PURPOSE: ADOPT FINAL 1991 OPERATING PLAN FOR THE DOWNTOWN
OSHKOSH BUSINESS IMPROVEMENT DISTRICT
INITIATED BY: DOWNTOWN BUSINESS IMPROVEMENT DISTRICT BOARD
BID BOARD RECOMDfENDATION: Approved 6-0
WHEREAS, The Downtown Oshkosh Business Improvement District Board has
developed and approved its 1991 Final Operating Plan; and
WHEREAS, on October 18, 1990 the City of Oshkosli Common Council approved the
Parking Agreement for the Downtown Oshkosli Business Improvement District.
NOW, THEREFORE, BE IT RESOLVED by the Common Couilcil of the City of Oshkosh
that the attached Downtown Oshkosh Busiriess Improvement District Final 1991
Operating Plan is hereby approved and adopted.

ANNUAL REPORT
Over the past years many positive improvements have been made in downtown
Oshkosh. However, realizing that it takes more than just physical improvements to
maintain an active and economically viable downtown, in 1987 }.�iasiness people and
property owners petitioned �he City to create the Downtown Os}ikosh Business
Improvement District (BID) . 1991 will be the fourth year the BID has been in
operation. While free parking has always been a major element of tlie BID's
Operating Plan, the BID developed a Strategic Plan which identifies the strengths
and weaknesses of the BID, prioritized goals and established objectives designed
to achieve its goals.
Under the direction of the BID Board, significant progress has been made
towards the realization of these goals. One of the goals was to create a positive
image for the BID. Actions towards the accomplishment of this goal included the
completion of the Walkway East project, implementatiori of additional streetscaping
plans, building improvements undertaken in coi�junction with the City's Commercial
Rehabilitation Program, and assisting with improvements in Riverside Park.
Additionally, with the cooperation of the Oshkosh Boy's and Girl's Club, a
regularly scheduled physical clean-up campaign was started.
A second goal was to complete a uniform marketing plan for the BID by 1994.
Acting as a catalyst, the BID Board has been meeting with a loc�.l marketing firm
and has asked the firm to prepare some alternr�.tive marketing plans that can be
considered by the BID and other downtown associations and groups.
Establishing professional management to meet the needs of t}ie BID was another
goal. 1991 will be the second year the BID has contracted for the services of
staff from the Ostikosh Commercial Development Corporation to assist in the
management and coordination of BID activities.
Increasing quality occupancy was also set as a goal at the Strategic Planning
session. While it may be difficult to judge successful achievement of this goal,
there are indications of a continued positive trend. Since November, 1989, six
businesses either closed their doors or relocated outside the BID. However,
during the same period, 14 new businesses were established in the BID and 3
businesses relocated to the BID from other parts of tt�e City, for a net gain of 11
businesses. Additionally, the City has continued to assemble the land needed to
complete the redevelopment of the 100 Block of North Main Street.
Attempts to increase the linkage between Park Plaza and the rest of the
District was also established as one of the BID's goals. Cooperative efforts in
this regard resulted in many events being held in the downtown. In addition to
Concerts in the Park, Waterfest, and the Miss Wisconsin and C}�ristmas parades,
several new events took place during 1990. Some of tliese activities included the
Mayor's Breakfast, a Mini-Grand Prix, Summerfare, and an EAA Community Night.
There is the potential that some of these activities will become annual eveiits iri
the downtown.
A total of $82,993 was budgeted for the 1990 Operatil�g Plan and $67,695 was
either expended or encumbered for 1990 projects. The futids still encumbered, a
reimbursement of funds from the Mayor's Breakfast, and a small amount of
unexpended funds will be carried over into the 1991 Operating Plan.

In order to continue these efforts towards achieving its goals and maintai►►
the positive improvements in the downtown, ttie BID Board has prepared this 1991
Operating Plan, with a budget of $91,426 for submittal to the Oshkosh Common
Council.
THE BID LAW
On April 6, 1984, the State of Wisconsin passed a law (Act 184) which allows
for the creation of Business Improvement Districts. The purpose of the law is to
authorize cities, villages, and towns to create one or more business improvement
districts to allow businesses within those districts to develop, manage, maintain,
and promote their districts and to establish an assessment method to fund these
activities. A BID must be a geographic area wit}iin a municipality consisting of
contiguous parcels which are subject to real estate taxes.
The formation of a business improvement district allows downtowners (business
people, property owners, merchants, City officials and others) , to figure out what
needs to be done to upgrade and strengthen downtown and to pay the cost of doing
it, in whole or in part. It is a way for downtowners to decide what they want and
to finance it.
A BID is the best available method for business people to organize, coordinate
marketing and promotion efforts, provide management and maintenance programs, and
encourage business development. It affords property owners and business people a
very real role in directing those affairs within the district which influence
their investment and environment. It also ens�ires ttiat all beneficiaries of
District programs participate in the funding of the programs.

1991 OPERATING PLAN
I . ORGANIZATION
Pursuant to Section 66.08(3) , Wis. Stats. , a Downtown Business Improvement
District Board has been appointed by the City Man�ger and confirmed by the
Common Council. The Board is comprised of 10 members representing the
following interests: ,

In addition, Board members represerit different areas witliin the District, as
well as large and small businesses. As a City etitity, the Board will
conduct its affairs under the open meeting law aiid public record
requirements. The Director of Community Development or his designee serves
as the Secretary of the Board. BID Board meetings are held the t}iird
Tuesday of the montll in Room 204 of City Hall. A roster of the 1991 BID
Board members is included as Appendix D.
The Board will be responsible for the managemerit of the Busiiiess Improvement
District. Responsibilities of the Board include implementing the operating
plan and preparing annual reports on the District. The Board will also
annually consider and make changes to ttie operating plan and submit the
operating plan to the Common Council for approval.
City staff will be assisted by the Oshkosh Commercial Development
Corporation (OCDC) in the development and implementation of BID program
activities.
II. OPERATIONS
During 1991, the Downtown Oshkosh Business Improvement District will carry
out the proposed program of activities listed on the following pages.
Included are the expenditures associated with eflch �.ctivity. These
projected costs include all services related to program development,
materials and management.

PROPOSED 1991 BID PROGRAM/BUDGET - DOWNTOWN OSHKOSH
PROGRAM ACTIVITIES ' EXPENDITURES
I. Free Short Term Parking Subsidy $ 57,000.00
A. Reimburse City Parking Utility for loss
of parking meter revenue in return for
establishing free short term parking in
accordance with the Parking Agreement
between the BID and the City.
OBJECTIVE: Alleviate customer concern
about plugging meters and having correct
change, etc. , to encourage longer
shopping time, convenience in conducting
business transactions and establishing
better public relations.
II . Marketing/Promotion $ 9,000.00
A. Implement a marketing strategy to promote
and enhance downtown businesses images.
OBJECTIVE: Develop effective ways to
attract additional downtown business
patronage. Consideration will be given
to sponsoring summer concerts, making
storefronts and displays more attractive,
coordinated cleaning efforts, and other
activities to improve the image of
downtown.
B. Maintain business directory - includes
all business listings with map indicating
free parkir►g areas, long term parking and
public facilities.
OBJECTIVE: To in�form downtown business
people, customers, clients, Oshkosh
community �,nd visitors what goods and
services are available downtown, where to
find them, and the most convenient place
to park. ,

EXPENDITURES
C. Targeted business prospect development
(consists of, but not limited to, in-
person and telephone business
recruitments, mailings, advertisements,
travel expenses, prospect accommodations,
targeted promotions) .
OBJECTIVE: To fill vacant retail aiid
office space in providing needed goods
and services not available downtown or in
Oshkosh, which in turn generates
additional commercial traffic for
existing downtown businesses.
III. BID Management $ 12,000.00
A. Funds to be used to contract with an
agency to assist tl�e BID Board in
achieving goals and objectives
established by the BID in conformance
with the Operating Plan.
OBJECTIVE: Professional management
person to provide day-to-day leadership
and coordination of BID activities to
report directly to the BID Board.
IV. General $ 13,426.00
A. Activities and programs to improve the
BID District as required or permitted by
State Statutes, that are in compliance
with the Operating Plan and approved by
the BID Board, providing sufficient
program funds are available.

RELATIONSHIP TO DOWNTOWN PLANNING
In 1980, the Common Council adopted the Downtown Redevelopment Plan and
Implementation Strategy. The City has been actively implementing pliysical
elements of the Plan by constructing new convention centre and hotel facilities,
making infrastructure and streetscape improvements, assisting in building
rehabilitation. The Plan also recommended increasing organizational efforts
between the public and private sectors as well as establist�ing a voluntary special
assessment district. A follow-up study, Planning Report - Central City Oshkosh,
approved by the Common Council in 1987, expanded various elements of the previous
plans and in particular recommended the creation of a management vehicle and
funding base to serve the downtown area. The management tool recommended was a
Business Improvement District.
The Downtown Oshkosh Business Improvement District (BID) is consistent with
and critical to the continued successful implementation of these downtown plans.
The BID enables the private sector to undertake promotion, management, marketing,
and other programs essential to a prosperous downtown.
BID ASSESSMENT METHOD
The City of Oshkosh Dowritown Business Improvement District (BIll) specifll
assessment method utilizes assessed value information and property street footage
data, both of which are available from the City Assessor's Office. As the
absolute values of assessed value and footage cannot be combined, the values are
calculated as a percentage of the total assessed value and a percentage of the
street footage. The two percentages are added with the sum divided by 200
percent, which results in a proportionate value of the total district. A
property's proportionate value of the total District is multiplied by the District
budget, resulting in the special assessment for the property.
The raw data, assessment calculations, and proposed District assessment for
each property in the Downtown Business Improvement District, are presented on the
following pages. The data for the assessment method have been obtained from the
files of the City Assessor and are subject to final tabulation by the City. To
account for street footages, ranging from very short front footages to entire
blocks, the footage was computed in a manner similar to the City's normal special
assessment methodology.
Property used for commercial and manufacturing purposes in the District will
be assessed. However, real property used exclusively for residential purposes
will not be assessecl.

Dear Mr. Frueh:
I have reviewed 1983 Wisconsin Act 184 which created
Wis. Stats. Sec. 66 . 608 . I have also reviecaed the
operating plan subnitted for Business Improvement
District �1 for downtown Oshkvsh, and I have reviewed
� this specifically with regard to Wis . Stats . Sec.
66 . 608 (1) (f) 5 which calls for a legal opinion as to
certain requirements being made for an operating plan.
It is my opinion that the plan which has been adopted does
provide for a special assessment method and that said
method will include manufacturing premises . It is fur-
ther my opinion that the expenditures have been listed
and that a time for making said expenditures, at least
initially, has been set forth.
The operating plan certainly describes why and how the
BID will promote the orderly development of the municipality
and specifically relates this plan to the central business
district plan. It is , therefore, my opinion that Sec. 66 . 608
(f) 1-4 has been met and complied with. �
