Motion by Kevin McGee to move the variance provided that the sign be wooden
and screwed or bolted into place and be non-illuminated. Motion seconded by
Elaine Cartwright. Motion approved 5-0.
Regarding the findings of fact, Mr. McGee felt a hardship exists. By granting
the variance, the Board is not treating the appellant any differently than others
in the same situation.
VIII. Appeal of Gerald Panske, owner of the property located at 8th
Avenue, proposes to construct a carport attached to the exis ing home
and accessory building. Since this property is a nonconforming use in
a manufacturing area, a variance is required to extend the nonconforming
use for residential purposes.
Ms. Porter stated this is a nonconforming use in a manufacturing district. The
appellant proposes to extend the use by constructing a carport attached to both
an existing home and an existing accessory building.
Mr. Gerald Panske, 107 W. 8th Avenue, stated he has a garage that he uses for
a shop as a hobby. He indicated he recently purchased a new van and would like
to protect it during the winter.
Mr. McGee inquired if this area is all manufacturing?
Ms. Porter replied yes.
Mrs. Cartwright inquired if the carport will cover a grass area?
Mr. Panske replied the carport will cover the existing concrete area.
Motion by Dan Goldthwaite to grant the appeal. Motion seconded by Harry Luebke.
Motion approved 5-0.
Regarding the findings of fact, Mr. Goldthwaite felt the lot is unusual and also
unusual circumstances exist due to the already nonconforming status of the proeprty.
Mr. McGee felt that given the shape of the property, the carport is a reasonable
request, especially since the garage is used as a shop.
IX. Appeal of David Binder, owner of the property located at 125 S. Knapp
Street, proposes to construct a 5' x 12' lean-to attached to the rear
of the existing accessory building and requests the following:
(1) A 7" rear yard setback is proposed; whereas a 2 1/2' rear yard
setback is required. (2) A 0' side yard setback exists; whereas a
2 1/2' side yard setback is required.
Ms. Porter stated the appellant proposes to construct a 60 square foot lean-to
at the rear of an existing accessory building. The side yard setback is existing
and will not be affected by the addition. However, a neighbor of the appellant's
has brought to our attention that the proposed rear yard setback should in fact
be 7", not 1 1/2' as indicated on the agenda.
