until June 8, 2001. There were frequent intervals of 2-3 weeks, between the times laborers came and went, leaving work unfinished. The dumpster was not removed until the end of August. 6. Mr. Wong wrongly states in his small claims complaint that the entire job was completed by August 30,200L However,there were still unresolved problems and work(i.e. range vent installation) in mid October. The following is an itemized account of the numerous violations of the Wisconsin Administrative Codes under Chapter 110: Home improvement Practices. This counter-claim if based on violations of Wisconsin Agriculture, trade & Consumer Protection (ATCP) law regarding Home Improvement Practices : Chapter ATCP 110. • We, the buyer, Virginia Tawawili and my husband Loruama Tawawili, to a home improvement contract for our residence at 1522 Jackson Street, Oshkosh entered into a "Home Improvement contract" with Pat Wong Widow& Siding which by definition (ATCP 110.02 [4] means "an oral or written agreement between a seller(Pat Wong) and an owner (V. &L. Tawawili). Part of my counter-complaint is in reference to one of the many verbal enticements Mr. Wong used to influence me to sign the written contract rather than choose the other contractor I had spoken with earlier that day. Mr. Wong indicated that he really wanted my job because he was trying to build name recognition in Oshkosh, and with the finishing of the Jackson Street construction he wanted to put out his company ' sign on our lawn because Jackson Street would be a busy thoroughfare and our home would really look sharp as people drove by. I have since come to learn that under Wisconsin Chapter ATCP110.02 [1] Prohibited trade practices, Mr. Wong lured me into thinking that his work would be like a"model" or"advertising job."In addition, Mr. Wong insisted upon showing me his papers proving that he was the only certified distributor of the brand of siding we were discussing. (Once the job was started, after a lengthy delay, Mr. Wong had no physical hand in the installation of the siding.) He insisted that I see the actual documentation which said he had the only certified right to buy and install that siding;this was "misrepresentation directly or by implication that products or materials to be used"ATCP110.02 (2) [b,f] and ATCP 110.02 (4) [b,c]."Misrepresent the status , authority or position of the sales representative.. which he represents." At this time, and repeatedly, Mr. Wong reassured me that he would personally be present to see to it that"the job would be done right." As the duration of the home improvement job became longer than the standard of practice for such work, I called Mr. Wong on three occasions to inquire why the eaves and downspouts had not yet been installed; since we were ha.ving so much rain that mother I wanted to be sure the roof was completed and secure against the weather. Mr. Wong each time he spoke about the matter I said the delay was due to the fact that the eaves and downspouts were backordered because there were specially made and that's why it was taking so long. This misrepresentation is a violation of ATCP 110.02 (3)[e,fJ. Two hours prior to my 6:00 PM meeting with Mr. Wong I interviewed another : contractor, John Calkins,ARMR, who made me a better price offer for the roofing job. I compared Mr. Wong's quote with the Mr. Calkin's quote. Mr. Wong said he really wanted the job so he would "sweeten the pot" for me by offering to "throw in the difference" in price between the fiberglass shingles with 30# felt that I originally wanted, ' but now for the same price as the asphalt shingles so we could finish the contract right away. He asked if it would be all right to make that a verbal agreement, because I could trust him, and it save time and extra paperwork which he had he already had filled out. TRUST being my hot button, I said OK. However, after the roof was finished, and I had an independent contractor examine the shingles, my suspicions were confirmed that the usual asphalt, not fiberglass shingles, had been used. I believe this is bait selling and is in violation of ATCP 110.02 (3) [a,b,d].I felt like I had been enticed and deceived. In addition, as our initial contract negotiations did not convince me to hire Mr. Wong, he volunteered to "sweeten the pot"again and"throw in" a decorative door and side panel • to dress up the finished new siding's appearance. Under ATCP 110.02(11)this was another violation. Another major violation is ATCPI 10.03 (1,2)regarding building permits. I refer : the details to Brian Noe, Oshkosh City Building inspector who will explain the nine(9) violations that come under this portion of the state code. Mr. Wong assured me he would take care of the necessa.ry building permits. However, not once nor ever, has there been any building or electrical permit issued from the City of Oshkosh placed in the usually designated location on our residence. Additionally, midpoint and final inspections have not been requested as are required by state law and city ordinances. In respect to ATCP 110.04 Warranties. (1) "A seller shall give a buyer a copy of every written warranty made with respect to labor, services, products or materials furnished in connection with home improvement. If the seller makes any oral warranty, the seller shall document that warranty in writing and give a copy to the buyer. The seller shall provide all warranty documents to the buyer at the time the buyer enters into a home improvement contract, except that a manufacturer's produce wananty may be provided when that product is installed. (2) If a seller warrants any labor, service...with the home improvement,the warranty shall be clear and specific and shall clearly specify all of the following: [a] Any warranty conditions or exclusions. [b] Any limitations on the scope or duration of the warranty. [c] The time period within which the seller will perform the seller's warranty obligations... (3)No seller may give any warranty which the seller does not intend to honor in full..." Throughout the entire home improvement period, from contract to the 2°d payrnent, Mr. Wong only verbally emphasized that he would guarantee the workmanship of the job and if there were ANY problems he would guarantee the cost of any labor that would be involved in making corrections. It was not until the 2"d payment tha.t I became aware that I was entitled to warranties for all the materials used on my home. In fact, I still do not know the name of the company that manufactured the replacement windows,the roof, or the siding, let alone have any copies of the warranties and specifications for installation, which may have a negative effect, should there be problems with the ma.terials. Mr. Wong failed to comply with ATCP 110.05 Home Improvement contract requirements (1,2 [a,b,d,fJ), which expressly describe the Wisconsin Administrative code for written contracts between seller and buyer. Another complaint that has not been addressed by Mr. Wong is in regard to the general contractor and subcontractor's under Pat Wong Window& Siding. On at least four separate phone calls with Mr. Wong I asked, even demanded, that I be given the names, addresses, and phone numbers of the men who worked on the roof. The solar tubes,the siding, and the new porch. Mr. Wong not only refused the give me those names, but sa.id he would not because these people had stolen equipment from him and . since one man was an alcoholic, he wanted to protect me from such"bad"character. On one telephone conversation Mr. Wong said he didn't want me to get misled by one of the workers because he (Wong ) was going to take him to court for his own reasons. Later, as � I persisted in another call, Wong said he would give me the man's name only after I had paid Pat Wong Window& Siding for the job. This violates ATCPl 10.05 (6)that states • that the name and address of a person other than the seller if he is to act as the general contractor. Finally, In violation of"ATCP 110.07 Contract cancellation; return of payments. (1) Condition warranting exercise of buyer's remedies. If, under a home improvement contract, a buyer pays a seller for any home improvement materials or services before the seller provides those materials or services to the buyer, the buyer may proceed under sub.(2)if any of the following occurs: (a)The seller fails to provide the materials or services by a deadline specified in the home improvement contract. (b) The seller fails to give notice of an impending delay as required (s) ATCP 110.02(7)[c],or fails to obtain the buyer's agreement to a new performance deadline (c) The buyer believes that the seller has failed to provide the materials in a timely manner, and the home improvement contract specifies no deadline for the seller to provide the materials or services.
