HomeMy WebLinkAbout90-404 November 1, 1990 Nov 15, 1990 #90-390 90-404 ORDINANCE FIRST READING SECOND READING (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: AMEND ANIMAL PROHIBITIONS INITIATED BY: POLICE DEPARTMENT A GENERAL ORDINANCE OF THE CITY OF OSHKOSH AMENDING SECTION 6-7 OF THE OSHKOSH MUNICIPAL CODE PERTAINING TO ANIMALS PROHIBITED IN i THE CITY The Common Council of the City of Oshkosh do ordain as followse SECTION 1. That Section 6-7 of the Oshkosh Municipal Code ' pertaining to prohibited animals in the City is repealed and recreated to read as follows: � SECTION 6-7 ANIMALS, FOWL AND INSECTS NOT PERMITTED IN CITY No person shall bring into, keep, maintain, offer for sale or barter, or release to the wild, nor shall any person permit such activities to occur on premises owned, used, rented or maintained by that person, within the City any bees or other insects, any poisonous or venomous biting or injecting species of amphibian, � arachnid or reptile, fowl, chickens, ducks, turkeys, geese, cows, cattle horses, sheep, swine, goats or any other domesticated livestock, or any wild or vicious animal. As used in this Section, a vicious animal is any animal or animals that constitute a physical threat to human beings or other animals, including any animal which unprovoked bites a person or persons on two separate occasions within a twelve-month i period. No animal may be declared vicious for acts committed by the animal if being utilized by a law enforcement agenc� for law enforcement purposes while under the control and direction of a law enforcement officer, or if the animal was �rotecting or defending a human being within the immediate vicinity of the animal from an un�ustified attack, or if the animal was subjected to immediate teasing, tormenting, abusing or assault. As used in this Section, wild animai shall mean any live monkey, I or other non-human primate, raccoon, skunk, fox, wolf, poisonous snake, a snake not indigenous to Wisconsin or a snake exceeding three feet in length, leopard, panther, tiger, lion, lynx, or any other warm-blooded animal, which can normally be found in the wild state. This Section shall not be construed to ap�ly to slaughterhouses f if permitted under other provisions of this Municipal Code, to zoological parks, circuses or like entertainment organizations subject to prior approval by the City Health Officer or designee, to an educational or medical institution, or to areas agricultural in nature prior to annexation to the City subject to annual approval by the City Health Officer or desi nee.
