HomeMy WebLinkAbout90-409 SUBSTITUTE AMENDMENT November 15, 1990 #g0-4og RESOLUTION (CARRIED LOST LAID OVER WITHDRAWN ) PURPOSE: APPROVE ASSESSMENT POLICY/FRONTAGE ROAD SYSTEM (SUBSTITUTE AMENDMENT) INITIATED BY: COUNCIL MEMBER BINNER WHEREAS, the City of Oshkosh has determined to pave the U.S. 41 frontage roads in the City of Oshkosh; specifically, Koeller and Washburn streets, and WHEREAS, there is no appropriate Special Assessment Policy established in the City to provide payment of the costs of these roads; and WHEREAS, a special working group appointed by the Mayor met to review policies affecting the assessment of improvements for the U.S. Highway 41 frontage road system and endorsed the policy outlined below; NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of Oshkosh that a Special Assessment Policy for the pavement of Koeller and Washburn Street is established as follows: The assessment for the pavement of the frontage roads, specifically, Koeller and Washburn Streets, is $100. 00 per front foot. There is no assessment for property with less than a depth of 75 feet of ownership because there would be no benefit from the improvement. The assessment of $100 shall be paid by the following owners: Owners of the abutting land to a depth of 167'-- $50. 00 per lineal ft. - 13 - November 15, 1990 Res 90-409 Owners of the abutting land from a depth of 167' to a depth of 334' - $30. 00 per lineal front ft. Owners of the abutting land from a depth of 334' to a depth of 500' -- $20. 00 per lineal ft. Should a parallel street lie between 300 feet and 1000 feet of the frontage road improvements, then the above described assessment of $100 per lineal front ft. shall be paid by the owners of the property lying 1/2 of the distance from the front- age road to the parallel street. The assessment rate shall be: $50. 00 per lineal front ft. to property immediately adjacent to frontage road back to 1/3 of the assessable area. $30. 00 per lineal front ft. property in the assessable district lying between 1/3 and 2/3 of the distance from the Frontage Road. $20. 00 per lineal front ft. for property in the assessable area lying 2/3 of the distance from the Frontage Road to the end of the assessable property. Should a parallel street lie less than 300 feet from the frontage road improvements, then the above described assessment of $100 per lineal front ft. shall be reduced by 1/2 as follows: $25. 00 per lineal front ft. to property immediately adjacent - 14 - November 15, 1990 Cont'd. Res 90-409 to frontage road back to 1/3 of the assessable area. $15.00 per lineal front ft. property in the assessable district lying between 1/3 and 2/3 of the distance from the frontage road. $10. 00 per lineal front ft. for property in the assessable area lying 2/3 of the distance from the frontage road to the end of the assessable property. Al1 assessments levied hereunder notwithstanding curves in the street shall be based on street frontage. There shall be a 50% reduction in the assessments when there is assessable property adjacent to both sides of the frontage road. Any residentially zoned and used property which does not abut the improvement will not be assessed under the terms and provisions of this policy. In the event that county, state and/or federal aids, together with special assessments exceed the total cost of the project, then the special assessments shall be reduced so that the combination of special assessments and aids equals the project cost.
